Quality and packing. 5.1 The Supplier shall, pack and supply the Products in accordance with all generally accepted industry standards and practices that are applicable. 5.2 The Products supplied to the Customer by the Supplier under this agreement shall: (a) be of satisfactory quality (within the meaning of the Sale of Goods Act 1979, as amended); (b) comply with all applicable statutory and regulatory requirements. 5.3 The terms implied by sections 13 to 15 of the Sale of Goods Act 1979 are, to the fullest extent permitted by law, excluded from this agreement. 5.4 The Supplier shall ensure that the Products are properly packed and secured in a manner to enable them to reach their destination in good condition. 5.5 The Customer acknowledges that the Supplier may not be the manufacturer of the Products. Where the Supplier is not the manufacturer, the Supplier shall have no liability whatsoever relating to the quality or specified use of the Products supplied to the Customer and all such liability shall sit with the Manufacturer.

Quality and packing. 4.1 The Supplier shall pack and supply the Products in accordance with the specific requirements of the Customer as set out in the Order or as otherwise notified by the Customer to the Supplier and all generally accepted industry standards and practices that are applicable. 4.2 The Supplier shall ensure that the Products are properly packed and secured in such manner as to enable them to reach their destination in good condition. 4.3 The Supplier warrants that it has obtained and holds all licences, permissions, authorisations, consents and permits needed to supply the Products in accordance with the terms of the Contract. 4.4 The Supplier shall comply with all applicable laws, enactments, orders, regulations and other instruments relating to the packing, packaging, marking, storage, handling, and delivery of the Products.
Quality and packing. 4.1 The Supplier shall ensure the correct Products are packed and supplied in accordance with all generally accepted industry standards and practices that are applicable. 4.2 The Products supplied to J9 or its Customers by the Supplier under this agreement shall:‌ 4.2.1 conform to the specification of the Products set out on the Websites or as otherwise provided by the Supplier to J9 prior to any Order (Specification); 4.2.2 be of satisfactory quality (within the meaning of the Sale of Goods Act 1979, as amended) and fit for any purpose held out by the Supplier or made known to the Supplier by J9 or a Customer; 4.2.3 be free from defects in design, material and workmanship and remain so for a minimum of 12 months after Delivery or such longer time as maybe relevant under any warranty given by the Supplier in connection with a Product; and 4.2.4 comply with all applicable statutory and regulatory requirements. 4.3 The Supplier shall ensure that: 4.3.1 the Products are properly packed and secured in such manner as to enable them to reach their destination in good condition; and 4.3.2 where reasonably requested by J9, the Supplier shall ensure that any label provided by J9 is applied to the Product as directed by J9 at no extra cost to J9. 4.4 The Supplier shall obtain and maintain in force for the Term all licences, permissions, authorisations, consents and permits needed to manufacture and supply the Products in accordance with the terms of these Conditions. 4.5 The Supplier shall comply with all applicable laws, enactments, orders, regulations and other instruments relating to the manufacture, packing, packaging, marking, storage, handling and delivery of the Products.

The Products supplied to the Customer by Hyrde under the Agreement shall: a. substantially conform to the specifications provided by Xxxxx; and b. comply with all applicable statutory and regulatory requirements in The Netherlands and the UK. 16.2. Hyrde shall ensure that the Products are properly packed and secured in a manner to enable them to reach their destination in good condition. 16.3. The Customer acknowledges that Hyrde does not manufacture the Products itself, for which reason it will not be able to provide any warranties in relation thereto beyond the warranties provided by the manufacturers.Hyrde will use its best endeavours to forward any warranty given by the manufacturer of the Products to the Customer. 16.4. Hyrde shall comply with all applicable laws in The Netherlands relating to the packing, packaging, marking, storage, handling, and delivery of the Products.
Quality and packing. 3.1 The Goods or Services supplied to the Buyer by the Supplier under this Contract shall: 3.1.1 conform with their description and the Specification; 3.1.2 be of satisfactory quality (within the meaning of the Sale of Goods Act 1979) and fit for any purpose held out by the Supplier or made known to the Supplier by the Buyer expressly or by implication, and in this respect the Customer relies on the Supplier’s skill and judgement; 3.1.3 be free from defects in design, material and workmanship and remain so for [36] months after Delivery; and 3.1.4 comply with all applicable statutory and regulatory requirements. 3.2 The Supplier shall ensure that the Goods or Services are properly packed and secured in such manner as to enable them to reach their destination in good condition. 3.3 The Supplier shall obtain and maintain in all licences, permissions, authorisations, consents and permits needed to supply the Goods or Services in accordance with the terms of this Contract. 3.4 The packaging and labelling of the Goods must comply with all applicable laws, statutory requirements and regulations relating to the packaging and labelling of the Goods as at the date of delivery of the Goods to the Buyer and shall comply with any quality requirements required by the Buyer. If provided by the Buyer, the Buyer’s material or part number shall be stamped on parts as specified in the Specification. 3.5 Any Goods that comprise of large parts must be stencilled with the Buyer’s material or part number (if provided by the Buyer). 3.6 The Buyer shall have the right to enter the Supplier’s premises to inspect, test and take samples of the raw materials, the packaging and the Goods or Services. 3.7 If following an inspection the Buyer considers that the Goods or Services are not or are not likely to be as warranted under clause 3.1, the Buyer shall inform the Supplier and the Supplier shall immediately take such action as is necessary to ensure that the Goods or Services are or will be as warranted under clause 3. 1. The Buyer shall have the right to re-conduct inspections and take further samples after the Supplier has carried out its remedial actions.

  • Labelling The distributor, on behalf of the selected vendor agrees that all supplies of articles should invariably contain the following information on its label and the carton. One information should not be overlapped by any other information needed to be furnished. The label should contain : a. Name of the item as approved b. CMS Cat. No. c. In case of Drugs items quoted /supplied by tenderer MUST CONFORM TO IP, BP, or USP norms and N.F.I. –III specification as noted against the item(s) in catalogue as applicable. k. The MRP and Trade Name will not be allowed to be printed in any pack. This will lead to cancellation of candidature straightaway. However, for excisable products, insertion of writing of Govt MRP is allowed as per provision laid down in the order of the Central Excise dept. However, for imported item(s), MRP and Trade name may be allowed in addition to Generic name.

  • API If the Software offers integration capabilities via an API, your use of the API may be subject to additional costs or Sage specific policies and terms and conditions (which shall prevail in relation to your use of the API). You may not access or use the API in any way that could cause damage to us or the Software, or in contravention of any applicable laws.   • Training Materials Training Materials will be provided for each student. Training Materials may be used only for either (i) the individual student’s reference during Boeing provided training and for review thereafter or (ii) Customer’s provision of training to individuals directly employed by the Customer.

  • Quality of Materials and workmanship The Contractor shall ensure that the Construction, Materials and workmanship are in accordance with the requirements specified in this Agreement, Specifications and Standards and Good Industry Practice.

  • ODUF Packing Specifications 6.3.1 A pack will contain a minimum of one message record or a maximum of 99,999 message records plus a pack header record and a pack trailer record. One transmission can contain a maximum of 99 packs and a minimum of one pack.

  • Quality Specifications SANMINA-SCI shall comply with the quality specifications set forth in its Quality Manual, incorporated by reference herein, a copy of which is available from SANMINA-SCI upon request.

  • Certificate of Analysis Seller shall provide a certificate of analysis and other documents as defined in the Quality Agreement for any Product to be released hereunder, in a form in accordance with the cGMPs and all other applicable Regulatory Requirements and Product Specifications and as shall be agreed upon by the parties. For any batch that initially failed to meet any Product Specification, the certificate of analysis shall document the exception. Products that do not meet dissolution specifications at USP Stage I and II testing shall not be accepted by Buyer (and such requirement shall be included in the Product Specifications/Quality Manual).

  • Quality- and Cost-Based Selection Except as ADB may otherwise agree, the Borrower shall apply quality- and cost-based selection for selecting and engaging consulting services.
