PROMOTIONS AND VACANCIES. 11.01 Vacancies within the scope of this Agreement shall be visibly posted on the bulletin board that is located in each outlet covered by this Agreement, within seven (7) calendar days from which the vacancy occurred and employees shall be allowed a further seven (7) calendar days in which to make a written application for such vacancy. The Co-operative will notify all Shop Stewards of all such vacancies when the vacancy is posted. 11.02 New positions within the scope of this Agreement shall be visibly posted on the bulletin board that is located in each outlet covered by this Agreement and employees shall be allowed seven (7) calendar days in which to make a written application for this new position. The Co-operative will notify all Shop Stewards of all such new positions when the new position is posted. 11.03 Vacancies and new positions within the scope of this Agreement shall be filled within a further seven (7) calendar days following completion of the seven (7) calendar days the vacancy and/or new position was posted for bids. 11.04 An employee transferred or promoted to a vacancy or new position shall be on a trial period of three (3) months. If the employee is required to revert to their former position or if the employee voluntarily decides to revert to their former position during this three (3) month trial period, said employee shall be entitled to do so without any loss of benefits and seniority and shall receive their former rate of pay. 11.05 Vacancies and new positions within the scope of this Agreement shall be filled on the basis of merit, ability and fitness, as determined by the Co- operative, to perform the work satisfactorily. Where merit, ability and fitness are comparable and sufficient, the senior applicant will be selected.

PROMOTIONS AND VACANCIES. 11.01 Vacancies within ‌ (a) When permanent vacancies occur in the scope of this Agreement shall bargaining unit and the Company wishes to fill such job vacancies, the vacancy will be visibly posted on the bulletin board that is located in each outlet covered by this Agreement, within seven for a period of ten (710) calendar days from which the vacancy occurred and employees shall be allowed a further seven (7) calendar days in which to days. (e) Where there are no suitable applicants under this Article, the Company shall be free to fill the vacancy at its discretion. Any such written request will remain on file to the end of the calendar year in which it was submitted, and such request will be recognized past this period provided the employee is required provides evidence of prior submission. Posting of temporary vacancies, lasting more than one (1) month will state that the vacancy is temporary and the reason for such vacancy. Employees returning will be placed on their former job, and the employee who filled the temporary job will have the right to bump an employee who filled the job which he left to assume the temporary position. The temporary designation will only apply to the original job vacancy and the job from which the replacement came. 6.04.06 An employee who is placed on a job per paragraphs 6.04.02, 6.04.03, 6.04.04 or 6.04.05, will be allowed the normal familiarization period and will be given the normal instructions for such job during the familiarization period. In the event that the employee fails to meet the job requirements during the familiarization period he shall be returned to his previous job or a comparable job at the same grade level as his previous job. 6.04.07 The Company will post notices of first line supervisory jobs and non- supervisory jobs outside the bargaining unit in the North York Plant. Written applications from the bargaining unit employees will be considered before an appointment is made. Grievances originating in connection with this clause shall only be subject to the grievance procedure up to and inclusive of the third step. 6.04.08 When qualifications for a job are determined by the Co- operative, to perform the work satisfactorily. Where merit, ability and fitness are comparable and sufficientwritten tests, the senior applicant following shall apply: (a) The Union will be selectedadvised upon request of the name of any employee(s) taking the test. (b) Test will be scheduled no earlier than five (5) days after the completion of the posting period. (c) The employee and the Union will be advised of the required pass xxxx. (d) If there is any complaint following the taking of any test, the test and results shall be shown to and discussed with the employee alone or with the xxxxxxx present if the employee so requests. In addition the test and results will be shown to and discussed with the Union upon request. (e) If no employee within the bargaining unit achieves a passing xxxx, the Company will discuss with the Union the possibility of filling the job, by providing additional training to someone within the bargaining unit, prior to hiring from outside. (f) In the interest of assisting employees wishing to further their technical knowledge, the company will provide the following on request: (i) a general outline of the areas to be covered by the test, and a list of textbooks or other publications covering the content of the test. (ii) feedback to employees that have failed tests regarding general areas requiring improvement. (iii) access to technical reference materials related to areas to be tested, subject to availability. Preference in supplying copies of this material will be given to applicants for a job requiring the test or to employees who have failed the test.
