Promotions and Filling of Vacancies. 10.1 A vacant position is defined as an open position within the aide classification, created by resignation, retirement, death, promotion, or release of an employee from a position. A position shall not be considered vacant until the Board determines and/or intends to fill said position. (a) Notice of the position to be filled shall be posted by the Board in a manner sufficient to provide current employees with reasonable opportunity to become aware of the position. Notice shall also be provided via electronic mail to all bargaining unit employees. The posting period shall be not less than five (5) working days. (b) Notices of job vacancies occurring during the summer shall be posted for ten (10) working days, shall be sent to the Union President or his designee for distribution to interested employees, and shall be provided via electronic mail to all bargaining unit employees. 10.3 Qualified employees under a contract with the Board of Education as an aide will be given first consideration for any vacant position. Factors to be used in selecting the employee for the position shall be seniority in the employee group, skill, ability, knowledge, experience and past performance on job evaluations. An arbitrator shall have no authority to overturn or set aside the employer's decision as to its consideration concerning an employee's skill, ability, knowledge, experience and/or past performance related to a bargaining unit member's ability to fill a vacant position. 10.4 An employee who successfully bids for a position may not bid for another position for six (6) months after the date of assignment to the new position. 10.5 An employee assigned pursuant to this Article to a new position shall serve a probationary period of sixty (60) calendar days commencing with the effective date of the assignment. The Board may remove the employee from the assigned position after the completion of the first thirty (30) calendar days of the probation period and prior to the expiration of the sixty (60) calendar days probationary period. An employee removed during the probationary period shall have the right to return to his former position and former rate of pay without loss of seniority. 10.6 If a position vacated by the reassignment of the incumbent pursuant to this Article is to be filled, after any transfers are made, it shall be filled on a temporary assignment basis until the employee completes his probationary period. 10.7 Nothing contained herein shall restrict the right of the Board to fill any position temporarily until the posting and bidding process provided herein is completed. 10.8 The Union shall be furnished names and addresses of all new employees hired into the bargaining unit within ten (10) days after their date of hire. 10.9 Employees promoted pursuant to this Article shall have the right to request reinstatement to their former positions after completion of the first thirty (30) calendar days of the probationary period and prior to the expiration of the ten (10) working days probationary period. They shall receive their former rate of pay and shall not lose their seniority. 10.10 Nothing herein shall restrict the right of the Board to fill any position temporarily until the posting and bidding process provided herein is completed. . 10.3 For purposes of this Article, the bargaining unit shall be considered divided into three employee groups: Office and Auxiliary Personnel; Operational Personnel; Food Service Personnel. All employees within the bargaining unit may bid for the position.

Where skill, experience ability, knowledge and past performance on job evaluationsare equal, seniority shall prevail. An arbitrator shall have no authority to overturn or set aside the employer's decision as to its consideration concerning an employee's whether skill, ability, knowledge, experience and/or and past performance related to a bargaining unit member's ability to fill a vacant positionare equal unless the arbitrator can find that the employer abused its discretion.
10.4 10.5 If a position is not filled by the selection of an employee within the appropriate employee group the position may be filled by the selection of a qualified employee from either of the other employee groups with the consent of the employee. District seniority skill, ability, knowledge and record of past performance shall be factors in determining which employee shall be promoted. Where skill, ability, knowledge and past performance are equal, seniority shall prevail. An arbitrator shall have no authority to overturn or set aside the employer's decision as to whether skill, ability knowledge, and past performance are equal unless the arbitrator can find that the employer abused its discretion.

10.11 Vacancies in positions to be filled shall be posted within fifteen (15) calendar days of the vacancy. Successful bidders will be awarded the position vacated by the former employee with seven (7) calendar days after bidding is closed.
10.12 The Board will provide to the Union alisl of all persons who bid on a position to be filled within ten (10) calendar days after the position is filled.
10.13 The Union shall. be furnished names and addresses of all new employees hired into the bargaining unit within ten(10) day~ after their date of hire.
10.14 When an employee in a bargaining unit is promoted to ahigher classification, he shall be placed on the step in that higher classification which has an hourly rate which prOVides at least a three (3%) percent increase in the employee's h~urly wage rate, but in ~o event shall the employee be placed on a step higher than the step from which he was promoted.
10.15 Vacancies in entry-level position shall be open to bidding by the entire bargaining unit prior to filling the position from a civil service eligibility list. nie Board shall have the right to judge qualifications, administer tests to determine qualifications, and to select an employee on the basis of qualifications. ,
10.16 The Board will post a notice describing the nature of any test to be given and identifying the person to give the test. Test scores will be posted. .
