The terms and conditions shall be as follows: Dispute Resolution Any claims or disputes made during design, construction, or post-construction between the Client and the Engineer shall be submitted to non-binding mediation. The Client and the Engineer agree to include a similar mediation agreement with all contractors, sub-contractors, suppliers, and fabricators, thereby providing for mediation as the primary method for dispute resolution between all parties. Xxxxxxxx/Payments Invoices for the Engineer’s services shall be submitted, at the Engineer’s option, either upon completion of such services, or on a monthly basis. Invoices are due upon receipt.   • Responsibility of the Parties 9.1. In the event of non-performance or improper performance of their obligations under this contract, the Parties shall be liable in accordance with the legislation of the Russian Federation.

  • LIABILITY OF OTHERS Nothing in this Contract shall be construed to impose any liability upon the Government to persons, firms, associations, or corporations engaged by Contractor as servants, agents, or independent contractors, or in any other capacity whatsoever, or make Government liable to any such persons, firms, associations, or corporations for the acts, omissions, liabilities, obligations and taxes of Contractor of whatsoever nature, including but not limited to unemployment insurance, gross receipt, excise, and social security taxes for Contractor, its servants, agents or independent contractors.
