Section 10.8.3. 13 Employees exercising their preferential seniority rights regarding shift selection may be 14 evaluated within thirty (30) working days by the District. Continuance in the new shift 15 assignment shall be subject to the evaluation, Articles V, VI, and/or XV, upon the request of 16 either party.

Section 10.8.3. 33 The returning employee will be assigned to the same position occupied immediately prior to the 34 leave of absence. If that position is not available, the returning employee will be assigned to a 35 position equivalent (similar) in duties and salary to that held prior to the leave of absence. The 36 replacement employee will be informed of the returning employee’s rights at the time of 37 posting. If a current classified employee was hired to fill the leave of absence position, that 38 employee will return to his/her previous position.
