Common use of Seniority Applied Clause in Contracts

Seniority Applied. If seniority is to be used in the scheduling of vacation, request for time off must have been made at least three and one-half (3½) months in advance of the schedule. If a nurse(s) is denied vacation because more nurses request the same vacation time off than can be accommodated, that nurse(s) must notify their manager of their intention to apply their unit credit seniority within two (2) weeks of receiving their denial. A nurse who successfully uses the “seniority to be applied” may do so one (1) time every three (3) years regardless of whether the vacation time is taken. “Seniority to be applied” will be applied against the least senior nurse. Vacation requests will be responded to within two (2) weeks of application and will be granted in a manner consistent with the staffing needs. No request shall be unreasonably denied.
