RESTRICTIONS ON USE OF THE CARD. 5.1 You must ensure that You have sufficient Available Funds on Your Account to pay for each purchase, payment or cash withdrawal using the Card. 5.2 The Card is linked to a dedicated Account but is not a cheque guarantee card, charge card or credit card, nor may it be used as evidence of identity. 5.3 The Card may not be used for preauthorised regular payments, for gambling, or for any illegal purposes. 5.4 We may restrict or suspend use of Your Card without notice if We identify or suspect that suspicious, fraudulent or illegal activities are being carried out in relation to the Card, if We believe You have not complied with these Terms and Conditions, or in the event of exceptional circumstances which prohibit the normal operation of the Card. 5.5 Unless it would be unlawful for Us to do so or it is impracticable for Us to do so, where We stop or suspend the use of Your Card in accordance Condition 5.4, We will notify You of this and Our reasons for doing so, by sending an email to the email address You provided Us with when You obtained the Card. Where it is not possible to notify You before We stop or suspend the Card, We will notify You as soon as possible after We have stopped or suspended the Card. 5.6 The Card may only be loaded via channels that We approve. The type and nature of these load channels will depend on the commercial relationship We have with Our partners. We will describe these load channels applicable to Your Card on the Website, however should You have any questions about ways to load Your Card please contact Our Customer Services team in accordance with Condition 14. 5.7 Spending limits apply to the Card. For details see clause 3 and xxxx://xxx.xxxxxxxxxxxx.xxx/card-fees. 5.8 Any preauthorised amount (such as a hotel or car hire booking) will place a “hold” on Your Available Funds until the retailer sends Us the final payment amount of Your purchase, which may take up to 30 days. Once the final payment amount is received, the preauthorisation amount on “hold” will be removed. During the “hold” period, You will not have access to the preauthorised amount.

RESTRICTIONS ON USE OF THE CARD a. In order to use your Card, you need to choose one of your Designated Accounts as the Account from which your Card transactions and fees will be paid (“the Bank Card Designated Account”). You will need to maintain in your Bank Card Designated Account a cleared cash balance which is not less than the amount being withdrawn on any transaction, plus the amount required for all relevant charges, except where you have previously established overdraft or other credit facilities for the Bank Card Designated Account with the Bank, in which case the available balance should cover the transaction and charges. b. The Bank reserves the right (but is under no obligation to do so) to decline any Card transaction where both the relevant fee and the sum being withdrawn exceed the amount available in the Bank Card Designated Account at the time the transaction is executed. c. In the event that the Bank exercises its discretion to allow a Card transaction in an amount which exceeds the amount available in the Bank Card Designated Account and/or previously approved overdraft or credit facilities at the time the transaction is executed, you shall take immediate steps to put such Account in credit, and you will pay the Bank’s overdraft charges in relation to such extension of credit by the Bank. d. You shall not be entitled to withdraw any cash or make any debit transfer or payment against any cheques or other payments which have been lodged to the Bank Card Designated Account but are not yet cleared by the Bank. The Bank reserves the right (but is under no obligation to do so) to decline any such withdrawal, debit transfer or payment. e. The Bank may from time to time introduce (and thereafter vary) limits on the number and/or amount of transactions (including withdrawals) that may be carried out within a designated period using the Card, by a particular Cardholder, or on particular accounts. The Bank may from time to time introduce (and thereafter vary) other measures for the protection of the Bank, the Merchant, the Cardholder and/or the Customer against wrongful use of the Card. The Bank’s discretion to introduce such limits and measures shall not include any requirement so to do, and unless otherwise agreed in writing to the contrary between the Bank and the Customer, the Bank may permit transactions in excess of the limits and outside of the measures introduced, and shall not be liable to the Customer for so doing. f. RESTRICTIONS ON USE OF THE CARD. 12.1 The Card limits will be applied according to the Visa Inc. rules (available on xxx.xxxx.xx.xx) during online purchases and while M-PESA transaction limits will apply when performing any transactions affecting your M-PESA Account. When attempting a Card transaction, you will receive an SMS notifying you of any restriction imposed by Visa.

  • Restrictions on Use Tenant shall use the Premises and Landlord’s Equipment in a careful, safe and proper manner, shall not commit or suffer any waste on or about Landlord’s Property or with respect to Landlord’s Equipment, and shall not make any use of Landlord’s Property and/or Landlord’s Equipment which is prohibited by or contrary to any laws, rules, regulations, orders or requirements of public authorities, or which would cause a public or private nuisance. Tenant shall comply with and obey all laws, rules, regulations, orders and requirements of public authorities which in any way affect the use or operation of Landlord’s Equipment and the use, operation or occupancy of Landlord’s Property. Tenant, at its own expense, shall obtain any and all permits, approvals and licenses necessary for use of the Landlord’s Equipment and the Premises (copies of which shall be provided to the Landlord), provided that Landlord shall be responsible for obtaining a certificate of occupancy for the Building generally (i.e., as opposed to a certificate of occupancy for the Premises after the performance of any work by Tenant, which shall be Tenant’s responsibility) and any other permits, approvals and licenses necessary generally for the use of Landlord’s Equipment and Landlord’s Property. Tenant shall not overload the floors or other structural parts of the Building; and shall not commit or suffer any act or thing on Landlord’s Property which is illegal, unreasonably offensive, unreasonably dangerous, or which unreasonably disturbs other tenants. Tenant shall not knowingly do or permit to be done any act or thing on Landlord’s Property or with Landlord’s Equipment which will invalidate or be in conflict with any insurance policies, or which will increase the rate of any insurance, covering the Building. If, because of Tenant’s failure to comply with the provisions of this Section or due to any use of the Premises or activity of Tenant in or about Landlord’s Property, the Insurance Costs are increased, Tenant shall pay Landlord the amount of such increase caused by the failure of Tenant to comply with the provisions of this Section or by the nature of Tenant’s use of the Premises. Tenant shall cause any fire lanes in the front, sides and rear of the Building to be kept free of all parking associated with its business or occupancy and in compliance with all applicable regulations. Tenant shall conduct its business at all times so as not to annoy or be offensive to other tenants and occupants in Landlord’s Property. Tenant shall not permit the emission of any objectionable noise or odor from the Premises and shall at its own cost install such extra sound proofing or noise control systems and odor control systems, as may be needed to eliminate unreasonable noise, vibrations and odors, if any, emanating from the Premises being heard, felt or smelled outside the Premises. Tenant shall not place any file cabinets bookcases, partitions, shelves or other furnishings or equipment in a location which abuts or blocks any windows.

  • Restrictions on U.S Transfers. Transfers of interests in the Regulation S Global Security to U.S. persons (as defined in Regulation S) shall be limited to transfers made pursuant to the provisions of Section 3.03(h)(C).

  • General Restrictions on Use Advisor agrees to hold all Proprietary Information in confidence and not to, directly or indirectly, disclose, use, copy, publish, summarize, or remove from Company's premises any Proprietary Information (or remove from the premises any other property of Company), except (i) during the consulting relationship to the extent authorized and necessary to carry out Advisor's responsibilities under this Agreement, and (ii) after termination of the consulting relationship, only as specifically authorized in writing by Company. Notwithstanding the foregoing, such restrictions shall not apply to: (x) information which Advisor can show was rightfully in Advisor's possession at the time of disclosure by Company; (y) information which Advisor can show was received from a third party who lawfully developed the information independently of Company or obtained such information from Company under conditions which did not require that it be held in confidence; or (z) information which, at the time of disclosure, is generally available to the public.

  • Limitations on Use of Information The Fund agrees not to use the information received for marketing or any other similar purpose without the prior written consent of the Intermediary.

For purposes of this Agreement, a dramatic performance shall include, but not be limited to, the following: (i) performance of a “dramatico-musical work” in its entirety; (ii) performance of one or more musical compositions from a “dramatico-musical work” accompanied by dialogue, pantomime, dance, stage action, or visual representation of the work from which the music is taken; (iii) performance of one or more musical compositions as part of a story or plot, whether accompanied or unaccompanied by dialogue, pantomime, dance, stage action or visual representation; (iv) performance of a concert version of a “dramatico-musical work”; The term “dramatico-musical work” includes, but is not limited to, a musical comedy, opera, play with music, revue or ballet. (f) ASCAP reserves the right at any time to withdraw from its repertory and from operation of this license, any musical work as to which any suit has been brought or threatened on a claim that such composition infringes a composition not contained in ASCAP’s repertory, or on a claim that ASCAP does not have the right to license the performing rights in such composition. (g) This license does not authorize any performance by means of a coin-operated phonorecord player (jukebox) for which a license is otherwise available from the Jukebox License Office. (h) This license is limited to the United States, its territories and possessions, and Puerto Rico.
