- Seniority Definitions and Uses. City wide seniority shall be defined as the length of continuous employment with the City of Bay City commencing on the employee's last date of hire with the City, and shall be used to determine benefit levels. Bargaining unit seniority shall be defined as the length of continuous employment in the bargaining unit commencing with the last date of hire in the bargaining unit and shall be used for layoff and recall, promotions, lateral transfers and vacation disputes. Bargaining unit seniority for bargaining unit employees working in the bargaining unit on the date of ratification of the first contract (April 4, 2005) shall be equal to their current City-wide seniority. The bargaining unit seniority rights of members of the bargaining unit apply only within the bargaining unit, and bargaining unit seniority rights have no application outside of the bargaining unit. However, when an employee applies for a promotion or transfer within the City, the City shall consider City-wide seniority as one of the factors in determining qualifications in accordance with any other applicable collective bargaining agreement.
