Policy Exclusions. A Exclusions applicable to all Insuring Clauses RSA shall not be liable to indemnify the Insured against any Loss which arises:
1) Bodily Injury/Property Damage for any bodily injury, mental anguish or emotional distress, illness, disease or death of any person, or damage to or destruction of any tangible property including loss of use thereof,
a) this Exclusion shall not apply to bodily injury in respect of that element of Loss for Insured Persons comprising Defence Costs otherwise covered under Claims Condition B. (“Allocation”) unless and until such time as that Insured has been found by way of any judgment or other final adjudication to have committed such act of dishonesty or fraud; and
b) RSA reserves its right to reduce liability under this Policy by an amount that fairly represents the extent to which RSA’s interests have been prejudiced by the Policyholder’s act or omission to have placed or in force valid and collectable valid and collectable Employers Liability and Third Party Liability insurance; and
c) Loss has not been declined, refused, exhausted under a valid and collectible Property Damage, Employers Liability and Third Party Liability insurance;
d) this exclusion shall not apply to cover provided for under V. CHARITY PROTECTION PROFESSIONAL INDEMNITY
2) Fraud or Dishonesty directly or indirectly based on, arising out of, or in any way involving any act of dishonesty or fraud found by way of any judgment or other final adjudication to have been committed by any Insured, until such time as that Insured has been found by way of any judgment or other final adjudication to have committed such act of dishonesty or fraud;
3) Illegal Profit or Advantage directly or indirectly based on, arising out of, or in any way involving any Insured being found by way of judgment or other final adjudication to have gained any profit or advantage or to have received any remuneration to which that Insured was not legally entitled, until such time as that Insured has been found by way of any judgment or other final adjudication to have gained any profit or advantage or to have received any remuneration to which that Insured was not legally entitled;
4) Prior Knowledge of Fact, Circumstance or Situation directly or indirectly based on, arising out of, or in any way involving any fact, Circumstance or situation:
a) which has been or should have been the subject of any written notice given under any contract of insurance of which this Policy is a direct or indirect...
Policy Exclusions. This insurance does not cover claims, losses or expense caused by or arising from:
5.1 the Insured Person committing, or attempting to commit, suicide or any act of intentional self-harm or self-exposure to needless peril (except in an attempt to save human life);
5.2 the Insured Person taking part in civil commotion or riot of any kind;
5.3 war, invasion, act of foreign enemy, hostilities whether war be declared or not, civil war, rebellion, revolution, insurrection, or military or usurped power;
5.4 the Insured Person committing any criminal or unlawful act;
5.5 the Insured Person engaging in active service in the armed forces of any nation;
5.6 the actual or threatened malicious use of pathogenic or poisonous biological or chemical materials by any person;
5.7 an Act of Terrorism or any action taken in controlling, preventing, suppressing or responding to an
5.8 ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel, or the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof;
5.9 the Insured Person taking part in any of activities not stated in the Schedule;
5.10 the intoxication of the Insured Person by means of alcohol or other drugs;
5.11 any medical condition of the Insured Person which was in existence before the start of the Period of Insurance;
5.12 any professional medical, hospital, surgical, manipulative, massage, physiotherapeutic, X-ray or nursing treatment carried out on the Insured Person.
5.13 any practices or activities excluded or forbidden by any professional sports contract to which the

Apollo will have no liability for any failure to meet the Service Level to the extent arising from: (i) use of the Service by Customer or its Users other than as authorized under the Agreement, Order, or Documentation; (ii) errors or unavailability of Customer Data or Third Party Applications that provide the same for use with the Service; (iii) Customer or User equipment, networks, or devices; (iv) third party acts, or services and/or systems not provided by Apollo or Apollo’s contractors; (v) general Internet problems, or other factors outside of Apollo’s reasonable control, including force majeure events; (vi) evaluation, beta, demonstration, non-production or proof-of concept uses or versions of the Service. Apollo will have no obligations to provide support for Third Party Applications or services, or for custom scripts or code not native to the Service. Additionally, if Customer desires technical or professional services from Apollo, including but not limited to services related to data modeling, code development, migration, or product training, then Customer and Apollo must enter into a mutually executed SOW for such services.
