The Concessionaire must a. Provide products or services of a quality satisfactory to the NAFI manager or their duly authorized representative.
b. Before beginning performance under this agreement, the Concessionaire will submit a listing of items, with corresponding selling prices, to the Contracting Officer for approval or disapproval action. The final approved listing is considered part of this agreement. Place the price list in a conspicuous spot for patrons to see.
c. At Concessionaire's expense, obtain all permits, give all necessary notices; pay all license fees; and comply with all municipal, prefectural, and national laws, rules, ordinances, and regulations, and any publication published by the military relating to public health or applicable to the business carried on under this agreement and assume complete and sole liability for all national, state, and local taxes applicable to the property, income, and transactions of the concession.
d. Comply with all applicable laws pertaining to wages, worker's compensation, equal opportunity, Service Contract Labor Standards Act, and so forth, as implemented by Air Force directives and required by law.
e. Comply with all memoranda, bulletins, and letters of instruction issued by or in behalf of the NAFI manager or their duly authorized representative.
f. Keep the concession area clean, orderly, attractive, secure, and in a safe and sanitary condition to the satisfaction of the NAFI manager.
g. Employ only persons who meet the health standards prescribed by law or regulations, which pertain to the jobs for which they are hired.
h. Furnish a sufficient number of trained employees for the efficient performance of this Concessionaire contract. Concession personnel must meet the health and security standards prescribed by applicable regulations, and must obtain installation passes and permits and security clearances as applicable. Concession personnel must give prompt and courteous treatment to authorized customers. Concession personnel must be neatly dressed and meticulous in their personal grooming at all times. Concessionaire provides employees clean uniforms or, when uniforms are not required, ensures that all clothing worn by employees is clean and in good condition at all times. A nameplate must be worn.

The Concessionaire must. (a) notify the Grantor of any natural events or activities on the Land or the surrounding area which may endanger the public or the environment;
(b) take all practicable steps to protect the safety of all persons present on the Land and must, where necessary, erect signposts warning the public of any dangers they may encounter as a result of the Concessionaire's operations;
(c) take all practicable steps to eliminate any dangers to the public and must clearly and permanently mark any that remain and of which the Concessionaire is aware;
(d) record and report to the Grantor all accidents involving serious harm within 24 hours of their occurrence and forward an investigation report within 3 days of the accident occurring;
(e) ensure that all contracts between the Concessionaire and any contractors contain, at a minimum, the same requirements as clause 14;
(f) be satisfied that facilities or equipment provided by the Grantor to enable the Concession Activity to be carried out meet the safety requirements of the Concessionaire;
(g) not bring onto the Land or any land administered by the Department any dangerous or hazardous material or equipment which is not required for purposes of the Concession Activity; and if such material or equipment is required as part of the Concession Activity, the Concessionaire must take all practicable steps at all times to ensure that the material or equipment is treated with due and proper care.
The Concessionaire must a) Keep copy of information or data or equivalent of the sample in the national territory;
b) Return the samples and/or data to the country, after the analysis, test or processing;
c) Provide ANP with the results obtained with carried out analyzes, tests and processing, meeting the deadlines of the applicable legislation.

14. What are the compliance obligations of the Concessionaire?
14.1 The Concessionaire must comply where relevant:
(a) with the provisions of any conservation management strategy or conservation management plan under the Conservation Xxx 0000 or Part IIA of the Reserves Xxx 0000, or any general policy statement made under the Conservation Xxx 0000, Reserves Xxx 0000, Xxxxxxxx Xxxxx Xxx 0000, or Wildlife Xxx 0000, or management plan under section 45 of the National Parks Act 1980, whichever is appropriate to the Land, together with any amendment or review of any policy, strategy or plan whether approved before, on, or after the date on which this Concession takes effect; and
(b) with the Conservation Xxx 0000, the Reserves Xxx 0000, the National Parks Xxx 0000, Wildlife Xxx 0000 and any other statute, ordinance, regulation, bylaw, or other enactment (collectively the “Legislation”) affecting or relating to the Land or affecting or relating to the Concession Activity, including any regulations made under the Conservation Xxx 0000 and Wildl...

The Concessionaire must. 13.1.1 Carry out the Works in a manner that complies with the Environmental Protection Plan, DFO Initial Authorization, Water Act Approval and the NWPA Approvals and protects and maintains surface and groundwater resources, both within and outside the Site and Adjacent Areas, including drinking water supplies.
13.1.2 Be responsible for planning, scheduling and performing the Works in such a manner that the quality of water flowing from the Site, the OffSite Facilities, the Temporary OffSite Facilities and the Graving Dock Construction Facility is, at all times, acceptable to all relevant environmental agencies, and take immediate action to correct any deficiency in water quality.
13.1.3 The Concessionaire is responsible for conducting water quality field sampling during construction, as described in the Environmental Protection Plan.
13.1.4 Should the water quality monitoring program indicate that water quality has deteriorated, directly or indirectly, as a result of the Works or the Decommissioning, the Concessionaire is responsible for all costs associated with implementing measures to identify the source of the problem and re establishing the ambient water quality condition.
