Project Cooperation. The Parties recognize that the construction to take place under this Agreement involves unique and special circumstances which dictate the need for the parties to develop specific procedures to promote high quality, rapid, and uninterrupted construction methods and practices. The Parties therefore agree that maximum cooperation among all Parties involved is required; and that with construction work of this magnitude, with multiple contractors and crafts performing work on multiple sites of over an extended period of time, all Parties agree to work in a spirit of harmony and cooperation, and with an overriding commitment to maintain the continuity of Project Work. Further, the Parties recognize that an act of god or an act of war could require the District to partially or fully suspend or terminate Project Work. The Parties shall fully cooperate with any request by the District to redirect their equipment, skills, and expertise to support the District’s efforts necessitated by such events.

a. At the first indication of non-cooperation, Consultant shall provide written notice to ODA WOC Administrator of the specific acts or inaction indicating non-cooperation and of any deliverables that may be delayed due to such lack of cooperation by other entities referenced in the SOW.
x. XXX WOC Administrator shall contact the non-cooperative entity/s to discuss the matter and attempt to correct the problem and expedite items determined to be delaying Consultant/project. If Consultant has followed the notification process described in section “a”, and delinquency or delay of any deliverable is found to be a result of the failure of other referenced entities to provide information, resources, assistance, or cooperation, as described in the SOW, Consultant will not be found in breach or default with respect to delinquencies beyond any reasonable control of Consultant; nor shall Consultant be assessed or liable for any damages arising as a result of such delinquencies. The 4M MC Cooperation is based on the fundamental principle of subsidiarity and decentralization, meaning that, apart from the provisions which are strictly necessary to coordinate their matching into a price coupling mechanism, each Party will keep its full independency and self-determination for its own business.
Project Cooperation. Possible paths of collaboration in public workshops and seminars have been be explored by the Consortium when it is considered suitable and of interest for the project and the partners. Although, the assessment of the collaboration have been be studied case by case taking into account the goals of the project and partners involved, below there is a preliminary list of ongoing European projects that could be assessed. For instance, a first contact with the CertifHy project has been established, attending to the proposed CertifHy workshops and following the progress of the project in order to search for synergies. Nevertheless it is considered that the timing of both projects has been not be perfect, as CertifHy is at the end of the duration, to prepare common activities. But the results of the project have been be very interesting also to be shared or distributed to Elyntegration stakeholders, to make them aware on guarantees of origin and new potential business models. Also the partners from FHa went in July 2017 to the symposium of Qualygrids in representation of Elyntegration. And those from Aachen presented the network services part of the project. The idea was to coordinate with other projects that have to do with electrolysers. The Elyntegration has collaborated with the FCHJU European Project Ely4Off in the organization of a Workshop.
