Reference Account. 1.1 In order for us to provide you with Services, you must maintain a Reference Account in the Reference Currency with us at all times.
Reference Account. Customer consents to SELECTICA's identification of Customer as a user of the Software and will cooperate with SELECTICA in furnishing nonconfidential information about Customer's software use for informational and promotional use by SELECTICA. No public press releases or other public forum information exchange about Customer's use of SELECTICA's Software will be implemented without prior written permission of Customer.
Reference Account. Kadence may ask the Customer to become a reference account in accordance with the terms of this Section 2 and such agreement to be confirmed in writing by the Client Notwithstanding anything to the contrary in this document, Xxxxxxx may include Customer’s name, logo or trademarks in marketing materials, customer lists, or other public communications. As a reference account, Xxxxxxx may ask the Customer agrees to participate in case studies, interviews and / provide quotations to be published in Kadence’s marketing materials. In the event that the Customer agrees to act as a reference account, Xxxxxxx will agree to act as a reference account/ supplier for the Customer.
Reference Account. In consideration of the favorable pricing and terms provided to Peregrine under this Schedule, Peregrine agrees to the release of an individual press announcement that Peregrine has licensed Motive technology to deliver internet based technical support for Peregrine's products. Additionally, a Peregrine spokesperson will speak to news reporters and industry analysts in conjunction with said release. Such press release will be coordinated with Peregrine and shall be subject to its prior approval that shall not be unreasonably withheld.
Reference Account. WDIG will act as a reference account for at least one potential HitBox Enterprise customer per quarter at the sole discretion of WDIG.
Reference Account. Any transfer of money must be made from the Reference Account. Withdrawals must be made to the Reference Account. DEGIRO can hold an Instruction to transfer money to the Reference Account until such money has actually been received by XXXXXX or SPV. In case the Cash Accounts option is used, the conditions of Article 10.3 (Cash Accounts) shall apply. Please see below for more details.
Reference Account. During the term of this Agreement, GE shall serve as a reference account for Telocity. Specifically, Telocity shall be permitted to name GE as a customer in any of its marketing or advertising materials and otherwise publicly state that it provides Telocity Services to GE; provided that GE shall have approved in advance the specific use of GE's name in such marketing and advertising materials and public statements. With respect to the preceding sentence, GE shall not unreasonably withhold or delay its approval of such materials and statements. GE shall also, from time to time, respond to calls for reference from prospective Telocity business customers, investors, analysts or other interested parties.
Reference Account. Company agrees to be a reference account for Sun and permits Sun to use its name, customers and products in press releases, advertising, and other marketing and promotional materials in formats and with content that Sun deems appropriate.
Reference Account. Licensee shall endorse the Licensed Software and AISystems by serving as a reference account for AISystems. Specifically and without limitation, AISystems shall be permitted to name Licensee as a customer in any of its marketing or advertising materials and otherwise publicly state that Licensee uses the Licensed Software and is a customer of AISystems. AISystems shall also be permitted to use Licenesee’s trademarks in its sales and marketing literature, which use shall be in accordance with Licensee's trademark usage guidelines set forth in SCHEDULE D (AEROMEXICO TRADEMARK USAGE GUIDELINES). Licensee shall also work with AISystems in good faith to create white papers and customer testimonials and, from time to time, respond to calls for reference from prospective AISystems customers, investors, analysts or other interested parties. Upon mutual agreement of the Parties (not to be unreasonably withheld, conditioned or delayed), Licensee shall also allow AISystems and its prospective customers to tour Licensee's facilities where the Licensed Software is being used. Both parties acknowledge that the following factors are relevant to determining whether such consent is unreasonably withheld, conditioned or delayed: (a) whether the prospective customer is a competitor of Licensee (indicating reasonableness of withholding consent), (b) whether both Licensee and the prospective customer are members of the SkyTeam Alliance (indicating unreasonableness of withholding consent), (c) the availability of keeping confidential information ( and Licensee's financial and operation data in particular), from disclosure to the prospective customer, and (d) the availability of binding the prospective customer to a confidentiality agreement. In the absence of a tour, Licensee shall use reasonable efforts to be available to the prospective customer by telephone. The provisions of this paragraph shall expire at the end of the Exclusivity Term, including any extensions thereto.
Reference Account. Company agrees to serve as a reference account for CI² and permits CI² to use its name, Customers' names (upon receipt of Customers' approval), and the name of the Modified Product in its Marketing Activities, as more fully described in the Marketing Plan.
