Renewal/Non-Renewal. Unless preliminary written notice is given by a party prior to January 1, this Contract will be automatically extended for an additional year.
Renewal/Non-Renewal a. The Governing Authority shall undergo a high-stakes review prior to contract renewal or at least every five years. The renewal process shall be conducted in accordance with the Sponsor’s renewal, nonrenewal, and termination policy and renewal application process, which shall be available on its website (“Renewal, Nonrenewal, and Termination Policy”). Renewal shall be subject to the Sponsor’s reasonable determination that the Governing Authority has complied with applicable law and terms of this Contract and that the School’s progress in meeting the academic, organizational, and financial goals prescribed over the term of this Contract have been satisfactory.
b. The Sponsor may choose to non-renew this Contract at its expiration for any of the following reasons:
i. Failure to meet student performance requirements;
ii. Failure to meet generally accepted standards of fiscal management;
iii. Material violation of any provision of this Contract or applicable state or federal law; and
iv. Other good cause, so long as in accordance with the criteria set out in the Renewal, Nonrenewal, and Termination Policy.. No later than the 15th day of January in the year in which the Sponsor intends to non- renew the School’s contract, the Sponsor shall notify the School of the proposed action in writing. The notice shall include the reasons for the proposed action in detail, the effective date of the termination or nonrenewal, and a statement that the School may, within 14 calendar days of receiving the notice, request in writing an informal hearing before the Sponsor. A decision by the Sponsor to terminate this Contract may be appealed only to the State Board. The decision of the State Board shall be final.
c. If the School does not intend to renew this Contract, the School shall notify the Sponsor in writing of its intent to not renew at least 180 days prior to Contract’s expiration, or otherwise in compliance with state law. The School may also terminate this Contract upon at least 180 days prior written notice to the Sponsor to be effective on any June 30 of any other year; provided, however, that this annual right of the School to terminate the Contract shall only be effective if or after the current Chief Executive Officer of the Sponsor is no longer serving the Sponsor in that capacity.
Renewal/Non-Renewal. This Employment Contract shall automatically renew for a term of five calendar years, expiring July 1, 2027, unless either of the following occurs:
A. the Board by contract reappoints the Superintendent for a different term allowable by law;
B. the Board notifies the Superintendent in writing, prior to January 10, 2022 that he will not be reappointed at the end of the current term, in which case his employment shall cease upon the expiration of this Contract; or
C. in accordance with such laws and regulation that would require nullification of this Contract.
Renewal/Non-Renewal. This Employment Contract shall automatically renew for a term of four (4) years, expiring June 30, 2028, unless either of the following occurs:
A. the Board by contract reappoints the Superintendent for a different term allowable by law; or
B. the Board notifies the Superintendent in writing, on or before March 1, 2024 that he will not be reappointed at the end of the current term, in which case his employment shall cease upon the expiration of this Contract.
Renewal/Non-Renewal. This Agreement shall be automatically extended without further action by the parties for one (1) additional year unless either party shall, at least 90 days prior to the expiration date, have given notice to the other party that this Agreement shall not be so extended.
Renewal/Non-Renewal. Unless written notice is given by a party prior to January 1 of the year of the Expiration Date (as may be extended) as provided by IC 20-28-8-7, this Contract will be automatically extended for an additional year. It is the parties’ intention that this be a continuing three (3) year contract unless notice is provided otherwise as required by this Contract or Indiana law.
Renewal/Non-Renewal. The Board may (but need not), in its sole discretion, renew (reissue) this Contract on an annual basis. This contract shall, however, be subject to renewal and/or non-renewal in accordance with the terms and conditions prescribed in Section 1229 of the Revised School Code.
Renewal/Non-Renewal. The parties acknowledge that applicable Laws require the amendment of the QHPs for the 2014-2015 Plan Year, with such amendment to be effective January 1, 2015. Failure to have a mutually agreed, amended QHPs for the 2014-2015 Plan Year by August 31, 2014 shall entitle the State to terminate this Contract in its entirety, effective January 1, 2015, subject to the run-out terms set forth herein. The parties further agree to negotiate in good faith to amend this Contract as reasonably necessary to ensure the highest quality individual experience with VHC. The parties further acknowledge that, from time-to-time, in its sole discretion, the State may issue a request for proposals to enlist additional contractors or to seek new product features to offer on VHC.
Renewal/Non-Renewal. This Agreement shall be automatically ------------------- extended annually on each March 3 without further action by the parties, for three-year rolling terms unless either party shall, at least 60 days prior to the annual extension date, have given notice to the other party that this Agreement shall not be so extended or otherwise terminated this Agreement. After the first two years of employment, the Employee may resign with at least 90 days notice subject to the discretion of the Board to shorten the notice time.
Renewal/Non-Renewal. Should the ADMINISTRATOR’S performance continue to be deemed unsatisfactory, the SUPERINTENDENT shall provide notice of non-renewal in accordance with MCL 380.1229.
