Right-of-Way Dedication. Developer’s predecessors in title have dedicated the required right-of-way along South Xxxxxx Road pursuant to the requirements of the PUD (the “Right-of-Way”).
Right-of-Way Dedication. In order to promote regional mobility within the County, the District has previously dedicated approximately 6.901 acres of right of way (approximately 100’ wide) within the District directly to the Fort Bend County Toll Road Authority (“FBCTRA”) at no cost to FBCTRA. Said right of way is located along existing F.M. 1093 and was provided as a contribution by the District for the potential future expansion and extension of the West Park Toll Road under a Joint Project Agreement Regarding Road Right of Way dated effective August 27th, 2019 (“JP Agreement”) between the District, the County, FBCTRA and Developer. After the Effective Date of this Agreement, and upon the written request of the County, the District (by and through its agreements with Developer) will convey to the FBCTRA (at no cost to the FBCTRA) an additional 1.095 acres of right of way for the future widening and extension of the Westpark Toll Road (“Westpark Toll Road ROW”) as depicted on Exhibit “G”. The conveyance instrument shall be in a form that is mutually agreeable to FBCTRA and the District and contain similar rights and terms as the JP Agreement. Upon the County’s abandonment of and relinquishment of rights to Abandoned Love Road to Developer, the District (by and through its agreements with Developer) will convey to the County (at no cost to the County) the remaining portion of Love Road right of way as depicted on Exhibit “H” (“Dedicated Love Road”). The conveyance instrument shall be in a form that is mutually agreeable to the District and the County. In exchange for the contribution of Dedicated Love Road, the County agrees that it shall not require and/or impose upon the District, Developer or any other developer or landowner within the District, the requirement to design, build and/or fund any future public road improvements, and/or any financial obligation to maintain and/or improve the Dedicated Love Road or the Abandoned Love Road.
Right-of-Way Dedication. Upon request by PBOT, Prosper Portland will dedicate public right-of- way for XX Xxxxxxx and XX Xxxxxxx Streets, NW Park Avenue, and the right turn lane at XX Xxxxxxx and 0xx Xxxxxx; provided that the parties acknowledge that the design of such right turn lane will be determined in accordance with Section 1.2.5, above, and unless the parties agree otherwise, the dedication will be no more than three (3) feet in width. PBOT acknowledges that Prosper Portland, in the dedication of public right-of-way, is obligated to comply with (a) that certain Purchase Agreement, dated May 5, 2016, governing Prosper Portland’s acquisition of the USPS Property from USPS (as amended, the “USPS PSA”) which requires any transfer to contain a covenant not to xxx USPS; and (b) the Consent Judgment, which requires that any transfer document expressly state that it is subject to the Consent Judgment.
Right-of-Way Dedication. The parties have discussed their various interests and determined that Bayer shall have no further obligations to dedicate public rights of way or other interests.
Right-of-Way Dedication. As shown in Figures 1 and 2, the ROW dedication is treated differently for primary and secondary roadways. For primary roadways, a portion of the ROW will have an ultimate conveyance to VDOT.
Right-of-Way Dedication a. Within thirty (30) days after the execution of this Agreement, the Developer shall execute a Quit claim Deed to Westfield for the Road Extension Property. Westfield shall pay whatever costs are associated with conveying the Right of Way Dedication, including the cost of any Survey.
Right-of-Way Dedication. 1. Pursuant to the requirements of this Agreement, Developer has agreed to Dedicate right-of-way on CR 210 valued at $760,000.00. Developer has requested, and the County has agreed to provide Developer certain credits against the payment of Road Impact Fees based upon the total value of the off-site Improvements/ROW as follows:
Right-of-Way Dedication. Right-of-way for County Road 212 adjacent to the Property shall be dedicated in accordance with the City of Xxxxxx Thoroughfare Plan in existence as of the Effective Date of this Agreement or as mutually agreed to by the Parties.
Right-of-Way Dedication. In consideration of the City’s approval of the final plat application without dedication of right of way or installation of required street and infrastructure improvements, the parties agree to the following:
Right-of-Way Dedication. The City will work with the County to determine the appropriate amount of right-of-way along existing and future County highways to be dedicated by the developer through the platting process.
