Promotions or vacancies in bargaining unit positions above the entry level shall be filled by internally promoting permanent employees in the Airport Fire Section of the Fire Rescue Division provided there are qualified eligible internal applicants. If it is determined that there are no qualified eligible internal candidates, prior to recruiting from outside the County, the Division of Human Resources Director and the Fire Rescue Division Director (or designee) shall determine whether a reasonably limited training period would result in qualified eligible internal candidates. L. The Division of Human Resources will coordinate with the Fire Rescue Division to schedule test or interview times to minimize potential hardships on employees due to shift scheduling. M. In the event the employee believes he/she has been discriminated against in the examination process, the Office of Equal Employment Opportunity shall be available to investigate those concerns. N. Any reinstatements into the Bargaining Unit shall be to entry level Firefighter only. Reinstated Unit members shall not have accrued seniority during separation and time in service shall be considered interrupted. Seniority shall start on the date of reinstatement. After an employee completes the electronic request, the online application/recruitment system will notify the employee when the classification is announced. The employee can then apply for the position. There shall be filled from eligibility lists. Eligibility lists for all classifications in the Bargaining Unit shall be maintained at all times by the Division of Human Resourcesa one hundred and eighty (180) calendar day probationary period served when an employee is promoted. The certification, ranking and qualifications shall be determined by the Division of Human Resources Director in accordance with Merit System practices and procedures.

If such employee does not perform the duties satisfactorily within such time, or if the employee so wishes, he/she shall revert to a recognized Emergency Medical Services magazinehis/her former position without loss of seniority. If it appears to the Co-operative that such employee is incapable of performing the duties satisfactorily, he/she may be required to revert to his/her former position before the expiration of three (3) months.
5. A subscription If the Co-operative provides training to fill a vacant position in the American Heat Video or equivalentCo-operative, the first opportunity will be granted according to seniority if it appears that the senior person has sufficient ability to fill the position.

10.06 Employees, who are out of town on Co-operative business may, prior to their leaving, apply for specific job vacancies that might occur during their absence, on forms provided by the promotion at Co-operative. Employees on an approved absence such time that as WCB, WI, LTD, Maternity or Parental leave, Leave of Absence or vacation will be eligible to apply for a vacancy is created.
P. In job posting while on leave provided it does not unreasonably delay the spirit of cooperative labor/management relations, the Division of recruitment process. The employee shall provide Human Resources with written notification prior to going on leave to advise that they are applying for any job postings occurring during the duration of their Leave of Abseence/vacation. If the employee is required to revert to their former position or if the employee voluntarily decides to revert to their former position during this three (3) month trial period, said employee shall return be entitled to do so without any loss of benefits and seniority and shall receive their former rate of pay.
10.05 Vacancies and new positions within the classification held scope of this Agreement shall be filled on the basis of merit, ability and fitness, as determined by the Co-operative, to perform the work satisfactorily. Where merit, ability and fitness are comparable and sufficient, the senior applicant will be selected.
10.06 Employees, who are out of town on Co-operative business may, prior to their leaving, apply for specific job vacancies that might occur during their absence, on forms provided by the promotion at Co-operative. Employees on an approved absence such time that as WCB, WI, LTD, Maternity or Parental leave, Leave of Absence or vacation will be eligible to apply for a vacancy is created.
P. In job posting while on leave provided it does not unreasonably delay the spirit of cooperative labor/management relations, the Division of recruitment process. The employee shall provide Human Resources with written notification prior to going on leave to advise that they are applying for any job postings occurring during the duration of their Leave of Absence/vacation. The Co-operative shall meet with have the union on their request right to provide temporarily fill the union with the opportunity full-time vacancy until said successful applicant returns to share its perspectives regarding the training and experience requirements as well as promotional examination procedureswork.

PROMOTIONS AND VACANCIES. A. Promotions or vacancies in bargaining unit positions above the entry level shall be filled by internally promoting permanent employees in the Airport Fire Section of the Fire Rescue Division provided there are qualified eligible internal applicants. If it is determined that there are no qualified eligible internal candidates, prior to recruiting from outside the County, the Division of Human Resources Director and the Fire Rescue Division Director (or designee) shall determine whether a reasonably limited training period would result in qualified eligible internal candidates.
B. Promotions or vacancies shall be filled from eligibility lists. Eligibility lists for all classifications in the Bargaining Unit shall be maintained at all times by the Division of Human Resources. The certification, ranking and qualifications shall be determined by the Division of Human Resources Director in accordance with Merit System practices and procedures.
C. The duration of each eligibility list shall remain in effect for a period of two (2) years and may be extended for a period of six (6) months at the discretion of the Division of Human Resources Director. If the eligibility list is exhausted prior to expiration, the examination will again be given. Reasonable efforts will be made by the County to administer the promotional examination thirty days prior to the expiration date of the current promotional eligibility list.
D. The following requirements shall be in effect with regard to promotional procedures:
1. Time In the event that a vacancy occurs in grade eligibility requirement for promotional examinations shall be measured in terms of continuous service. An interruption for an authorized leave of absence without pay shall not constitute a break in continuous service; however, the time of a leave of absence without pay shall not be credited as time in service.
2. The time in grade eligibility criteria for promotional examinations shall be by the closing date as published on the official Division of Human Resources job announcement.
E. Promotions to any rank/classification covered by this Agreement shall be determined by a job related examination/selection process developed by and the Division of Human Resources following consultation with Court determines to fill the union.
F. A cutoff score on each examination phase will be necessary to attain an overall minimum qualifying score.
G. Upon written request of the unionvacancy, the Division of Human Resources Director may elect to appoint a representative from Division of Human Resources/EEO to attend the selection interview process within the Fire Rescue Division.
H. If a bargaining unit member is passed over for promotion, the Division Director or designee shall, at the employee's request, counsel the individual(s) on possible reasons and areas to concentrate which may improve their chances for promotion in the future. The Division Director or designee has the absolute discretion to select any one of the candidates certified to the Division from the eligibility list maintained by the Division of Human Resources.
I. Promotional examination announcements vacancy shall be posted conspicuously for a period of five (5) working days within the County where the vacancy occurs and the Union may post the vacancy notice at all other locations of the Airport Fire Station at least fourteen (14) calendar days prior Court. The posting shall list the name of the vacant position and the qualifications for said position. Bargaining unit employees who wish to be considered to fill the vacancy may submit a letter of interest to the official application closing dateCourt Administrator in the County where the vacancy exists within the posting period. The Court shall have the right to reject any applicant who does not meet the qualifications set forth in the posting.
J. The promotional examination process shall begin no less than sixty (60) and not more than seventy-five (75) days after closing of applications.
K. The County will provide and maintain the following reference materials at the Airport Fire Station as designated below, including, but not limited to:
1. Operations & Policy Manuals (OPM).
Section 2. International Fire Service Training Association (IFSTA) manuals.Promotions to any vacant position in the Court in Xxxxxxxx, Kalkaska or Otsego Counties shall be offered to Court employees where the vacancy exists. The most senior employee in the county where the vacancy exists who meets the posted qualifications and demonstrates the ability to
Section 3. A subscription to a recognized Fire magazine.
4. A subscription to a recognized Emergency Medical Services magazine.
5. A subscription to the American Heat Video or equivalent.
6. A subscription to the Pulse Video or equivalent.
7. A complete and continually updated copy of the Civil Service Rules and Regulations.
8. An updated pharmaceutical reference book for all ALS units.
9. A dictionary.
10. An updated paramedic manual for all ALS units. An additional selection of reading materials and training aids will be maintained and upgraded in the Division's Training Bureau, and will be available to employees upon request. Prior to the closing date for a promotional examinationWhen an employee is promoted, the County will provide an applicable list employee shall be given a probationary period of reading material as a guide up to aid employees in their preparation for thirty calendar (30) days. L. The Division of Human Resources will coordinate with the Fire Rescue Division to schedule test or interview times to minimize potential hardships on employees due to shift scheduling.
M. In the event probationary period the employee believes he/she has been discriminated against in the examination process, the Office of Equal Employment Opportunity shall is found to be available to investigate those concerns.
N. Any reinstatements into the Bargaining Unit shall be to entry level Firefighter only. Reinstated Unit members shall not have accrued seniority during separation and time in service shall be considered interrupted. Seniority shall start on the date of reinstatement. Employees reinstated within one year of separation may apply qualified for the position previously held by submitting a completed application during and is not able to perform the filing period of a subsequent promotional announcementwork, or the employee decides they do not want the position, the employee shall be returned to their previous position. Employees filling vacancies or receiving promotions under this Article shall assume the wage rate to that step which provides them with an increase in pay in the new job classification.
O. An employee who requests and is granted a voluntary demotion:
1Section 4. During Promotions shall be at the probationary period shall return to the classification prior to the promotion;
2. After completion sole discretion of the probationary period he/she shall return to the classification held prior to the promotion at such time that a vacancy is createdCourt Administrator.
P. In Section 5. Judicial appointments are at the spirit sole discretion of cooperative labor/management relations, the Division Judge. These appointments are: (1) Clerk of Human Resources shall meet with the union on their request to provide the union with the opportunity to share its perspectives regarding the training Court; (2) Magistrate; (3) Probate Register; (4) Juvenile Register; (5) Juvenile Officer and experience requirements as well as promotional examination procedures.(6)
