The information may be disclosed to other parties if the requirements set out by law are met. The file descriptions and data protection principles can be found on the telecommunications operator’s website. The customer has the right to prohibit the telecommunications operator from using or disclosing any of their details for direct advertising, distance selling or other direct marketing purposes, or to an address directory service, or for marketing surveys and opinion polls. Electronic direct marketing usually requires the customer’s prior consent. The telecommunications operator may process traffic and location data, for example, for the implementation and usage of services, for billing and technical development, and for marketing purposes in compliance with the valid legislation. The data processed includes, for example, the type of the mobile phone and other details pertaining to the terminal device, the location data and traffic data associated with communications and service use, such as subscription numbers, and the times and durations of the connections. The traffic and location data may be processed for as long as the above operations necessitate. PROCESSING OF CUSTOMER INFORMATION. 9.1 Processing of Customer information and identification data The Telecommunications Operator is allowed to process Customer register information for the purposes of Customer relationship management, service development, and marketing in a way described in the register declaration in effect at any given time. The information can be delivered and to a third party under the statutory requirements. The register declarations and principles applicable to protection of privacy are available on the website of the Telecommunications Operator. The Customer has the right to deny the Telecommunications Operator disclosure of the Customer’s Customer information for the purposes of direct advertising, distance selling, or other direct marketing, address enquiries service, or marketing or opinion surveys. Electronic direct marketing operations usually require the Customer’s prior consent in writing. The Telecommunications Operator is allowed to process identification and location data for the purposes of service production and use, invoicing, technical development work, and direct marketing in compliance with the laws and regulations in force at any given time. The information to be processed includes, for example, the device type of the mobile phone, other information related to the terminal device, location data of the subscriber connection, and other identification data related to communication and service use, such as subscriber numbers, and the times and durations of established connections. Identification and location data shall be processed only for the duration of the operations required for the purposes listed above. The Telecommunications Operator has the right to record Customer calls and other similar Customer communication, such as marketing calls. The Telecommunications Operator may use the recordings to verify business transactions, sort out complaints, monitor quality, and for training purposes, for example.

Without limiting the foregoing, you agree that you will not use Mobile Banking or the Software to transmit or disseminate: (i) junk mail, spam, or unsolicited material to persons or entities that have not agreed to receive such material or to whom you do not otherwise have a legal right to send such material; (ii) material that infringes or violates any third party’s intellectual property rights, rights of publicity, privacy, or confidentiality, or the rights or legal obligations of any wireless service provider or any of its clients or subscribers; (iii) material or data, that is illegal, or material or data, as determined by First Resource Bank (in its sole discretion), that is harassing, coercive, defamatory, libelous, abusive, threatening, obscene, or otherwise objectionable, materials that are harmful to minors or excessive in quantity, or materials the transmission of which could diminish or harm the reputation of First Resource Bank or any third-party service provider involved in the provision of Mobile Banking; (iv) material or data that is alcoholic beverage-related (e.g., beer, wine, or liquor), tobacco-related (e.g., cigarettes, cigars, pipes, chewing tobacco), guns or weapons-related (e.g., firearms, bullets), illegal drugs- related (e.g., marijuana, cocaine), pornographic-related (e.g., adult themes, sexual content), crime-related (e.g., organized crime, notorious characters), violence-related (e.g., violent games), death-related (e.g., funeral homes, mortuaries), hate-related (e.g. racist organizations), gambling-related (e.g., casinos, lotteries), specifically mentions any wireless carrier or copies or parodies the products or services of any wireless carrier; (v) viruses, Trojan horses, worms, time bombs, cancelbots, or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information; (vi) any material or information that is false, misleading, or inaccurate; (vii) any material that would expose First Resource Bank, any third-party service provider involved in providing Mobile Banking, or any other third party to liability; or (viii) any signal or impulse that could cause electrical, magnetic, optical, or other technical harm to the equipment or facilities of Fiserv or any third party. You agree that you will not attempt to: (a) access any software or services for which your use has not been authorized; or (b) use or attempt to use a third party’s account; or (c) interfere in any manner with the provision of Mobile Banking or the Software, the security of Mobile Banking or the Software, or other customers of Mobile Banking or the Software; or (d) otherwise abuse Mobile Banking or the Software.

  • Patient Information Each Party agrees to abide by all laws, rules, regulations, and orders of all applicable supranational, national, federal, state, provincial, and local governmental entities concerning the confidentiality or protection of patient identifiable information and/or patients’ protected health information, as defined by any other applicable legislation in the course of their performance under this Agreement.

  • Safeguarding Information Not to use or disclose any information concerning a recipient of services under this contract for any purpose not in conformity with state and federal law except upon written consent of the recipient, or the responsible parent or guardian when authorized by law.

  • Processing of Data You acknowledge and agree that with each use of the Service initiated by your xxxxxxxxxx.xxx authenticated Users the Service will access Your xxxxxxxxxx.xxx account to retrieve, store, manipulate, process and modify Customer Data based on Your configuration of the Service (“Process”) and You expressly consent to such access solely as is necessary to provide the Service or Support Services. If the Service cannot for any reason access Your xxxxxxxxxx.xxx account, Conga will be excused from any nonperformance of the Service. You acknowledge that to provide the Service, Customer Data leaves the xxxxxxxxxx.xxx system. Xxxxxxxxxx.xxx is not responsible for Customer Data when it is outside of the xxxxxxxxxx.xxx system.
