Promotion or Transfer. After a person with a disability is employed, the employer shall not be required under this chapter to promote or transfer the person to another job or occupation, unless, prior to the transfer, the person with the disability, by training or experience, is qualified for the job or occupation. Any collective bargaining agreement between an employer and labor organization shall contain this section as part of the agreement.

Promotion or Transfer. In all cases of promotion, transfer or reassignment of work, seniority shall be the governing factor, provided that the employee with the most seniority has the qualifications, skill and ability to perform the job concerned.
Promotion or Transfer. In the event of promotion in or transfer from one classification to another, the employee shall be given a thirty (30) workday trial in which to show his/her ability to perform on the new job. If the employee is unable to demonstrate ability, as determined by the Employer, to perform the work required during the trial period, or at the option of the affected employee, the employee shall be returned to his/her previous assignment. The Employer will be able to use a substitute in the former position.
Promotion or Transfer shall have the choice of remaining a classified employee or becoming a participating covered employee. If a classified employee elects to become a participating covered employee, that decision shall be irrevocable.
Promotion or Transfer. The Authority shall consider applicants within the bargaining unit for whom a successful bid would result in a promotion or transfer (as defined herein) to a higher or equal rate classification. In cases of promotion or transfer, the following factors shall be considered: a) Skill, ability, performance, qualifications and experience; b) Seniority within the Union at the Authority; When the matters in factor a) are relatively equal in the opinion of Authority, then factor b) shall govern.

(b) Should the employee be unable to satisfy the requirements of the work performance criteria in the trial period, or should the employee decide during the trial period that he/she does not want to continue in the job, then the employee shall be returned to his/her former position. In such circumstances, the Employer shall have the right to require all employees who changed positions in consequence of the promotion or transfer, to move back into their positions and wage rates which they occupied prior to the promotion or transfer. (c) Any employee in the bargaining unit who applies for, and is awarded, a position with the Employer outside the bargaining unit shall be on a trial period for thirty-five (35) calendar days. During this trial period, the employee of the Employer, at either’s sole discretion, may decide to have the employee return to his/her former position within the bargaining unit. In such circumstances, the Employer shall have the right to require all the employees who changed positions within the bargaining unit, in consequence of the movement of the employee to a position outside of the bargaining unit, to move back into their positions and wage rates which they had previously occupied.

The Institute will notify any employees who may be affected by this clause when it makes an offer of employment and in the appointment letters. 17.3.3 Permanent employees who are promoted or transferred to temporary positions will return to their previous positions when the temporary assignments are complete. 17.3.4 Upon promotions through competition, employees will be placed on the scale according to their length of service with the Institute and without change to their increment date.
