READMISSION PROVISIONS AND CLAUSES. The commitments in the EU-Turkey Readmission Agreement are based on the Principle of Reciprocity. The Readmission Provisions review the return procedures of ‘own nationals’, ‘third country nationals’ and ‘stateless persons’ consecutively from EU’s and Turkey’s perspective. Under Article 2 of the Agreement, the entitlement for the readmission applies to persons who do not or no longer fulfil the conditions for entry, residence or presence in the territorial zone of the Contracting Parties. An exception for the third country nationals and stateless persons who have left the territory of the Requested State more than 5 years before falls in the non-application area of the readmission procedure. According to Article 3 of the Agreement, the readmission of the persons is liable to the provisions of the Agreement and does not necessitate any additional formalities from the Contracting Parties.   • PROVISIONS OF LAW AND SEPARABILITY It is understood and agreed that this MOU is subject to all applicable Federal and State laws, City ordinances and regulations, the Charter of the City of Los Angeles, and any lawful rules and regulations enacted by the City's Civil Service Commission or the XXX.   • WAIVER CLAUSE The parties acknowledge that during negotiations which resulted in this Agreement each had the unlimited right and opportunity to make demands and proposals with respect to any subject or matter not removed by law from the area of collective bargaining, and that the understandings and agreements arrived at by the parties after the exercise of that right and opportunity are set forth in this Agreement. Therefore, the Board and the Union for the life of this Agreement each voluntarily and unqualifiedly waives the right, and agrees that the other shall not be obliged to bargain collectively with respect to any subject or matter not specifically referred to or covered in this Agreement, unless mutually agreed, even though such subject or matter may not have been within the knowledge or contemplation of either or both parties at the time that they negotiated or signed this Agreement.
