Sick Leave Bank. a. Upon the date of execution of this Agreement, there shall be established, or continued in the case of those Colleges having previously so established, a Sick Leave Bank. b. During the term of this Agreement, a unit member who is not a member of the Sick Leave Bank will automatically become so during the month of October. Sick Leave Bank. a. Upon the date of execution of this Agreement, there 18.01 There shall be established, or continued a Sick Leave Bank available to all members of the bargaining unit. The "bank" and membership in it shall be established in the case following way: 18.01.01 Each member of those Colleges having previously so established, a the bargaining unit will have one sick-leave day deducted from his yearly allotment to initially implement the bank. 18.01.02 All members of the bargaining unit will participate in and be eligible for the Sick Leave Bank. b. During 18.01.03 Should the term "bank" fall below 100 days, each member of the unit will be assessed to contribute a sick-leave day. 18.01.04 If a member has no sick leave days, he/she will automatically be assessed the day owed at the end of September of the following year. 18.01.05 Should a teacher leave the system owing a sick-bank day, he/she shall be liable for a substitute's daily pay. 18.01.06 When a teacher enters the system, he/she shall have one sick leave day deducted for the bank after thirty (30) days employment. This provision will not be applied to teachers entering after May 15. 18.02 THE SICK LEAVE BANK WILL BE ADMINISTERED AS FOLLOWS: 18.02.01 The Sick Leave Bank Committee shall be comprised of six members. The President of the Malden Education Association shall appoint three members. The Superintendent shall be a member and two members of the School Committee, appointed by the School Committee, shall be members. The Bank shall be administered in accordance with the guidelines of this Agreement, a unit member who is not a member Article. The President ; except that, in the case of a provisional employee, such employee who shall have accumulated forty five (45.00) hours (six (6) days) of sick leave and is not a member of the College Bank may become a member by assigning to the Bank, during the month next following, seven and one-half (7.50) hours (one (1) day) of such personal sick leave days so accumulated. No administrator shall be entitled to become a member of the Sick Leave Bank save as in hereinbefore provided. Assignment by an administrator of a personal sick leave day to the Bank shall be made in writing to the University Personnel Officer. The University Personnel Officer or the President’s his designee shall maintain a register of the membership of the Sick Leave Bank and of the number of sick leave days accumulated in the Bank. d. Five . Annually during the month of July, the University Personnel Officer shall give written notice to the local Association Representative of: (a) the total number of days accumulated in the Sick Leave Bank as of July; and (b) the names of all those administrators at the University who are members of such Bank on such date. At each University where a Sick Leave Bank shall have been established pursuant to the terms of this Agreement, there shall also be established a Sick Leave Bank Committee, which committee shall consist of two (2) persons chosen by the President of the University, and two (2) members of the bargaining unit chosen by the President of the Association. Once he has been off the payroll for thirty seven and one-half (37.50) hours (five (5) working days after the exhaustion of a sick leave bank member’s personal sick leave accumulation, compensatory time, and personal leave accumulationdays), every member of the Sick Leave Bank shall be entitled eligible to draw upon the Sick Leave Bank, effective thereafter upon notice to the President of the College. The granting of such sick leave shall be subject to the same criteria Bank as regular sick leave days and shall be in all other respects consistent with Employer policyneeded; provided, however, that any member of the Sick Leave Bank wishing to draw upon the Bank shall first make application to the Sick Leave Bank Committee. The Committee shall determine and certify to the President of the University whether the applicant is eligible in accordance with the provisions of this subsection. The Committee may recommend to the President that such an applicant, and/or any unit member receiving sick leave benefits from the Bank, should be examined by a physician, and they shall do so upon the written request of the President of the Association. The Committee may also at reasonable times recommend that the President require an examination by a physician and/or require a physician’s report from an applicant or a person receiving benefits. The Committee may recommend to the President that benefits be provided, or continue to be provided, to any eligible applicant after such examination or certification or that they be terminated. The President may require that a unit member who is on leave of absence by reason of sickness be examined by a physician chosen by the President or his designee. Any unit member who thereafter fails or refuses such examination may not draw accumulated sick leave, or upon the Sick Leave Bank. The University will pay the costs of all physical examinations. The physician shall render a written report to the President of the University. The President shall provide a copy of the physician’s report to the Committee, to the unit member and to the President of the Association. The President may, upon receipt of such medical report and the recommendation of the Committee, terminate the sick leave benefits or deny eligibility, as the case may be. The decision of the President shall not be arbitrary or capricious. No member of the bargaining unit shall, during any five (5) year period commencing with the date on which he/she first draws upon the Sick Leave Bank, draw in the aggregate there from more than the equivalent of two (2) work years of sick leave for any single illness or injury. Whenever any person is drawing upon the Sick Leave Bank, and while doing so, is entitled to accumulate personal sick leave in accordance with the provisions of the foregoing paragraph (a), the amount of such sick leave that would otherwise accrue to such person shall be available only for accrue in its full amount to the illness of the employee and not for the illness of the family. e. Sick Leave Bank. Whenever the accumulation of sick leave days in the Sick Leave Bank shall have fallen to three hundred seventy-below twenty five (375) hours [fifty (5025) days], the President University Personnel Officer shall so notify the local Association Representative in writing, and any member of the College or Sick Leave Bank wishing to remain a member thereof shall, within fifteen (15) days after the President’s designee shall notify all members. Thereaftergiving of such notice, assign an additional seven and one-half (7.57.50) hours [(one (1) day) of his personal sick leave day] from each member's accumulated sick leave shall be assigned accumulation to the Bank unless a member notifies the President of the College or the President’s designee in writing within five (5) days of receipt of said notice that that member does not wish to remain a memberBank; provided, however, however that any member of the Sick Leave Bank wishing to remain a member thereof and who shall have exhausted that member’s his personal sick leave accumulation on the date of the giving of such notice, shall assign such additional days day within fifteen (15) days after the date on which such member is next entitled to personal sick leave leave; and provided further that such member shall retain all his rights in the Bank until such period of for assigning an additional day shall have expired. No administrator shall be permitted to contribute any day or days of personal sick leave to the Sick Leave Bank except in excess such amounts as are provided in this subsection (e). Anything in the foregoing to the contrary notwithstanding, members of a sick leave bank shall continue to be eligible to draw upon such bank irrespective of the fact that the total number of days in such bank is less than twenty-five (25); provided, however, that if, pursuant to which that unit member is entitled as determined by the administrationprovisions of this subsection (e), there are no members of a sick leave bank, those who were last members shall remain eligible to draw upon such bank, pursuant to the provisions of this subsection (e), until all the days accumulated therein shall have been exhausted.

Sick Leave Bank. a. Upon The Governing Board, in cooperation with the date of execution of this AgreementAssociation, there shall be established, or continued in the case of those Colleges having previously so established, establish a Sick Leave Bank to be administered by the Association. The Association shall establish rules for the implementation of the Bank which supplement and are not inconsistent with the following provisions: A. Membership in the Bank shall be voluntary. To be a member of the Bank, employees must join with an initial donation of two (2) days and rejoin each September by donating one (1) sick leave day for that school year to the Bank. Part-time employees contribute a half day. Each employee is limited to a total donation of two (2) days in any one school year. The total number of days available in the Bank shall not exceed 1,000 at the commencement of any school year. B. An employee may not withdraw days from the Bank for illness until the employee’s own accrued sick leave has been depleted, a three (3) day period has transpired without pay for each illness, and a written verification of illness from a licensed physician has been received by the Sick Leave Bank Committee. Days withdrawn from the Bank by a given employee will be limited to a maximum of ninety (90) days and will not have to be replaced except as a regular yearly contributing member of the Bank. b. The employees shall not hold the Governing Board or the Administration of SPEED liable for any decisions made by the Sick Leave Bank Committee. The Association agrees to hold harmless the Governing Board and the Administration of SPEED for any claim, damages, or legal actions regarding the Bank. G. Sick Leave Bank. a. If a unit member does not want to be a member of the sick leave bank, that unit member shall provide by October 30 written notice to the President of the College or the President’s designee that the unit member is not assigning to the Employer seven and one-half (7.5) hours [one (1) day] of that unit member’s personal sick leave accumulation. c. All requests for withdrawals from the Sick Leave Bank must be made in writing accompanied by written medical evidence (e.g. a note from the employee’s doctor/physician/medical provider indicating the inability of the employee to perform his/her duties). The medical evidence must include the specific nature of the illness and/or injury, and the date the employee may be expected to return to work. f. The Sick Leave Bank may only be used for an employee’s illness or injury. g. Employees who withdraw days from the Sick Leave Bank will be paid for each day at their current per diem (daily) rate of pay. h. A Sick Leave Bank Committee (SLBC) composed of two (2) members appointed by the Federation President, and two (2) members appointed by the Superintendent of Schools, shall meet to consider all requests to withdraw days from the Sick Leave Bank. The decision of the SLBC to grant or deny a request shall be made by majority vote of the SLBC. In the event a vote of the SLBC results in a tie, the Superintendent shall review the request, including any medical evidence presented by the employee, and he/she shall cast a final vote to break the tie. The vote shall be final and binding on all parties and shall not be subject to appeal or arbitration, provided the decision of the SLBC is not arbitrary or capricious. i. Whenever the balance of the Sick Leave Bank exceeds one hundred and twenty-five (125) days, there will be no need to annually assess additional days. Members will automatically donate one (1) additional day whenever the balance of the Bank falls below one hundred and twenty-five (125) days. In no case will a member be assessed more than two (2) days in any given school year. The following criteria shall be used by the Sick Leave Bank committee in determining the eligibility of a member to draw from the Bank and determining the amount of leave: a. A member must have fallen used up all of his / her accumulated sick leave; b. Members must submit competent and timely evidence that a request is necessary to three benefit the member who is suffering uncommon, life-threatening or serious or lengthy illness; c. A member’s prior utilization of the Sick Leave Bank. 4. Upon completion of the application process, the Sick Leave Bank committee may issue a grant of days from the Sick Leave Bank of no more than one hundred (100) shifts in each year. 5. The Sick Leave Bank shall have a minimum of seventy-five (37575) hours [fifty shifts in reserve. If the number of shifts falls below seventy-five (5075) days]then Section 1 shall be reapplied. However, the President total number of Sick Leave Bank shifts in reserve shall not exceed three hundred (300.) Sick Leave Bank. a. All P.R.E.S.P.A. personnel of the Bargaining Unit may participate in the bank on a voluntary yearly basis. During The primary purpose of the term Sick Leave Bank is to protect an Employee’s earning power during periods of protracted and unavoidable absence due to his/her incapacity to perform the responsibilities of his/her assignment. Each Employee may join the Sick Leave Bank only after he/she donates one (1) day, and only one (1) day, of his/her accumulated sick leave to the Bank and submit his/her authorization to join. To facilitate the GFT in administering the teachers’ sick leave bank, a list of newly hired teachers will be given to the GFT president and vice-president at the beginning of each semester. 2. All bargaining unit members who wish to join the Sick Leave Bank may do so by applying in writing to the Superintendent on or before September 30 of any school year. Sick Leave Bank. a. Upon When an employee exhausts all of his/her accumulated sick leave due to a serious illness or injury of the date of execution of this Agreementemployee and/or his/her immediate family and additional days are still needed, there then he/she may request through the WEA that the additional days be transferred from other bargaining unit members accumulated sick leave. If the request is approved by the Superintendent, he/she shall so advise the WEA President, in writing, who then shall notify the case bargaining unit members of those Colleges having previously so establishedthe donation opportunity. b) Teachers who have a balance of at least fifty (50) sick leave days may donate a maximum of two (2) sick days to a single applicant by submitting a signed sick leave donation form to the Treasurer. Sick Leave Bank. a. Upon The parties shall establish a sick leave bank to cover Employees starting the date second year of execution employment at Prospect Mountain High School in the event of this Agreement, there long-term illness. Thereafter, seven and one-half (7.5) hours [one (1) personal sick leave day] from each member's accumulated sick leave shall be assigned to the Bank unless a member notifies the President of the College or the President’s designee in writing within five (5) days of receipt of said notice that that member does not wish to remain a member; provided, however, that any member of the Sick Leave Bank wishing to remain a member thereof and who shall have exhausted that member’s personal sick leave accumulation on the date of the giving of such notice, shall assign such additional days within fifteen (15) days after the date on which such member is entitled to personal sick leave and shall retain all rights in the Bank until such period of assigning an additional day shall have expired. No unit member may draw upon the Sick Leave Bank in excess of the number of days to which that unit member is entitled as determined by the administration.
