When an employee accepts a new position that is entitled to accumulated credits the employee may choose to carry those credits to their new position and when used would be paid at their current rate of pay.

PAYMENT OF WAGES AND ALLOWANCES. 12.01 ‌ Equal Pay‌ The Employer shall not discriminate between male and female employees by employing a person of one sex for any work at a rate of pay salaries that is less than the rate of pay at which a person of the other sex is employed for similar or substantially similar work. Paydays‌ (a) Employees shall be paid biweekly every second Friday. Auxiliary employees shall receive their pay no later than four weeks after they commence employment. Terminating employees will receive their final pay within eight days of the end of their final pay period. (b) A comprehensive statement detailing all payments, allowances and wages deductions shall be provided in each pay period. All premiums and allowances payable shall be paid out no later than the payday at the end of the second biweekly pay period after the pay period in which the premium was earned. (c) The Employer shall provide for the direct deposit (electronic funds transfer) of the employee's pay in a participating chartered bank, trust company or credit union of the employee's choice on or before the appropriate payday. Employee participation shall be compulsory except where access to a financial institution with capability of accepting direct deposit is not available. (d) If the pay is not available on the payday, the Employer shall arrange for the employee to be provided on the payday with an adequate advance on their salary. Rates of Pay‌ (a) Employees shall be paid in accordance with Schedule "A" attached hereto the rates of pay negotiated by the parties to this agreement, subject to Clause 27.7 - Salary Protection and forming part Downward Reclassification of this AgreementPosition. 12.02 (b) The distribution of pay shall be done in such a manner that the details of the pay shall be confidential. (c) The rates of pay in Appendix 1A and 1B - Salary Grid will be increased starting the first pay period after the following dates: Substitution Pay‌ (a) An employee will be granted substitution pay where the employee is: designated to perform the principal duties of or temporarily substitute in a higher paying position, or assigned to perform duties of a higher paying position which would warrant a higher classification. (b) The employee shall receive the rate for the job, where a single rate is established. If a salary range is established, they shall receive the minimum rate of the new salary range or the rate in the new salary range which is the closest step to 8% above their current rate, whichever is greater, but not more than the top of the new salary range. Employees on short-term disability leave, special leave, or any other paid leave of absence will be entitled to the basic rates of pay they received prior to substituting in a higher position. (c) Substitution pay is not payable when an employee has not been designated or assigned by the Employer to substitute, pursuant to (a)(1) or (2) above, or where an employee's current position normally requires periodic substitution in the higher position as defined in the functional job description. (d) Where this job description requires periodic substitution: substitution pay shall not be payable for periods of substitution of 70 consecutive work hours or less in the higher position; substitution in excess of the 70 consecutive work hours shall be payable from the commencement of the first shift of substitution; substitution is not payable for any period of substitution during vacation relief in the higher position. (e) Payment for leave under Clauses 20.1 - Bereavement Leave and 20.2 - Special Leave will be made at an employee's basic pay, except if an employee has been working in a higher paid position than their regular position for a majority of their regularly scheduled hours in the four pay periods preceding their leave, in which case they shall receive the higher rate. (f) If an employee substitutes in a higher paying classification where the salary placement in the salary range is less than the salary they would have received if substituting in a classification between their current classification and the substituting classification, then the salary placement will be equivalent to the higher rate. This shall only apply to classifications in the same classification series or the classification series in which the employee is substituting. An employee shall not receive a salary greater than the maximum of the range of the classification in which the employee is substituting. (g) Grievances concerning (a) above, that are filed at arbitration, may be referred by either party to the expedited classification appeal process where the dispute is a disagreement on the classification level. Rate of Pay on Reclassification or Promotion‌ (a) When an employee is promoted or reclassified to another a higher-paying position and such promotion would not otherwise result in any increase in salary at the time, such employee shall be placed in an increment level in his new position which will provide an immediate increase of no less than one (1) full increment in the salary schedule, the employee will receive the rate for the position if a single salary, or, in the case of positions on a salary range, will receive the rate in the salary range which is the closest step to 8% above their previous rate, or the minimum of the new scale over his previous range, whichever is greater, but not more than the top of the new salary rate. Any subsequent salary progression shall coincide with the next fiscal year budget approvals and/or annual salary reviewsrange. 12.03 Where (b) If an employee is promoted or reclassified to a higher paying classification where the salary placement in the salary range is less than the salary they would have received if substituting in a classification between their current classification and the new position, then the salary placement will be equivalent to the higher rate. This shall only apply to classifications in the same classification series or the classification series to which the employee is reclassified or promoted. An employee shall not receive a salary greater than the maximum of the range of the classification to which the employee is promoted or reclassified. Future increments, if any, shall be to the next higher step in the range of the classification to which the employee has been promoted or reclassified. (c) The above does not apply to new classifications established pursuant to Clause 28.2 - Changes to the Job Evaluation Plan and Benchmarks/Reference Jobs. Pay on Temporary Assignment‌ A regular employee temporarily assigned temporarily by the Employer to perform the duties of a position with a higher salary maximum, he shall be paid acting pay from the day he commenced to perform the duties of the higher salary position, at the next higher salary rate for the duration of the time temporarily assigned duties are performed. 12.04 Where the Employer temporarily assigns an employee to the duties and responsibilities of a position with a lower maximum salary where there is no work reasonably available for him in the position from which he was assigned, he shall continue to be paid at the rate applicable to the position from which he was assigned. 12.05 An employee may, upon giving at least fifteen (15) days notice, receive on the last pay day preceding commencement of his annual vacation any pay cheque which may fall during the period of vacation. 12.06 When an employee accepts a new permanent position that is not entitled to accumulated credits for vacation, statutory holiday time and lieu time all credits owing will be paid out at the employees rate of pay prior to moving to lower than their new position. For the purpose of this Article, promotion shall be defined as a move from one classification to another classification with a higher salary grid and shall not include a change of status from Graduate to Registered Nurse. An Employee who is moved to a lower rated classification will be placed at the level on the grid, if any, which most closely recognizes her experience level on the other grid. 22.03 Each Employee will be advanced from her/his present level to the next level set out in the Salary Schedule, twelve (12) months after she/he was last advanced on her increment date. If an Employee's absence without pay from the Employer exceeds thirty (30) continuous calendar days during each twelve (12) month period, save and except maternity and/or parental leave as recognized by the Employment Standards Act, her/his service review date will be extended by the length of such absence in excess of thirty (30) continuous calendar days. Each regular part-time Employee will be advanced from his/her present level on the salary schedule to the next level on the salary schedule after obtaining one year's service credit, calculated in accordance with the provisions of Article 13. For the purposes of calculating increment dates for those people affected by Social Contract, the time worked between June 14, 1993, and March 31, 1996, inclusive is to be ignored. Therefore, the time worked up to June 13, 1993, from the date of the previous grid step adjustment and the time worked after March 31, 1996, will count towards calculating the twelve (12) month period needed to achieve the next increment. 22.04 A Graduate Nurse or a Graduate Practical Nurse in the employ of the Employer upon presenting proof of current certification the College of Nurses of Ontario shall be given the salary of the Registered Staff Nurse as provided in this Article effective the date the nurse presents proof of successfully passing the certification examination to the Director of Nursing or his/her designate, or to the date of last hire whichever is later. A Registered Nurse and a Registered Practical Nurse is required to present to the Director of Nursing or his/her designate before February 15th of each year his/her current Certificate of Competence and his/her valid CPR certification. Such time shall be extended for satisfactory reasons. 22.05 When a mistake is made on an employee accepts a new position that is entitled to accumulated credits employees pay cheque it shall be corrected in the employee may choose to carry those credits to their new position and when used would following manner. PAYMENT OF WAGES AND ALLOWANCES. 12.01 22.01 The Employer shall pay salaries and wages in accordance with Schedule "A" attached hereto and forming part of this Agreement. Pay will be deposited bi-weekly into a bank account as designated by each employee. Except in circumstances beyond the Employer's control, the regular pay day shall be every second Friday, on which day Employees will be paid their respective wage entitlement provided however that when such Friday falls on a paid holiday herein mentioned, the wages shall then be paid at least 24 hours preceding the holiday. On each pay day, each Employee shall be provided with an itemized statement of his/her wages, overtime, and other supplementary pay and deductions. The Employer may not make deductions from wages or salaries unless authorized by statute, court order, arbitration order or by this Agreement. 12.02 When an employee is promoted to another position and such promotion would not otherwise result in any increase in salary at the time, such employee shall be placed in an increment level in his new position which will provide an immediate increase of no less than one (1a) full increment in the new scale over his previous salary rate. Any subsequent salary progression shall coincide with the next fiscal year budget approvals and/or annual salary reviews. 12.03 Where an employee is assigned temporarily Employees requested to perform the duties of a position with a higher salary maximum, he shall job classification will be paid acting at the rate of pay from for the day he commenced higher rated job classification for the full amount of time replacement is required (i.e. Team Leaders). (c) An Employee who is promoted to their new positiona higher rated classification within the bargaining unit will be placed on the level of the salary schedule of the higher rated classification so that she shall receive no less an increase in salary than the equivalent of one step in the salary range of the previous classification (provided that it does not exceed the salary range of the classification to which she has been promoted) and she/he shall retain her/his service review date for the purpose of wage progression. When For the purpose of this Article, promotion shall be defined as a move from one classification to another classification with a higher salary grid and shall not include a change of status from Graduate to Registered Nurse. An Employee who is moved to a lower rated classification will be placed at the level on the grid, if any, which most closely recognizes her experience level on the other grid. 22.03 Each Employee will be advanced from her/his present level to the next level set out in the Salary Schedule, twelve (12) months after she/he was last advanced on her increment date. if an employee accepts a new position that is entitled Employee's absence without pay from the Employer exceeds thirty (30) continuous calendar days during each twelve (12) month period, save and except maternity and/or parental leave as recognized by the Employment Standards Act, her/his service review date will be extended by the length of such absence in excess of thirty (30) continuous calendar days. Each regular part-time Employee will be advanced from his/her present level on the salary schedule to accumulated credits the employee may choose to carry those credits to their new position and when used would be paid at their current rate next level on the salary schedule after obtaining one year's service credit, calculated in accordance with the provisions of payArticle 13.

PAYMENT OF WAGES AND ALLOWANCES. 12.01 ‌‌ 20.01 The Employer shall pay employees covered by this Agreement salaries and wages in accordance with Schedule "A" Appendix A and Appendix B attached hereto and forming part of this Agreement.. Employees in the Administrative Classification shall receive a grid step increase upon the successful completion of their probationary period. Annual increases are as per Appendix A. 12.02 20.02 When an employee, on the request of the Executive Director, temporarily substitutes in or performs the principal duties of a higher paying position of a different nature, he/she shall receive the rate for that job. When an employee is promoted assigned to another a position paying a lower rate, his/her rate shall not be reduced. When an employee accepts moves from one job classification (regardless of duration) with a new position lower salary grid, he/she will be placed on the lower salary grid at a step which is closest to the employee’s existing salary grid. 20.04 It is agreed that staff and management will meet to review and update the policy regarding meal and other expenses incurred by employees in the course of doing their job, on an annual basis. 20.05 Any employee prevented from performing his/her regular work with the Employer on account of an occupational accident that is entitled to accumulated credits recognized by the Workplace Safety & Insurance Board as compensable within the meaning of the Workplace Safety & Insurance Act or a non-occupational accident recognized by the insurance carrier, shall receive from the Employer the difference between the amount payable by the Workplace Safety & Insurance Board or Short-Term Disability Benefits from the insurance carrier and his/her regular salary. It is understood that such difference will be charged against the employee's sick leave bank. At the point when the sick leave bank is exhausted, the employee may choose request that the Employer top up payments from their overtime and vacation banks. At the point when all banks are exhausted, the Employer will no longer top up payment from the Workplace Safety & Insurance Board or Insurance Carrier. It is also understood that no employee shall be entitled to carry those credits receive more total monies under this provision than he/she would normally receive from his/her regular salary after all deductions including tax. It is further understood that at such time as the employee is deemed to have suffered a long-term disability as defined by the Workplace Safety & Insurance Board and/or the Insurance Carrier, this section shall no longer apply. Employees in receipt of Long-Term Disability benefits, shall be permitted to receive from the Employer the difference between the amount payable by the Insurance Carrier and eighty-five percent (85%) of his/her regular salary. It is understood that such difference will be charged against the employee’s sick leave bank. At the point when the sick leave bank is exhausted, the employee may request that the Employer top up payments from their new position overtime and vacation banks. At the point when used would all banks are exhausted, the Employer will no longer top up Long-Term Disability payments from the Insurance Carrier. 20.06 Prior to commencement of employment and maintained annually, an employee who is required by the Employer to use his/her personal automobile for the performance of his/her duties for the Employer shall provide the Employer with proof of his/her being covered by an all inclusive business use automobile insurance policy in the amount of not less than one million dollars ($1,000,000.00) public liability and property damage prior to his/her using his/her personal automobile for the performance of his/her duties for the Society. Upon complying with the above, an employee who uses his/her personal automobile shall be paid reimbursed for such use at their current rate the following rates during the term of paythis Collective Agreement: (1) 0 - 5,000 kilometres – 40¢ per kilometre (effective on ratification) 42¢ per kilometre (effective July 1, 2006) (2) 5,001 kilometres or more – 34¢ per kilometre (effective on ratification) 36¢ per kilometre (effective July 1, 2006) The Employer will pay the deductible portion of each P.L./P.D. household claim to a maximum of two hundred and fifty dollars ($250.00) and each comprehensive automobile claim to a maximum of twenty-five dollars ($25.00) and non-insurable items, except cash, to a maximum of two hundred and fifty dollars ($250.00), provided: (a) the claim arose in the direct course of duty; (b) the employee has not contributed to the cause of the damage claim; and (c) the employee has taken proper steps to prevent the damage. The parties agree to review the total mileage compensation package every six (6) months during the life of this Agreement or upon Ontario Government change, whichever comes first.
