Payment of Actual Costs. The District agrees to pay the actual cost of providing services under this Agreement. Said costs include salary and benefits for the assigned ACSO personnel and are identified in the 2020-2021 budget attached hereto as Exhibit BFY 2020-2021 Cost Estimate 3,” which reflects amounts required for such personnel in accordance with the applicable collective bargaining agreements.

Payment of Actual Costs. The Developer has heretofore and may hereafter elect to make Developer Advances to pay Actual Costs of such Authorized Improvements. The Developer shall also make Developer Advances to pay for cost overruns of such Authorized Improvements (after applying cost savings).

If the special education costs related to Charter School special education students are less than the amount of state and federal funds provided by the Kern County SELPA, the Charter School agrees those excess funds are to remain in the Special Education Funds with the District to be used to fulfill the Charter School’s obligations under this agreement in future years. If, under rules or regulations enforced by the local SELPA, the funding must be used within a stated time or be returned to the SELPA, the funding at risk of being returned may be used by the District to pay special education expenses of the District, and such use constitutes additional contribution by the Charter School toward encroachment of special education costs and expenses into District general revenue under Education Code Section 47646(c).
Payment of Actual Costs. Upon completion of installation of the facilities, District will determine the actual amount of its costs and expenses thereby incurred. If the actual amount exceeds the estimate previously paid, Applicants will pay to District the amount of such excess promptly upon demand. If the actual amount is less than the estimate previously paid, District will, upon completion and acceptance of the facilities, credit any excess money to any account then owed by Applicants or refund it. District's determination of such costs and expenses shall be final and binding provided that such determination shall be made upon the basis of generally accepted accounting principles consistently applied and shall be free of arithmetical error. In the event a performance bond or certificate of deposit is being held, it likewise will be released to Applicants upon acceptance of the work by District to the extent that it has not been used or required.

Payment of Actual Costs. The use of Bond Proceeds and other funds under any Bond Indenture shall be expressly limited to the uses provided therein. Except as may otherwise be expressly agreed to by the City and the Developer in the final agreement described in the Roadway Improvements Memorandum of Understanding, the Developer shall be obligated to pay the Actual Costs of Authorized Improvements necessary to complete construction of the Authorized Improvements, including any cost overruns (after applying any cost savings), notwithstanding insufficient Bond Proceeds or other funds under a Bond Indenture.

Following completion of the Project, Company shall determine its actual costs for the Project identified in the Scope of Work. Company's actual costs shall include all direct costs plus applicable overheads. If the actual costs are more than the estimated costs, Company will forward a copy of the actual costs to Customer along with an invoice for the additional amount within one hundred twenty (120) calendar days after completion of construction. Customer will have thirty (30) calendar days after receiving any invoice to make payment in full. If the actual costs are less than the estimated costs, Company will forward a copy of the actual costs to Customer along with a refund to cover the overage. Company shall keep accurate and complete accounting records in support of all cost xxxxxxxx and claims in accordance with generally accepted accounting principles. Upon request, Company shall provide accounting records to Customer following completion of Project.
