School Board Authority. The Association recognizes that subject to the provisions of this Agreement and the Public School Laws of Maryland, the Board of Education and the Superintendent of Schools reserve and retain full rights, authority and discretion in the proper discharge of these duties and responsibilities to control, supervise and manage the Xxxxxxx County Public Schools under existing law, rules and procedures.

School Board Authority. Subject to the terms and conditions of this Agreement and to the provisions of the Public School Laws of Maryland, it shall be the exclusive function of the Board of Education and the Superintendent of Schools to determine the mission of the county public education system and to operate the affairs and direct the personnel of the system in all aspects, including but not limited to the standard of service to be offered; the efficiency of administration; the methods, means and personnel by which such operations are to be conducted, the right to discipline, and to take whatever action and issue rules, policies, procedures and regulations necessary to carry out the mission of the county public education system for which they are responsible and which is entrusted to them.
School Board Authority. The parties acknowledge that the Board is responsible for the management and direction of the District according to the laws of the State of South Dakota, and has the authority to adopt policies, rules, and regulations to carry out such management and direction.

CCEA recognizes that the Board of Education and the Superintendent of Schools reserve and retain full rights, authority and discretion in the proper discharge of their duties and responsibility to control, supervise and manage the Xxxxxxxx County Public Schools under applicable law, rules and procedures. Nothing in this Agreement shall otherwise be construed to limit the powers and responsibilities conferred upon the Board or the Superintendent of Schools under the statutes and laws of the State of Maryland. Any failure to enumerate in this Agreement the retained powers, rights, authority and prerogatives of the Board or the Superintendent of Schools shall not be construed as waiver of any such powers, rights authority or prerogatives.

School Board Authority. The School Board represents to the Province and the Contractor, that the obligations of the School Board under this Agreement have been duly authorized by the School Board.
School Board Authority. The operation and management of the District and the direction of its employees are vested in the School Board. Except as specifically restricted by the provisions of this Agreement or other federal or state law, the School Board has the exclusive authority to establish policy and manage the conduct of the public schools within its jurisdiction. The School Board's exclusive authority includes but is not limited to, the right to operate the District, to staff the District, to direct the Employees to select its supervisory personnel, to hire new Employees, to layoff Employees, to assign work, to transfer work or Employees; and to discipline and discharge Employees for just cause. This Agreement does not, in any way, restrict the right of CATA as permitted by Act 195 to bring to the employer, on a "meet and discuss" basis, policy matters affecting wages, hours, terms or conditions of employment.
