Equalities. 1.1 Employees will be afforded equal opportunities in employment irrespective of disability, gender, race, religion, age, sexuality, marital status, parental status, caring responsibilities and hours of work
1.2 Local authorities will ensure that discriminatory practices are identified and removed and non-discriminatory practices introduced in all areas of employment including recruitment, training and promotion. Lawful positive action initiatives should be taken to achieve and maintain a representative workforce.
1.3 The National Council has agreed an Equal Opportunities Guide which is intended for use in all local authorities. The Guide is reproduced in Part 4.2 of this national agreement.
Equalities. It is important that all the advice on good practice set out in the Green Book on equalities and the Local Government Job Evaluation Scheme is followed for the computerised version.
Equalities. 25.1 The Contractor shall and shall ensure its sub-contractor’s and Staff at all times comply with the requirements of the Equality Xxx 0000 and all other related statutory and regulatory requirements and the Council’s policies and procedures copies of which are available on request relating to equal opportunities and shall not treat any person or group of people less favourably than another on the grounds of age, disability, gender reassignment, race, religion or belief, sex, sexual orientation, pregnancy and maternity, marriage and civil partnerships..
25.2 The Contractor shall fully indemnify the Council against all actions, claims demands, proceedings, damages, costs, charges and expenses whatsoever in respect of any breach by the Contractor or this Condition 24.
Equalities. 14.1 The BID Company shall perform its obligations under this Agreement (including those in relation to the BID Arrangements) in accordance with:
(i) the Equality Xxx 0000 or other relevant legislation, or any statutory modification or re- enactment thereof (whether in relation to race, sex, gender reassignment, age, disability, sexual orientation, religion or belief, pregnancy, maternity or otherwise);
(ii) the Council’s equality and diversity policy as provided to the BID Company from time to time; and
(iii) any other requirements and instructions which the Council reasonably imposes in connection with any equality obligations imposed on the Council at any time under applicable equality law.
Equalities. The Dundee Partnership has evidenced its commitment to equalities in relevant annual reports and external audits. This will remain a priority for continuous improvement over the next three years and beyond, as we continue to broaden and deepen the Dundee Partnership's agenda and representation to reflect all communities of interest and identity in the city. This will be driven through our Dundee Equality and Diversity Partnership which is currently considering the implications of the Guidance on Equalities to Community Planning Partnerships. An Equality Impact Screening of this SOA has been undertaken by representatives of the Equality and Diversity Partnership. Equality Impact Assessments will be built into SOA implementation to ensure that potential for impact (or opportunities offered) can be addressed.
Equalities. 20.1. The YMCA provides the Facilities and delivers services on an equal opportunities basis so that all members of the community are treated fairly and with dignity and respect. The Hirer is expected to uphold those principles in the course of any use of the Facilities.
Equalities. 25.1 The Contractor as an employer and provider of the Services shall take all reasonable steps to ensure elimination of all forms of discrimination within the meaning and scope of the provisions of the Equality Xxx 0000 (or any statutory modification or re-enactment thereof) in both its employment practice and in its delivery of the Services in accordance with an established equal opportunities policy, which policy shall include effective monitoring.
25.2 In complying with its obligations under clause 25.1, the Contractor shall have due regard to the School’s Equality Scheme, a copy of which can be made available on request, and the Contractor shall ensure compliance with its obligation under:
25.2.1 The Equality Xxx 0000;
25.2.2 The Equality and Human Rights Commission’s Guidance for Employers and all amendments, re-enactments, or any subsidiary legislation, enactments, regulations, codes of practice or guidance issued or in force during the Agreement Term.
25.3 The Contractor shall take all reasonable steps to secure the observance of clause 25 by servants, employees or agents of the Contractor and all suppliers and sub-contractors employed in the execution of the Agreement.
25.4 Failure by the Contractor to comply with its obligations in this clause 25 may be regarded as a fundamental breach of this Agreement.
Equalities. In order to embed compliance with the Race Relations Amendment Act 1976, equalities and diversity issues are considered as part of community cohesion headline challenge. Under development is a specific and agreed countywide outcome for all local authorities to reach equality standards 2 & 3 by an agreed timescale, with a dedicated resource to progress the initiative. More broadly, work is in progress to develop an approach to assist the migrant worker community in the county. The Lincolnshire Community Cohesion Partnership is the core body that will develop and ensure implementation of emerging proposals in this area. The Sustainable Community Strategy, which is delivered by the LAA, has been subjected to an Equalities Impact Assessment, which has been validated by an independent advisor.
Equalities. 18.1 The Provider hereby confirms that to the best of its knowledge and belief it has complied with the Equality Xxx 0000 (the “Act”) and hereby agrees to continue to comply with the Act in a manner which is proportionate and relevant to the nature of the Framework Agreement.
18.2 The Provider agrees to provide the Service in a non discriminatory manner and shall promote equality and work towards the Service reflecting best practice as identified in Guidance including the relevant Codes of Practice issued by the Equality and Human Rights Commission.
18.3 The Provider may be subject to the requirements of the equality duty under the Equality Xxx 0000 (Specific Duties) (Scotland) Regulations 2012 in respect of the Service being provided under this Framework Agreement and any IPA entered into there under. Where the requirement to comply with this equality duty exists, compliance with the requirements contained in Clauses 18.1 to 18.4 and Clause 18.10 herein will be evidence to the Purchaser of the Provider meeting this requirement.
18.4 The Provider recognises that Scotland Excel has a responsibility to monitor the extent to which the provision of the Service extends to socially excluded groups. In recognition of this, the Provider agrees, where appropriate and practicable, to work towards providing information to Scotland Excel in relation to employment and provision of the Service in respect of the protected characteristics as detailed in the Act, Part 2 Chapter 1.
18.5 The Provider shall not discriminate, directly or indirectly or by way of victimisation or harassment against any person on grounds of gender reassignment, age, marriage, and civil partnership, sexual orientation, disability, religion or belief, sex, pregnancy or maternity and race contrary to the Act.
18.6 The Provider shall notify Scotland Excel forthwith in writing as soon as it becomes aware of any investigation of, or proceedings brought against, the Provider under the Act. The Provider will inform Scotland Excel of any investigation decision or outcome of any proceedings as soon as practical upon receipt of said decision or outcome being made. The Provider will ensure that when reporting an outcome or decision to Scotland Excel that any Child or Young Person’s anonymity is maintained. For the avoidance of any doubt, this is in addition to the reporting requirements under Clause 17 (Management and Monitoring Arrangements) of the relevant IPT.
18.7 Where any such investigation is undertak...
Equalities. 21.1 The Council is required to meet the public sector equality duty under Section 149 of the Equality Xxx 0000 and in certain circumstances the Provider may also be subject to that duty where it is carrying out functions of a public nature. The Provider shall at all times act in accordance with the Equality Xxx 0000 in relation to its obligations under the Agreement, and the Provider shall:-
21.1.1 not unlawfully discriminate either directly or indirectly or victimise or harass any person on such grounds as age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity, race, religion or belief, sex or sexual orientation, and without prejudice to the generality of the foregoing the Provider shall not unlawfully discriminate within the meaning and scope of the Equality Xxx 0000 (or any statutory modification or re-enactment thereof),
21.1.2 take all reasonable steps to secure the observance of this clause by its employees,
21.1.3 co-operate with the Council in monitoring the Providers compliance with this clause 21 including providing such information as the Council may reasonably request,
21.1.4 not knowingly do anything in the performance of this Agreement which might place the Council in breach of the Councils duties and obligations under the Equality Xxx 0000 and
21.1.5 indemnify the Council against any costs, claims and expenses the Council may incur as a consequence of the Providers (or its employees) breach of this clause 21.
21.2 The Provider shall:
21.2.1 have an equal opportunities, or equality and diversity, policy in respect of the protected characteristics of age, disability, gender reassignment, marriage and civil partnership, pregnancy and maternity race, religion or belief, sex and sexual orientation
21.2.2 demonstrate effective implementation of its policies in relation to recruitment practices including evidence of open recruitment methods such as use of the Job Centre or press advertisements;
21.2.3 regularly review the full range of equality policies and procedures and take specific action to make any necessary changes;
21.2.4 regularly monitor from different ‘protected characteristic’ groups in relation to access to services, satisfaction with services and complaints including how the monitoring process impacts upon the development of policy and practice
