Repayment of Overpayment. If at any time the Province provides Funds in excess of the amount to which the Recipient is entitled under the Agreement, the Province may: (a) deduct an amount equal to the excess Funds from any further instalments of Funds; or (b) demand that the Recipient pay an amount equal to the excess Funds to the Province.

Repayment of Overpayment. The Academy shall be directly responsible for reimbursing the State for any overpayments of State School Aid Payments. At its option, the State may reduce subsequent State School Aid Payments by the amount of the overpayment or may seek collection of the overpayment from the Academy. In the event an overpayment of any kind is made to the Academy by the Fiscal Agent, the Acdemy shall be directly responsible for reimbursing the Fiscal Agent.

In the event payments made exceed the amount to which British Columbia is entitled under this Agreement, the amount of the excess is a debt due to Canada and, unless otherwise agreed to in writing by the Parties, British Columbia shall repay the amount within sixty (60) calendar days of written notice from Canada.
Repayment of Overpayment. 23.2.1 If prior to a Pool Creditor notifying the Pool Funds Administrator of the overpayment, the Pool Funds Administrator receives notice (from the Pool Banker or otherwise) of the overpayment, the Pool Funds Administrator shall forthwith require (by written notice) that the recipient of the overpayment pay the overpayment as directed by the Pool Funds Administrator and any Pool Creditor who receives such notice shall forthwith pay the amount to an account specified by the Pool Funds Administrator. 23.2.2 If the overpayment is repaid within two Business Days of receiving the notice, the overpayment (or any part not paid) shall bear interest at the Base Rate or at such other rate as shall be set from time to time by the Executive Committee from the date the overpayment was received up to the date that it is repaid in full to the person entitled thereto (after as well as before judgment). 23.2.3 Any overpayment (or part thereof) not repaid within two Business Days after demand therefor in accordance with this Section 23 shall bear interest at the Default Interest Rate from the expiry of that period and shall be recoverable in accordance with Section 24.

Repayment of Overpayment. 4.7.1 Canada and Manitoba agree that every effort will be made to ensure that the calculation of Canada’s contribution installments to Manitoba will be accurate. 4.7.2 In the event payments made to Manitoba exceed the amount to which Manitoba is entitled under the Agreement, the amount of the excess is a debt due to Canada and shall be repaid to Canada upon receipt of notice in writing to do so within 90 days. 4.7.3 In the event that the second installment payment made to Manitoba is determined to be less than the amount to which Manitoba is owed under the terms of section 4, Canada agrees to pay Manitoba, within 90 days, the amount determined to be outstanding upon receipt of written notice to do so. 4.7.4 Canada shall, in addition to any other remedies available, have the right to recover the debt by deducting or setting-off the amount of debt from any future contribution payable to Manitoba under this Agreement.
Repayment of Overpayment. Each Party agrees that, and the Sales Agent shall ensure that each Distributor agrees that, in case it has received more than its Entitlement(s), it shall upon request, which request may also be addressed to any Beneficiary, not being a Party, by the Collection Agent immediately pay or repay such amount plus interest at a rate of HIBOR+1% per annum thereon into the Collection Account for correct distribution by the Collection Agent in accordance with this Agreement. The Collection Agent’s next Statement will, to the extent applicable, be an adjusted Statement showing the correct Entitlement(s). The Collection Agent shall make no further payments to the relevant Party(ies) or Distributor(s) or Beneficiaries, as applicable, until such amount has been repaid in full, including the afore-mentioned interest, and it may formally notify such Party(ies) or Distributor(s) or Beneficiary, as applicable, upon the occurrence of such situation.
