Remaining Family Members. Family members listed on the lease that remain in the unit when the head of household dies or leaves the unit without a housing subsidy assistance (e.g. institutionalization) forming a new household in unsubsidized housing and given their RRC or Post 10/1/99 RRC rights to the remaining family members, etc.). Continued occupancy by remaining family members is permissible only if:
(a) The family reports the death or departure of the head of household within 10 calendar days of the occurrence;
(b) The family member requesting to become the new head of household is age 18 years or over, has lived in the unit as an authorized occupant, on the Lease, for a minimum of three consecutive calendar years (36 months), has not had any unauthorized extended absences, and passes applicant screening;
(c) The CHA approved new head of household signs a new lease within 30 calendar days after the CHA approves the remaining family members; and
(d) There are no rent and/or criminal activity violations.
Remaining Family Members. If the head of household dies or leaves the unit for any reason, continued occupancy by remaining household members is permissible only if there is one or more household members on the Lease and living in the household who passes screening and is 18 years of age or older or an emancipated minor. Eviction proceedings can be commenced if
1) the remaining household members fail to inform PHA within 10 days of the death or departure of the former head of household;
2) there is no family member qualified to sign a new lease, or
3) after the remaining family member’s approval to assume the lease obligations, her/she fails to sign a new Lease within 30 days and/or
4) the only adults or emancipated minors remaining in the unit have committed rent default or criminal activity violations.
5) the family fails to notify the PHA of any additions to the household by birth, adoption or Court- awarded custody and to refrain from permitting other persons to join the household without first undergoing screening by the PHA.
Remaining Family Members. After the departure or death of Resident, continued occupancy by remaining members of Resident’s household shall be permitted if there is a remaining family member age eighteen (18) or older or an emancipated minor as provided by state law. The remaining family member will be required to execute a new Lease within fifteen (15) working days of Resident’s departure or death. If this Lease is an extension of occupancy by Resident’s household under a prior Lease with Landlord, any amounts due under the prior Lease shall be charged and collected as if they had been incurred hereunder. All adult members, including emancipated minors, shall be subject to Landlord’s screening policy including but not limited to eligibility for occupancy in low-income tax credit housing pursuant to the requirements of Section 42 of the Internal Revenue Code of 1986, as amended;

After the departure or death of Resident, continued occupancy by remaining members of Resident’s household shall be permitted if there is a remaining family member age eighteen (18) or older or an emancipated minor as provided by state law. The remaining family member will be required to execute a new Lease within fifteen (15) working days of Resident’s departure or death. If this Lease is an extension of occupancy by Resident’s household under a prior Lease with Landlord, any amounts due under the prior Lease shall be charged and collected as if they had been incurred hereunder. All adult members shall be subject to Xxxxxxxx’s screening policy, including emancipated minors; Y Resident further acknowledges the importance of a peaceful and safe environment for all residents. Therefore, Resident agrees that if Landlord determines, in its sole discretion, that a person is a threat to the peace and safety of other residents or the neighborhood and issues a no trespassing notice to such person, and after Resident has written notice thereof, the Resident agrees to not allow such person in or about the unit or authorize him/her to be on Landlord property at any time;
Remaining Family Members. (d) There are no rent and/or criminal activity violations.
Remaining Family Members. If the head of household dies or leaves the unit for any reason other than lease termination or enforcement, continued occupancy by remaining household members is permissible only if there is one or more household members on the Lease and living in the household who passes screening and is 18 years of age or older or an emancipated minor. Eviction proceedings can be commenced if:
(1) the remaining household members fail to inform HHA within ten (10) days of the death or departure of the former head of household;
(2) there is no family member qualified to sign a new lease;
(3) after the remaining family member’s approval to assume the lease obligations, he/she fails to sign a new lease within thirty (30) days;
(4) the only adults or emancipated minors remaining in the unit have committed rent default or criminal activity violations; or
(5) the remaining family members fail to notify the HHA of any additions to the household by birth, adoption, or Court-awarded custody and fail to refrain from permitting other persons to join the household without first undergoing screening by the HHA, except as provided in Section 26(a).

Eviction proceedings can be commenced if:
1) the remaining family members fail to inform CHA within 30 days of the death or departure of the former head of household;
2) do not have a family member qualified to sign a new lease, or
3) after the remaining family member’s approval to assume the lease obligations, her/she fails to sign a new Lease within 30 days; and/or
4) for rent default or criminal activity violations.

If the head of household dies or leaves the unit for any reason, other than for an authorized unit transfer, continued occupancy by remaining household members is permissible only if there is one or more household members on the Lease and living in the household who passes screening and is 18 years of age or older or an emancipated minor. Eviction proceedings can be commenced if
1. The remaining household members fail to inform DHA within 10 days of the death or departure of the former head of household;
2. There is no family member qualified to sign a new lease, or
i. after the remaining family member’s approval to assume the lease obligations, her/she fails to sign a new Lease within 30 days and/or
ii. The only adults or emancipated minors remaining in the unit have committed rent default or criminal activity violations.
iii. The family fails to notify the DHA of any additions to the household by birth, adoption or Court-awarded custody and to refrain from permitting other persons to join the household without first undergoing screening by the DHA, except as provided in Section 13(b).
