Qualities. 2.1 Unless otherwise indicated to Buyer in writing by Seller, any information provided to Buyer regarding the characteristics of goods and services (in particular of Marine Fuels, shall not be construed as specifications to be delivered hereunder, but only as indications of the general characteristics available from time to time. 2.2 Fuels are sold “as is”, and Seller makes no representations, guarantee, conditions or warranties of quality, merchantability or fitness for any particular purpose and any implied warranties or conditions as to quality, merchantability or fitness whatsoever. Buyer shall have the sole responsibility for the selection of suitable Marine Fuels for use in the Vessel and shall have the sole responsibility to verify before delivery, if the fuel is suitable to the vessel. Buyer warrants that the Marine Fuels selected by Buyer for the Vessel are suitable for the Vessel. The Seller can in no circumstances be held responsible for any consequences incurred by inadequate nomination of Xxxxxx Xxxx type stated by the Buyer. The Seller shall not be obliged to verify the type of Marine Fuel and its suitability for the Vessel. In no event, the Seller shall be liable for direct expenses incurred for removal and replacement of fuel and any consequential or indirect damages or injuries, including without limitations, demurrage claims, loss of contract or loss of profit. 2.3 In case of a complaint at delivery, Seller shall take four samples of each delivered Marine Fuels. Buyer shall have the right to have its representative witness the drawing of the samples. The aforementioned samples shall be securely sealed and labelled, numbered and identified by name of the vessel, Marine Fuels type(s), delivery date and place of delivery.
Qualities. During the Service Offering term, the Service Offering will substantially conform to the applicable Service Description unless otherwise stated herein. We do not commit that the Service Offering will be uninterrupted or that the Service Offering does fulfill any merchantability or fitness for a particular purpose, or will meet (or is designed to meet) your business requirements, unless stated otherwise in the applicable Service Description or individually agreed between the parties.
Qualities. When taking into account the qualities of the AI subsystem (vs the functional requirements mandated by goal and tooling), the following will be addressed: - Accuracy: The accuracy required by the solution will be determined by a few numbers, for example reaching goal within 20nm. The accuracy metrics need to be a guiding force towards the development in the solution even in training phase. During the training phase the accuracy is a guiding factor and not yet a must. In the TEM use case the important requirement is to always reach the goal within 20 nm of the goal and then stop when in that position. In the training phase this means that the training and the testing data need to reach roughly the same results. Not being able to reproduce training results for testing data results in a failure. In UUV Use Case 1, the objective is to automatically create new and challenging scenarios to fine-tune the parameters of unmanned vehicles. The novelty and criticality of these generated scenarios are assessed using various Key Performance Indicators (KPIs). Unlike the TEM use case, there is no predefined optimal goal in this scenario, and any enhancement in KPIs represents a favourable solution for the use case. Additionally, one can involve experts’ opinion to review the performance of the RL- solution. In UUV Use Case 2, since the objective is to improve the performance of vehicle sensors based on their observations in scenarios generated by UUV Use Case 1, we have access to ground truth data in the form of an image stream from the environment. The accuracy requirement may be quantified, for instance, by achieving a high percentage of correctly identified objects and minimizing discrepancies between the sensor input and the actual image stream. The information resulting from failures and successes determines quality standards for the DT, in the case of the DT requirements, it is hard to have them all upfront well-established and it is an iterative process. Of course, failing to produce qualitatively good data will result in failure of the AI, but the accuracy of the AI can be determined independently upfront, even when this dependency is known.

  • Samples The Contractor shall submit the following samples of Materials and relevant information to the Authority’s Engineer for pre-construction review: (a) manufacturer's test reports and standard samples of manufactured Materials; and (b) samples of such other Materials as the Authority’s Engineer may require.

  • Tests 7.7.1 If the Contract Documents, laws, ordinances, rules, regulations or orders of any public authority having jurisdiction require any portion of the Work to be inspected, tested or approved, the Contractor shall give the Architect timely notice of its readiness so the Architect may observe such inspection, testing or approval. The Contractor shall bear all costs of such inspections, tests or approvals conducted by public authorities. 7.7.2 If the Architect determines that any Work requires special inspection, testing, or approval which Subparagraph 7.7.1 does not include, he or she will, upon written authorization from the State, instruct the Contractor to order such special inspection, testing or approval, and the Contractor shall give notice as provided in Subparagraph 7.7.1. If such special inspection or testing reveals a failure of the Work to comply with the requirements of the Contract Documents, the Contractor shall bear all costs thereof, including compensation for the Architect's additional services made necessary by such failure; otherwise the State shall bear such costs, and an appropriate Change Order shall be issued. 7.7.3 Required certificates of inspection, testing or approval shall be secured by the Contractor and promptly delivered by him to the Architect. 7.7.4 If the Architect is to observe inspections, tests or approvals required by the Contract Documents, he will do so promptly.
