Delivery Times: All deliveries must be made during normal working hours. Generally this is to mean between 8:00 am and 3:00 pm. Delivery Notification: The vendor must notify the ordering department minimally two (2) business days in advance of delivery. If there is a scheduled holiday the vendor must provide minimally three (3) business days notice. Each State has their own holiday schedule and the vendor is responsible for obtaining these schedules. Deliveries attempted to be made without the required notification can be rejected and the State will not be held responsible for the extra delivery charges. If delivery occurs after normal working hours, acceptance or rejection shall be at the convenience of the State. Delivered Items Condition: The items being delivered must in good condition upon arrival. The State shall not bear any responsibility for the goods in question until the State takes possession of them at the destination point of delivery. The pipe will be accepted or rejected at the time of delivery. The unloading shall be a mutual effort between State and Supplier. The State will not be responsible for the costs of material or return shipping costs for items returned due to poor condition.

The demo chairs will be used for the term of the contract for ergonomic chair evaluations, demonstrations, and chair selection. The Wellness Center will request the chairs from the vendors based on their needs and requirements. Vendors are to tag each demonstration chair with specific ordering information. Detailed Requirements: Vendors will be expected to stock several contract chairs to meet the requirements of departments that do not have a color preference. Orders should be screened and if the model of chair is in stock but in another color, a call will be placed to the customer to determine if they will accept what is on hand. Product Requirements: Seating must be designed for flexibility of use so that it is able to accommodate varied tasks. Seating must be fully adjustable so that it is able to fit the needs of many workers. Such adjustments must be designed so that they are easy to reach and execute while sitting in the chair. Chairs are to have pneumatic seat height adjustment. Other desirable adjustments may include, but are not limited to, seat pan inclination, backrest inclinations with variable position lock, seat depth adjustment, sliding seat pan, and backrest height adjustment.   • Delivery Point The delivery point is the point of delivery of the Power Product to the CAISO Controlled Grid (the “Delivery Point”). Seller shall provide and convey to Buyer the Power Product from the Generating Facility at the Delivery Point. Title to and risk of loss related to the Power Product transfer from Seller to Buyer at the Delivery Point.

  • Delivery Points ‌ Project water made available to the Agency pursuant to Article 6 shall be delivered to the Agency by the State at the delivery structures established in accordance with Article 10.

  • SHIPPING AND SHIPPING COSTS All delivered Equipment and Products must be properly packaged. Damaged Equipment and Products may be rejected. Supplier must arrange for and pay for the return shipment on Equipment and Products that arrive in a defective or inoperable condition. Sourcewell may declare the Supplier in breach of this Contract if the Supplier intentionally delivers substandard or inferior Equipment or Products.

  • Shipping Costs All items must be bid Freight On Board Destination (hereinafter FOB). This does not include hardware items being shipped to Alaska or Hawaii. Actual shipping costs will apply to items shipped Alaska or Hawaii.

  • Contract Quantity The Contract Quantity during each Contract Year is the amount set forth in the applicable Contract Year in Section D of the Cover Sheet (“Delivery Term Contract Quantity Schedule”), which amount is inclusive of outages.

  • Shipping Axon may make partial shipments and ship Axon Devices from multiple locations. All shipments are FOB shipping point via common carrier. Title and risk of loss pass to Agency upon Axon’s delivery to the common carrier. Agency is responsible for any shipping charges in the Quote.

  • API If the Software offers integration capabilities via an API, your use of the API may be subject to additional costs or Sage specific policies and terms and conditions (which shall prevail in relation to your use of the API). You may not access or use the API in any way that could cause damage to us or the Software, or in contravention of any applicable laws. We reserve the right in our sole discretion, to: (i) update any API from time to time; (ii) place limitations around your use of any API; and (iii) deny you access to any API in the event of misuse by you or to otherwise protect our legitimate interests.

  • Contact Points Each Party shall designate a contact point to facilitate communications between the Parties on any matter covered by this Agreement.

  • Destination The term (“Destination”) means delivered to the receiving dock or other point specified in the applicable Contract Document.

  • Shipment Dell will ship the APEX System to the Site when included as part of the APEX Service. The terms and process for shipment and delivery of the APEX System will be stated in the applicable Service Offering Description.
