Rescheduling Orders Sample Clauses

Rescheduling Orders. Distributor may at any time, upon not less than thirty (30) days written notice to IDSI, reschedule and/or postpone the delivery date relating to an order (or any part thereof) for up to thirty (30) days. The postponement of delivery to a date more than thirty (30) days from the delivery date specified in the initial order shall be deemed a cancellation of such order. DISTRIBUTOR MAY NOT POSTPONE THE DELIVERY DATE MORE THAN ONCE WITH RESPECT TO ANY ORDER. If Distributor cancels a previously rescheduled delivery of Equipment, the applicable cancellation charges shall be based on the delivery date specified in the initial order submitted by Distributor for such delivery.
Rescheduling Orders. Imation and its Subsidiaries will have the right to reschedule the shipment date of any Purchase Order not later than five (5) days prior to the scheduled shipment date; provided that (i) Imation may reschedule the shipment date of any Purchase Order no more than two (2) times, (ii) any re-scheduled shipment date, whether re-scheduled from the original or a re-scheduled shipment date, will occur no later than three (3) months in the aggregate after the original shipment date of such Purchase Order and (iii) the pricing and payment terms, as determined in accordance with Section 5, as of, and applicable to, the original scheduled shipment date of such Purchase Order will continue to apply notwithstanding any rescheduled shipment date. Any further rescheduling will be subject to the written agreement of the parties.
Rescheduling Orders. NCR may reschedule an Order from its originally scheduled ship date provided that the rescheduled shipment date will in no event be later than two (2) months past the initial shipment date and the reschedule quantity is within the flexibility parameters stated above in Section 2.2.1, unless agreed otherwise. Once the said two months period expires, NCR shall agree to Supplier’s arrangement for immediate shipment of the rescheduled Order. If NCR subsequently cancels a rescheduled Order, the provision of Section 2.3 will apply.

The postponement of delivery to a date more than forty-five (45) days from the delivery date specified in the initial order shall be deemed a cancellation of such order. DISTRIBUTOR MAY NOT POSTPONE THE DELIVERY DATE MORE THAN ONCE WITH RESPECT TO ANY ORDER. THIS SECTION DOES NOT AFFECT THE TERMS OF THE LETTER OF CREDIT.
Rescheduling Orders. Purchaser may, free of charge, reschedule the Delivery Date for any Product one time prior to Seller’s shipment thereof by providing Seller with notice thereof (the “Rescheduling Notice”) electronically, by facsimile, or by mail. The new Delivery Date specified in such Rescheduling Notice shall then become the new Delivery Date for the Order, which shall in all other respects remain in full force and effect. Such new Delivery Date shall in no event (a) be greater than forty five (45) days after the original delivery dates or be accelerated without the Seller’s consent, or (b) result in an inconsistency with the Forecast provisions set forth in Section 2.1.
Rescheduling Orders. Reseller may reschedule its orders only on the following conditions: (i) you may reschedule each order only once; (ii) you must give TERADATA written notice of your request to reschedule an order at least thirty (30) days before the scheduled shipment date; and (iii) you may not delay shipment of the order by more than ninety (90) days after the originally scheduled shipment date. A request for rescheduling that does not meet each of these criteria may, at TERADATA’s discretion, be treated as an order cancellation.

  • Rescheduling (a) A Maintenance Outage and the associated Capacity Credit Period may be rescheduled if Seller’s request to reschedule is received by Buyer no later than 5:00 p.m. PPT on the day before the Maintenance Outage was previously scheduled to begin. (b) A Major Overhaul and the associated Capacity Credit Period may be rescheduled provided: (i) The rescheduled Major Xxxxxxxx begins six months or more after the first outage notification date and time; (ii) The notification to reschedule is made at least one week before the Major Overhaul was previously scheduled to begin; and (iii) There is at least a one-month period between the notification to reschedule and the commencement of the rescheduled Major Overhaul. (c) Maintenance Outages and Major Overhauls may be rescheduled more than once.

  • Rescheduling of Tests If the Authority’s Engineer certifies to the Authority and the Contractor that it is unable to issue the Completion Certificate, as the case may be, because of events or circumstances on account of which the Tests could not be held or had to be suspended, the Contractor shall be entitled to re-schedule the Tests and hold the same as soon as reasonably practicable.

  • Pending Orders Upon termination of this Agreement, Micrus shall have the right, at its option, to continue or terminate any order pending as of the effective date of termination.

  • Timeliness of Submitting Orders You are obliged to date and indicate the time of receipt of all orders you receive from your customers and to transmit promptly all orders to us in time to provide for processing at the price next determined after receipt by you, in accordance with the Prospectuses. You are not to withhold placing with us orders received from any customers for the purchase of shares. You shall not purchase shares through us except for the purpose of covering purchase orders already received by you, or for your bona fide investment.

  • Scheduling Regulations F-1 Tour schedules shall be posted, except in cases of emergency, two (2) weeks in advance and shall cover a six (6) week period or full-time nurses will be paid premium pay on the first tour of the new schedule. Requests for specific days off are to be submitted, in writing, at least two (2) weeks in advance of posting. F-2 Request for Tour Changes F-3 Where there is a change in the schedule from one day shift to another day shift commencing at different start times on the same day, the change will not be considered a change in schedule as defined under Article 14.12. If the nurse is advised of the change and unable to accept it due to extenuating circumstances and the Employer unilaterally changes the start time, premium pay would be applicable if the change is made with insufficient notice as per Article 14.12. F-4 A full-time nurse may request to work a permanent evening or night shift. Where such request is made the following conditions shall apply: i) The nurse will submit a written request to the Manager with a copy to the Union. ii) The Manager will provide a written response to the nurse stating her ability to honour such a request, with the provision that either the nurse or the Manager may discontinue the scheduling arrangement with four (4) weeks written notice in advance of the posted schedule. A copy of such response shall be forwarded to the Union. iii) The permanent shift arrangement applies to the individual nurse, not to the position and therefore when a nurse vacates such arrangements, said vacant line will revert back to a regular rotating line consistent with the remainder of the master rotation. iv) A nurse on permanent evening or night shift will twice a year spend two (2) weeks on day shift at a mutually agreeable time. These intervals will be at least three (3) to four (4) months apart. F-5 Scheduling - 7.5 hours (a) Full-time i) Master rotations including an individual nurses position within a master, will not be changed without first informing the nurse and the bargaining unit president and or designate. ii) A nurse will not be scheduled to work more than seven (7) consecutive days without receiving two (2) consecutive days off or premium payment shall be paid. iii) The Employer will schedule full-time every second weekend off or premium pay will apply. The Employer will endeavour to schedule a nurse for a day shift prior to the nurse’s weekend off. The Employer agrees that a weekend will be defined as sixty (60) hours from the completion of the Friday tour until the commencement of the Monday tour. iv) The Employer undertakes to use its best effort consistent with proper management of the Hospital to ensure that days off may be taken consecutively and days off rotated so as to effect an equal distribution among the full-time nurses. v) The Employer will endeavour as far as reasonably possible to provide some day tours when available. vi) A nurse shall not be required to commence work within twelve (12) hours of completing a scheduled tour or premium payment shall be paid.

  • Pre-Ordering BellSouth will provide electronic access to its OSS and the information contained therein in order that Freedom can perform the following pre-ordering functions: service address validation, telephone number selection, service and feature availability, due date information, customer record information and loop makeup information. Mechanized access is provided by electronic interfaces whose specifications for access and use are set forth at BellSouth’s Interconnection Web site and are incorporated herein by reference. The process by which BellSouth and Freedom will manage these electronic interfaces to include the development and introduction of new interfaces will be governed by the change Version: 4Q04 Resale Agreement 12/14/04 management process as described in Section 2.6 below. Freedom shall provide to BellSouth access to customer record information, including circuit numbers associated with each telephone number where applicable. Freedom shall provide such information within four (4) hours after request via electronic access where available. If electronic access is not available, Freedom shall provide to BellSouth paper copies of customer record information, including circuit numbers associated with each telephone number where applicable. If BellSouth requests the information before noon, the customer record information shall be provided the same day. If BellSouth requests the information after noon, the customer record information shall be provided by noon the following day. 2.2.1 The Parties agree not to view, copy, or otherwise obtain access to the customer record information of any customer without that customer's permission. Freedom will obtain access to customer record information only in strict compliance with applicable laws, rules, or regulations of the state in which the service is provided. BellSouth reserves the right to audit Freedom’s access to customer record information. If a BellSouth audit of Freedom’s access to customer record information reveals that Freedom is accessing customer record information without having obtained the proper End User authorization, BellSouth upon reasonable notice to Freedom may take corrective action, including but not limited to suspending or terminating Freedom’s electronic access to BellSouth’s OSS functionality. All such information obtained through an audit shall be deemed Information covered by the Proprietary and Confidential Information section in the General Terms and Conditions of this Agreement.

  • Self Scheduling The Home and the Union may agree to implement a self-scheduling process. Self-scheduling is the mechanism by which employees in a Home create their own work schedules. The purpose of self scheduling is to improve job satisfaction and quality of work life for the participating employees. Self scheduling requires a collaboration of employees and management to ensure proper coverage of the Home and to meet the provisions of the Collective Agreement. It is agreed that self scheduling will be negotiated locally by the Home and the Union and will include a trial period. Each Home must have the majority agreement of the full-time and part-time employees who vote on the issue to agree on a trial period of up to six months. Once the trial period is complete, each Home must have a minimum of 66⅔% agreement of the full-time and part-time employees who vote on the issue to continue with the new schedule on a permanent basis.

  • Scheduling of Vacations Vacations shall be scheduled at a time mutually acceptable to the Agency and the employee and consistent with the work requirements of the Agency.
