Results of Survey. If the Handback Survey indicates that any of the Maintained Elements of the Buildings are not in a condition consistent with the Handback Requirements upon Project Co implementing the Plans over the remainder of the Term, within 60 days of completion of the Handback Survey Project Co will deliver to the Authority’s Operating Period Representative in accordance with Sections 4.8 and 4.9 of Schedule 4:
(a) Project Co's proposal as to the maintenance works (if any) (the "Handback Works") required to be carried out in respect of the Maintained Elements of the Buildings to satisfy the Handback Requirements as at the Expiry Date;
(b) Project Co's proposal for the carrying out of the Handback Works (the “Handback Works Plan”) over the remainder of the Term as part of the Annual Service Plan and the Five Year Maintenance Plan then in effect and describing the total works to be carried out as well as the method and schedule for carrying out such works; and
(c) Project Co’s calculation of the Handback Amount. The Authority’s Operating Period Representative may, within 20 Business Days after receipt of the Handback Works and Handback Works Plan, review and comment on such plan in accordance with Section 4.7 of Schedule 4.
Results of Survey. If the final survey shows that the Contractor has not complied with or is not complying with its obligations under Clause 26.1 (Maintenance) the Authority shall:
Results of Survey. If the final survey shows that the Contractor has not complied with or is not complying with its obligations under clause 21.1.4 (Maintenance) the Authority shall:-
32.4.1 notify the Contractor of the rectification and/or maintenance work which is required to bring the condition of the Waste Management Facilities to the standard they would have been in if the Contractor had complied or was complying with its obligations under clause 21.1.4 (Maintenance) (the “Required Standard”);
32.4.2 specify a reasonable period within which the Contractor must carry out such rectification and/or maintenance work; and
32.4.3 recover the cost of the survey from the Contractor by means of a withdrawal from the Retention Fund Account or Deduction from the next payment of the Monthly Unitary Charge.
Results of Survey. (a) If the final survey carried out pursuant to either Clause 28.3 or Clause 28.4 shows that the Concessionaire has not complied with or is not complying with its obligations under this Agreement, the Authority shall:
(i) notify the Concessionaire of the rectification and/or maintenance work which is required to bring the condition of the Terminal and the Port Crafts to the standard they would have been in if the Concessionaire had complied or was complying with its obligations under this Agreement (the Required Standard );
(ii) specify a reasonable period within which the Concessionaire must carry out such rectification and/or maintenance work; and
(iii) recover the cost of the survey from the Concessionaire by calling under Operational Performance Bond;
(b) The Concessionaire shall carry out such rectification and/or maintenance work notified pursuant to Clause 28.6(a) (the Outstanding Work ) in order to reach the Required Standard within the period specified and any costs it incurs in carrying out the Outstanding Work shall be at its own expense, unless otherwise instructed by the Authority where the final survey is carried out pursuant to Clause 28.4.
(c) If the Concessionaire has been notified under Clause 28.6(a)(i) that rectification and/or maintenance work is required, then:
(i) twelve (12) months prior to the Expiry Date where the final survey has been carried out pursuant to Clause 28.3; or
(ii) where the final survey has been carried out pursuant to Clause 28.4 within twenty
Results of Survey. If the final survey shows that the Contractor has not complied with or is not complying with its obligations under clause Maintenance the Authority shall:
41.5.1 notify the Contractor of the rectification and/or maintenance work which is required to bring the condition of the Schools to the standard they would have been in if the Contractor had complied or was complying with its obligations under clause Maintenance (“the Required Standard”);
41.5.2 specify a reasonable period within which the Contractor must carry out such work; and
41.5.3 recover the cost of the survey from the Contractor by means of a withdrawal from the [Retention Fund Account] or deduction from the next payment of the Unitary Charge.
Results of Survey. If a Final Survey shows that the Contractor has not complied with or is not complying with its obligations under Clause 24.1 (Maintenance of Project Facilities), the Authority shall:
41.5.1 notify the Contractor of the rectification and/or maintenance work which is required to bring the condition of the New Project Facilities to the standard they would have been in if the Contractor had complied or was complying with its obligations under Clause 24.1 and/or to bring them up to the standards required by the Handback Requirements (Required Standard);
41.5.2 specify a reasonable period which may where appropriate impose restrictions on the periods of time within which the Contractor must carry out such work; and
41.5.3 recover the cost of a Final Survey from the Contractor by means of a withdrawal from the Retention Fund Account or deduction from the next payment of the Monthly Unitary Charge.

If the Handback Survey indicates that any element of the New Facility will not be in a condition consistent with the Handback Requirements upon Project Co implementing the Plans over the remainder of the Term, within 60 days of completion of the Handback Survey Project Co will deliver to the Authority’s Operating Period Representative in accordance with Sections 4.7 and 4.8 of Schedule 4 [Services Protocols and Specifications]:
(a) Project Co’s proposal as to the maintenance and other works (if any) (the “Handback Works”) required to be carried out in respect of the New Facility to satisfy the Handback Requirements as at the Expiry Date;
(b) Project Co’s proposal for the carrying out of the Handback Works (the “Handback Works Plan”) over the remainder of the Term as part of the Annual Service Plan, Life Cycle Plan and the Five Year Maintenance Plan then in effect and describing the total works to be carried out as well as the method and schedule for carrying out such works; and
(c) Project Co’s calculation of the Handback Amount. The Authority’s Operating Period Representative may, within 20 Business Days after receipt of the Handback Works and Handback Works Plan, review and comment on such plan in accordance with Section 4.8 of Schedule 4 [Services Protocols and Specifications].
