Section 504 Plans. The State shall develop and implement policies, procedures and practices to provide that Section 504 plans are developed and implemented for eligible youth.

The District recognizes its obligation under the regulation implementing Section 504 at 34 C.F.R. § 104.33 to provide a free appropriate public education (FAPE), including the development and implementation of Section 504 plans, to each qualified student with a disability in its jurisdiction.

By April 1, 2022, the School will create for OCR review and approval a plan for reviewing all IEP and Section 504 Plans for all students enrolled in the School to determine whether the placement, accommodations, and services are appropriate educational services designed to meet the student’s individual needs.

Several youth at each facility have 504 plans that identify accommodations and supports. Discussion with staff, observations, and file review indicated that several youth indicate that 504 plans are developed appropriately and that teaching staff are aware of students in need of accommodations and supports. Recommendations Both facilities have been in substantial compliance with this provision for approximately 18 months, beginning December 31, 2006.
