The application description comprised: ‘Alterations to main access and associated alterations to pavement, removal of a section of boundary wall, provision of new car parking and drop off/pick up area, alterations to existing car park, landscaping and associated works’. The LPA reference number is 21/02994/F. Condition 2 of the Planning Permission requires a Community Use Agreement to be established. The condition wording outlines: ‘a community use agreement prepared in consultation with Sport England – to be signed and approved by Sport England – shall be submitted to the Local Planning Authority for its approval. The agreement shall apply to the outdoor sports field, toilets and car park and include details of pricing policy, hours of use, access by non-educational users, management responsibilities and a mechanism for review. The development shall not be used otherwise than in strict compliance with the approved agreement’. The reason for a Community Use Agreement is to secure well managed safe community access to sports facilities in the area.
2.2 Further to this, in 2021, Cherwell District Council granted planning permission for cricket nets and bays at Xxxxxxx School. The reference number is 21/01685/F. Condition 2 of this permission outlined: ‘a community use agreement prepared in consultation with Sport England shall be submitted to the Local Planning Authority for its approval, and a copy of the completed approved agreement shall be provided to the Local Planning Authority. The agreement shall apply to the outdoor playing fields, sports hall car parking and toilet and changing provision and include details of pricing policy, hours of use, access by noneducational establishment users management responsibilities and a mechanism for review. The development shall not be used otherwise than in strict compliance with the details approved by the local planning authority pursuant to the requirements of this condition’.
2.3 The purpose of this Community Use Agreement is to satisfy the requirements of these conditions.
2.4 In addition, it is intended that further planning applications relating to sports facilities at the School will come forward in the future. Pursuant to C.R.S. § 13-94-104(4), Judicial and the Public Guardianship Commission (“Commission”) entered into a Memorandum of Understanding fully executed on January 29, 2018 (“Initial MOU”).
