SERVICES AND OPERATIONS. (a) All promotional material, regardless of media format (i.e., printed, electronic, broadcast media), provided to the public by the Concessioner in connection with the services provided under this Contract must be approved in writing by the Director prior to use. All such material will identify the Concessioner as an authorized Concessioner of the National Park Service, Department of the Interior. (b) The Concessioner will provide Federal employees reduced rates, in accordance with guidelines established by the Director, when conducting necessary official business. Complimentary or reduced rates and charges may otherwise not be provided to Federal employees by the Concessioner except to the extent that they are equally available to the general public. (c) The Director and Comptroller General of the United States, or any of their duly authorized representatives, will have access to the records of the Concessioner as provided by the terms of Applicable Laws. (d) Subconcession or other third party agreements, including management agreements, for the provision of Visitor Services required and/or authorized under this Contract, whether in consideration of a percentage of revenues or otherwise, are not permitted. (e) The Concessioner will ensure that any protected sites and archeological resources within the Area are not disturbed or damaged by the Concessioner's activities. Discoveries of any archeological resources by the Concessioner will be promptly reported to the Director.

SERVICES AND OPERATIONS. ‌ (a) Required and Authorized Visitor Services‌ During the term of this Contract, the Director requires and authorizes the Concessioner to provide the following visitor services for the public within the Area:

Nothing in this agreement shall be construed as preventing or otherwise discouraging the Developer from facilitating use of the Course for activities in addition to golf.

The Operations shall include: 10.2.1.4 supply of blanks of Identity Documents; 10.2.1.5 collection of applications and processing of data (including biometric data) for Identity Documents; 10.2.1.6 collection and allocation of fees for Services due from customers to the Government; 10.2.1.7 personalization of Identity Documents; 10.2.1.8 acting as registration authority for qualified signature according to eIDAS requirements 10.2.1.9 other operational activities that aim to ensure the provision of Services and correspond to the Technical Requirements. 10.2.2 The Private Partner shall comply with the rules of Technical Requirements which specifically or substantially apply to the provision of Services and performance of Operations by the Private Partner, including, without limitation, the requirements for Identity Documents (as per section 2.4 of Technical Requirements), the KPIs for Services (as per section 2.5 of Technical Requirements), and performance of enrolment and personalization Services/Operations (as per subsection 2.6.2 of Technical Requirements). 10.2.3 The Private Partner shall ensure that all appropriate fee collection instruments for Services and Operations, including the online and on-site payment mechanisms, as well as the Private Partner’s account for collecting payments for Services and Operations under this Agreement have been established until the Operational Date. SERVICES AND OPERATIONS. (a) Required and Authorized Visitor Services The Concessioner must provide the following required Visitor Services within the Area: Canoe rental services to park visitors. This service may include transporting the visitor to the appropriate access point and picking them up again and returning them to their personal vehicle. The Concessioner may provide the following authorized Visitor Services within the Area: Shuttle service related to the rental. The Concessioner will be permitted to provide shuttle service to transport private canoes. Raft and kayak rentals and shuttle service related to the rentals are authorized. Private vehicle shuttle service is authorized. (b)Operation, Maintenance and Quality of Operation (1) The Concessioner must provide, operate and maintain the Visitor Services in accordance with this Contract in a manner considered satisfactory by the Director, including the nature, type and quality of the Visitor Services. The Concessioner's authority to provide Visitor Services under the terms of this Contract is nonexclusive. The Concessioner's operations and contract compliance will be evaluated on at least an annual basis. (2) The Director assigns government owned personal property listed in Exhibit C to the Concessioner. The Concessioner must maintain the government owned personal property assigned to it and will be responsible for maintaining the property as necessary to keep it in good and operable condition. If the property ceases to be serviceable, it must be returned to the Director for disposition.

SERVICES AND OPERATIONS. (a) Schedule 3.23 is a copy of a computer-generated list of all records or cartons for which a retrieval request was received between January 1, 2004 and May 31, 2004 from a customer and where the requested item was reported as not found. (b) Seller invoices for storage monthly one (1) month in advance and for services monthly in arrears (e.g., on June 1, 2004 Seller issued invoices for storage for the month of July 2004 and for any activity in May 2004 with respect to customer’s stored records or files). (c) Seller’s invoices to customers of the Business are accurate in all material respects other than with respect to discrepancies that are not reasonably likely to have a Material Adverse Effect, and such invoices do not charge customers for material quantities of nonexistent items or for services not performed. (d) Schedule 3.23 identifies materials stored with Seller that, to Seller’s Knowledge, have been damaged (including damage by water) or inadvertently destroyed. In each such case identified on the schedule, the relevant customer has been notified in writing of the event. (e) Schedule 3.23 identifies each instance since January 1, 2004 in which Seller was unable to locate a record or file requested by a customer and such event led to a customer complaint (either written or oral).
