Common use of Seniority Tie Breaker Clause in Contracts

Seniority Tie Breaker. In the event two (2) or more seniority dates are tied, the relative order of priority will be determined by the date an employee’s application or transfer form was received for the position on which the employees’ seniority is based. The employee with the earliest date of receipt on the application/transfer form will have first priority within the group. In the event one (1) or more employees do not have a date stamped application/transfer form, the last four (4) digits of the employees’ social security number will be added up with the highest number receiving first priority and so on.
