Restricted Use of Certain Persons to Facilitate Communication a. A Facility shall not require an individual who is deaf or hard of hearing to bring another individual to interpret for him or her. 28 C.F.R. § 36.303(c)(2).
b. A Facility shall not rely on an adult accompanying an individual with a disability to interpret or facilitate communication, except –
(1) In an emergency involving an imminent threat to the safety or welfare of an individual or the public where there is no interpreter available; or
(2) Where the individual with a disability specifically requests that the accompanying adult interpret or facilitate communication, the accompanying adult agrees to provide such assistance, and reliance on that adult for such assistance is appropriate under the circumstances. 28 C.F.R. § 36.303(c)(3). Consent of, and for, the accompanying adult to facilitate communication must be provided freely and voluntarily both by the individual with a disability and the accompanying adult. A Facility may not coerce or attempt to persuade another adult to provide effective communication for the individual with a disability. See 28 C.F.R. Part 36, App. A.
c. A Facility will not rely on a minor child or another Resident to interpret or facilitate communication, except in an emergency involving an imminent threat to the safety or welfare of an individual or the public where there is no interpreter available. 28 C.F.R. § 36.303(c)(4). The imminent threat exception in this paragraph and its subparts is not intended to apply to the typical and foreseeable emergency situations that are a part of the normal operations of the Facility’s programs, services, and activities. Personnel may rely on an accompanying individual to interpret or facilitate communication under this paragraph only in truly emergency circumstances, i.e., where any delay in providing immediate services to the individual could have life-altering or life- ending consequences. See 28 C.F.R. Part 36, App. A (discussion of 28 C.F.R. § 36.303(c)(3)-(4)). Once the emergency has lifted, personnel should revisit the decision of what auxiliary aids and services are appropriate.
d. The Facility will not use its personnel as sign language interpreters unless, as discussed above, the employee’s sign language interpreting skills have been evaluated and the Facility can document that the individual is a “qualified interpreter” pursuant to 28 C.F.R. §36.104. Due to confidentiality, potential emotional involvement, and other factors that may adversely affect the ability to facilitate communication, the Hospital may never require, coerce, or rely upon a family member, companion, case manager, advocate, or friend of a Patient or Companion to interpret or facilitate communications between Hospital Personnel and such Patient or Companion. In any case, such person may be used to interpret or facilitate communication only if the Patient or Companion who is deaf or hard of hearing does not object, if such person wishes to provide such assistance and if such use is necessary or appropriate under the circumstances, giving appropriate consideration to any privacy issues that may arise. This provision in no way lessens the Hospital’s obligation to provide appropriate auxiliary aids and services as required under this Agreement.

Due to privacy and confidentiality concerns, potential emotional involvement, and other factors that may adversely affect the ability to facilitate communication, DCF Personnel shall never require or coerce a family member, advocate or friend of a deaf or hard-of-hearing Customer or Companion to interpret or facilitate communication between DCF Personnel and such Customer or Companion unless the following four (4) factors are present:
a. The Customer or Companion desires such person to provide communication assistance and the person agrees to do so;
b. Such use is appropriate under the circumstances, giving consideration to any privacy and confidentiality issues that may arise;
c. The Customer or Companion has been made aware of the full range of auxiliary aids and services options available free of charge using the materials and formats described in Section I.3; and
d. The Customer or Companion provides written confirmation that he or she was made aware of relevant auxiliary aids and services available free of charge and agrees to the use of such person to interpret or facilitate communication. In time-sensitive, life-threatening situations, DCF Personnel may rely upon communication through a family member, advocate or friend until a qualified interpreter is obtained. In such situations, DCF shall retain the written documentation required by Section H.8 (d) above in the individual’s file.
Restricted Use of Certain Persons to Facilitate Communication. KFHPW will not rely on an adult friend or family member of the Patient or Companion who is deaf, deaf-blind, or hard of hearing to interpret except:
a. In an emergency involving an imminent threat to the safety of an individual or the public where there is no interpreter available; or
b. Where the Patient or Companion who is deaf, deaf-blind, or hard of hearing specifically requests that the adult friend or adult family member interpret, the accompanying adult agrees to provide such assistance, and reliance on that adult for such assistance is appropriate under the circumstances. At any time, KFHPW may also provide a Qualified Interpreter at no cost to the Patient or Companion. The adult friend or adult family member will not be compensated by KFHPW. KFHPW will not rely on a minor child of Patient to interpret except in the limited circumstances described in (a) above.

In any case, such person shall be used to interpret or facilitate communication only if the Patient or Companion who is deaf or hard of hearing or who has a speech impairment does not object, if such person wishes to provide such assistance, and if such use is necessary or appropriate under the circumstances, giving appropriate consideration to any privacy issues that may arise.

Restricted Use of Certain Persons to Facilitate Communication. MHS shall not require a Patient and/or Companion with a disability or who is LEP to bring another individual to interpret for him or her. The parties recognize that Patients or Companions with disabilities and/or limited English proficiency may seek to use family members or friends as interpreters. Regardless, MHS shall not rely on a minor child accompanying an individual with a disability and/or an LEP individual to interpret or facilitate communication except in an emergency involving an imminent threat to the safety or welfare of an individual or the public where there is no interpreter available. MHS may rely on an adult accompanying a Patient and/or Companion with a disability and/or limited English proficiency if:
1. The Patient and/or Companion specifically requests that the accompanying adult interpret or facilitate communication, the accompanying adult agrees to provide such assistance, and reliance on that adult for such assistance is appropriate under the circumstances;
2. The Patient and/or Companion has been made aware of the availability of qualified interpreters and foreign language interpreters free of charge;
3. The availability of qualified interpreters and foreign language interpreters has been effectively communicated to the Patient and/or Companion using the necessary auxiliary aids or services or language assistance services; and
4. The Patient and/or Companion provides written confirmation that he or she was made aware of the availability of qualified interpreters and foreign language interpreters free of charge and agrees to the use of such person to interpret. If use of the family member or friend is not necessary or appropriate under the circumstances, or if the family member or friend is unable to provide competent interpretation under the given circumstances, MHS shall provide interpreter services in place of, or if appropriate, in addition to the person selected by the person with a disability or LEP person. MHS shall inform an LEP individual or individual who is deaf or hard of hearing who has declined the offer for MHS to provide an interpreter free of charge that he or she may reconsider and request an interpreter at any time.
