Transit principles. (1) The Requested Contracting Party shall allow the transit of citizens of third countries or stateless persons through its territory upon request of the Requesting Contracting Party, if the onward journey in possible other states of transit and the readmission by the State of destination is assured.

Nevertheless the transit application must include the details on the type of the transit (entry point, time of entry or use of escorts), the particulars of the persons concerned, and a declaration of the coherent conditions (in respect to the Principle of Non- Refoulement) in the destinated country from the Requesting State to grant non-refusal of the readmission application of the person.165 The reply of the transit admission must be submitted in 5 working days, in case of no reply, the admission will be considered as agreed on behalf of the Requested State. A refusing reply from the Requested State must include the reasons of refusal considering the transit obligations to be valid.166 Regardless the transit procedure, any person in subject to readmission, must be informed to the competent authorities at least 48 hours before within a scheduled return transportation plan in respect to the readmission obligations, unless the person is in possession of a valid travel document or identity card (valid visa or residence permit) for the purpose of entry on the territory of the Requested State in the case of third country nationals or stateless persons.167 In such cases, the Requesting State does not have to submit a readmission application or notification to the competent authorit...
Transit principles. (1) A Contracting Party shall allow an alien to pass through its territory in connection with the enforcement of an order of refusal of entry or expulsion issued by a competent authority of the other Contracting Party provided that onward travel to the destination state is assured.
