Sick Leave Bank. A. Teachers on active duty in Xxxxxx County are eligible to contribute to a A voluntary sick leave bank. a. In the event that the number of accumulated days for periods in the bank at the beginning of personal illness, injury, or quarantine which a school year is of sufficient number that a contribution of one (1) sick leave day by all teachers who are not only prolonged but are also catastrophic and incapacitating and which are not likely to permanently disable the teacher. New current members of the bank would cause the maximum number of days specified hereinabove to be exceeded, the current year’s contribution by all such current members shall be suspended.
b. If the normal annual contribution is suspended as provided in Subsection 2(a) above and the bank is then depleted during the school year, the current year’s contribution shall be assessed at the time of such depletion.
c. A veteran teacher who is not a current member of the bank may become a member by contributing one (1) sick leave bank may not access the bank until a 60 school-day waiting period has been met.

b. Written certification will be provided from the teacher’s physician substantiating the illness and certifying that the absence will continue during a period of at least ten (10) consecutive days following the utilization and exhaustion of all said paid leave benefits as provided herein;
c. Written application must be made by or on behalf of the teacher no later than twelve (12) days after exhaustion of said paid leave benefits;
d. The teacher must have been absent for at least four (4) consecutive duty days after exhaustion of said paid leave benefits;
e. Upon resumption of employment after using days from the bank, said teacher shall be permitted to contribute repay the number of days owed to the bank upon approval (number of days borrowed minus number of days contributed) at the rate of two (2) sick leave days per year, even though such contribution would cause an accumulation of days in excess of the committee.
D. Annual rates of contribution maximum specified hereinabove, plus said teacher shall be a maximum of continue to contribute one (1) day per year as determined by provided hereinabove in Section 2.

Sick Leave Bank. A. Teachers on active duty 1. The Board has set up a bank to cover leave taken above that of eleven (11) days by the individual. The number of days in Xxxxxx County are eligible the bank is 1000 days annually. Employees who wish to contribute to a use sick leave bankbank days shall complete a written request within five (5) contract days from the initial absence. Contributors In extraordinary circumstances, the building administrator may submit the written request for sick leave bank days on behalf of the employee. The decision on use of sick leave bank days shall be made by a committee consisting of the Superintendent/designee, Assistant Superintendent for Human Resources, AEA President and Vice President. The decision will be permitted communicated to apply for leave the employee within 5 contract days of receipt of the request.
2. Days from the bank to cover regularly scheduled duty days for periods of personal may be used under the following conditions:
a. Physical illness, injury, or quarantine which condition of the individual licensed employee during the time the employee is hospitalized and/or under the care of a physician. A statement will be required from the physician recommending that the licensed employee be absent from work due to the condition of the employee’s health after a total of three days has been taken from the bank in a contract year.
b. Critical illness, disability, or death in one’s immediate family. The illness or disability shall require the family member to be hospitalized and/or under the care of a physician. A physician’s written verification may be required. Immediate family shall be defined as spouse, children, father, mother, father-in-law, mother-in-law, grandparents, brother or sister. In the event of death, a maximum of 3 days may be used.
3. Eligibility for use of days from the bank is determined by the following conditions:
a. All licensed employees are eligible for coverage under the following conditions.
i. The individual teacher must have contributed a total of 15 days of unused leave to be eligible (vested) to be covered the next school year. In order to save days, the teacher must request to bank the days as opposed to redeeming them for the daily substitute rate at the end of the year.
ii. The teacher is not eligible to be covered under the provisions of the leave bank until the beginning of the 3rd year and complying with (i) above.
iii. Teachers who have donated days to the bank but are not only prolonged but vested may use their donated days for reasons as specified in 2A & 2B. Notification of intent to use donated days shall be made by the employee within 5 days of usage. Used donated days will be deducted from the amount needed to be vested.
4. Coverage will remain in effect until the employee is eligible for coverage under KPERS disability; if leave is being used as defined in 2(b) above, a maximum of 100 days may be used over a ten year period once the employee is vested, which will reset every ten years. The calculation of maximum days and first decennial period will commence in the 2018-19 school year.
5. Biological parents may use sick leave bank days in the event of a child’s birth. The distribution of the bank days will follow these guidelines:
a. A maximum of six (6) calendar weeks for natural delivery and eight (8) calendar weeks for cesarean delivery may be used from the date of the child’s birth.
b. If both of the biological parents are also catastrophic employed in licensed positions in the district and incapacitating both are vested in the sick leave bank, the leave days may be taken by either employee, or shared between the two, up to a family maximum of six weeks for natural deliveries and which are up to a family maximum of eight weeks for cesarean deliveries. An individual’s leave days must be exhausted before he or she may use bank days. It is not likely to permanently disable required that both parents have used all of their individual leave before one of them accesses the teacherleave bank provided the one accessing the bank has exhausted his or her individual leave days.
6. New members Employees may use sick leave bank days in the event of a child adoption. The distribution of the sick leave bank may not access the bank until a 60 schooldays will follow these guidelines:
a. When adopting an infant (0-day waiting period has been met.
B. The contribution on the appropriate form will be authorized by the teacher and continued from year to year until canceled in writing by the member. It is not required that both parents have used all of their individual leave before one (1) day per year as determined by of them accesses the Association and certified leave bank provided the one accessing the bank has exhausted his or her individual leave days.
7. Employees who resign or otherwise terminate prior to the Superintendent prior to July 1 completion of each year.

Ten (10) Sick Leave Bank days may be provided to eligible members (those who have exhausted their own Sick Leave) for immediate family members in situations which are verified by medical documentation to be life-threatening. Examples of life threatening situations would include but are not limited to cancer, serious heart or brain conditions. Conditions that would not be considered life threatening would include childhood illnesses such as measles, mumps, chicken pox, or broken bones. Immediate family is defined as spouse, children, parent, and members of the required form immediate household with whom one has an association equivalent to family ties. The requesting teacher will submit medical documentation of the immediate family member’s condition and submitted need for care to the Sick Bank Committee and must obtain approval committeeas outlined above.

Sick Leave Bank. A. Teachers on active duty A bank of sick leave may be established at the discretion of the teachers with separate accounts for each bargaining unit/school in Xxxxxx County accordance with the terms and conditions set below:
7.3.6-1 The Sick Leave Bank (SLB) shall exist for the purpose of providing paid sick leave for participating teachers who have used all their own accumulated sick leave and are struck by serious illness, disability, or accident that prevents them from working. In extreme cases of hardship as determined by the Superintendent, he may grant SLB withdrawals for use in the case of a family member’s illness.
7.3.6-2 The SLB will be available to all members of the bargaining unit who contribute to it.
7.3.6-3 A teacher new to his district shall be eligible to contribute two sick days from his accumulation. Any sick days remaining in the bank at the end of the year shall remain in the bank. A teacher, during subsequent year(s), may voluntarily contribute additional days to a maximum of two days per teacher per year. Any teacher who has had the opportunity to contribute to the bank, but has not, or does not, shall be ineligible to receive SLB benefits. If the SLB is depleted during the contract year, teachers may voluntarily contribute days to re-establish the SLB. The Association shall provide the Superintendent with a detailed annual reconciliation of the SLB’s balance as of October 1 each year for the prior twelve months. The reconciliation will indicate the names of all participants, number of days deposited and withdrawn by each participant, and beginning and ending balances.
7.3.6-4 Any eligible teacher who has exhausted his sick leave bank. Contributors may make written application for withdrawal from said SLB, which will be permitted to apply administered by the Emergency Leave Committee of the Association. A teacher who is or may be disabled must make a timely application for leave from coverage under the bank to cover regularly scheduled duty days for periods Long Term Disability (LTD) plan. The Association will send a copy of personal illness, injury, or quarantine which are not only prolonged but are also catastrophic and incapacitating and which are not likely to permanently disable the teacher’s application for leave, as well as information regarding the number of sick leave bank days awarded to the teacher, to the Superintendent at the time its decision is made. New members of The parties agree that no teacher determined to be eligible for coverage under the LTD Plan may receive more donated days from the sick leave bank may not access than are necessary to meet the bank until a 60 school60-day waiting elimination period has been metfor eligibility in the LTD plan. The Association and the Superintendent agree to maintain open communications regarding the administration of the sick bank.
B. Sick Leave Bank. A. Teachers on active duty in Xxxxxx County are eligible to contribute to a sick leave bank. Contributors will be permitted to apply for leave from the bank to cover regularly scheduled duty days for periods of personal illness, injury, or quarantine which are not only prolonged but are also catastrophic and incapacitating and which are not likely to permanently disable the teacher. New members The purpose of the sick leave bank is to provide potential additional sick time for members who, because of serious prolonged illness or unexpected necessary medical care have (or will as a result of their medical condition) exhausted their accumulated sick leave. The intent of the sick leave bank is not for use of common colds, flu, or elective surgery. Similarly, sick leave bank days will not be used for maternity leave, barring extenuating medical complications. The bank will be administered by a committee composed of two representatives from Management and two representatives designated by MSEA. A majority vote of the committee shall be required for any days to be granted. The committee shall report to the School Board, the Association and the employees annually, indicating the use of the sick leave bank. The committee may not access submit recommendations for modification to the operation of the sick leave bank to the School Board and the Association. If the recommendations are ratified by the Board and the Association, the recommendations shall be implemented. In order to participate in the sick bank one must be covered by a collective bargaining agreement or be a confidential employee. Participation is voluntary; however, one must initially donate eight (8) hours of sick leave to the bank to join. Open enrollment is from September 1st to October 1st of each year. New hires can join the bank within 30 days of becoming eligible to earn sick time. Employees will continue to donate on a rotating basis, alphabetically, until the bank is built up to a 60 school-day waiting period has been met.

However, the bank can exceed the maximum accrual in order to accommodate each qualified employee that wants to be a member of the sick leave bank. If the bank stays at the maximum there will be no need to replenish the bank. If it drops below the minimum it will need to be replenished. It will be replenished in the same manner in which it was established starting with the next person on the appropriate form will be authorized by the teacher and continued alphabetical list. Sick Leave Bank. A. Teachers on active duty 1. The Board shall establish a Sick Leave Bank in Xxxxxx County which full-time teachers are eligible to contribute participate on a voluntary basis.
2. The intent of this plan is to a provide extended sick leave bankto those participants who incur a catastrophic illness or disability which necessitates prolonged continuous absence from work. Contributors The Bank shall be used only for the catastrophic personal illness of the participant, or his/her spouse or children, and not for illness, disability or death of any other person.
3. A full-time teacher may enroll in the Bank by signing an authorization form agreeing to contribute one (1) day of his/her sick leave to the Bank at the beginning of each year. When the total number of days in the Bank equals twice the number of participants, no yearly contribution will be permitted required until such time that the Bank is depleted to apply for leave the number of days equal to the number of participants.
4. Sick Leave Bank. A. Teachers 23-1 The Board will cooperate in the continuance of a Sick Leave Bank on active duty in Xxxxxx County are a voluntary basis. 23-6 Any remainder of the teacher’s accumulated cumulative leave days will be the teacher’s new balance.
23-7 A maximum of 60 days each school year can be drawn by a teacher from the Bank in addition to the teacher’s own accumulated days, if any.
23-8 A teacher who withdraws cumulative leave days from the Bank will not be required to replace such days except as a regular contributing member to the Bank.
23-9 Cumulative leave days can only be withdrawn from the Bank for an individual teacher’s illness.
23-10 Request for use of Bank days must be accompanied by a letter from the attending physician certifying that the teacher is unable to fulfill the teacher’s contractual obligations and explaining the medical reasons therefore.
23-11 Any variances from this Article shall be from July 1 to October 31by the Sick Leave Bank Committee. Sick Leave Bank. A. Teachers on active duty in Xxxxxx County are eligible to contribute to a sick leave bank. New members The purpose of the sick leave bank is to provide potential additional sick time for members who, because of serious prolonged illness or unexpected necessary medical care have (or will as a result of their medical condition) exhausted their accumulated sick leave. The intent of the sick leave bank is not for use of common colds, flu, or elective surgery. Similarly, sick leave bank days will not be used for maternity leave, barring extenuating medical complications. The bank will be administered by a committee composed of two representatives from Management and two representatives designated by MSEA. A majority vote of the committee shall be required for any days to be granted. The committee shall report to the School Board, the Association and the employees annually, indicating the use of the sick leave bank. The committee may not access submit recommendations for modification to the operation of the sick leave bank to the School Board and the Association. If the recommendations are ratified by the Board and the Association, the recommendations shall be implemented. D. Upon compliance with Section C above, the Superintendent prior to July 1 Sick Leave Bank Committee may issue a grant of days from the Sick Leave Bank of no more than one hundred (100) days total but in increments of no more than 35 days. After a grant of or use of 100 days from the sick leave bank, a teacher may not draw from the bank again until five years have passed from the end of the first 100 days granted. A teacher may not draw on the bank more than twice (that is, two periods of 100 days, each yearfive years apart.)
E. The maximum Sick Leave Bank shall have a minimum of 200 days in reserve. If the number of day falls below 200, then Section A shall be reapplied. However, the total number of sick leave bank days that can in reserve shall not exceed 600 unless it is the result of adding days contributed by new members. The Association shall provide the Superintendent with an annual sick Bank Report by August 31 of each year detailing the beginning balance of the sick bank, additions to the sick bank, deductions from the sick bank, and ending balance of the sick bank as of June 30 each year. HCEA and the Superintendent/Designee will provide each other quarterly sick bank reports on the days and hours granted and used for accounting and compliance purposes only.

Sick Leave Bank. A. Teachers on active duty in Xxxxxx County are eligible to contribute to a sick leave bank. Contributors will be permitted to apply for leave from the bank to cover regularly scheduled duty days for periods of personal illness, injury, or quarantine which are not only prolonged but are also catastrophic and incapacitating and which are not likely to permanently disable the teacher. New members The purpose of the sick leave bank is to provide potential additional sick time for members who, because of serious prolonged illness or unexpected necessary medical care have (or will as a result of their medical condition) exhausted their accumulated sick leave. The intent of the sick leave bank is not for use of common colds, flu, or elective surgery. Similarly, sick leave bank days will not be used for maternity leave, barring extenuating medical complications. The bank will be administered by a committee composed of two representatives from Management and two representatives designated by MSEA. A majority vote of the committee shall be required for any days to be granted. The committee shall report to the School Board, the Association and the employees annually, indicating the use of the sick leave bank. The committee may not access submit recommendations for modification to the operation of the sick leave bank to the School Board and the Association. If the recommendations are ratified by the Board and the Association, the recommendations shall be implemented. In order to participate in the sick bank one must be covered by a collective bargaining agreement or be a confidential employee. Participation is voluntary; however, one must initially donate seven (7) hours of sick leave to the bank to join. Open enrollment is from September 1st to October 1st of each year. New hires can join the bank within 30 days of becoming eligible to earn sick time. Employees will continue to donate on a rotating basis, alphabetically, until the bank is built up to a 60 school-day waiting period has been met.

However, the bank can exceed the maximum accrual in order to accommodate each qualified employee that wants to be a member of the sick leave bank. If the bank stays at the maximum there will be no need to replenish the bank. If it drops below the minimum it will need to be replenished. It will be replenished in the same manner in which it was established starting with the next person on the appropriate form will be authorized by the teacher and continued alphabetical list. Sick Leave Bank. A. Teachers on active duty in Xxxxxx County Effective with the 1992-1993 school year, a Sick Leave Bank shall exists as follows: The purpose of the Sick Leave Bank is to provide paid days for serious personal illness or family illness to contributors to the Bank who have exhausted their accumulated sick days and who are eligible to contribute to a sick leave bankexperiencing prolonged personal or family illness. Catastrophic injury, terminal diagnosis or illness is defined as a life-threatening condition or combination of conditions affecting the mental or physical health of the employee, and includes, but is not limited to, the following: lengthy hospitalizations, necessary surgery requiring a lengthy recovery, an ongoing treatment regimen requiring frequent time off work, or complicated pregnancy requiring bed rest or hospitalization. The catastrophic illness or injury must use require the services of a health provider. This benefit is available to eligible, voluntarily participating faculty and staff who have legitimately exhausted all of their accumulated sick and vacation leave.

Sick Leave Bank. A. Teachers on active duty in Xxxxxx County are eligible The District and the Association shall administer a Sick Leave Bank to contribute to be used when a unit member has incurred a prolonged illness or injury and whose sick leave accumulation has been exhausted. A committee consisting of two (2) administrators (the Superintendent and the School Business Manager) and two (2) teachers (appointed by the Association) shall review all sick bank requests. The granting of requests shall be contingent upon the approval of at least three (3) of the committee members. Sick Leave Bank. The following shall be effective upon the date the parties ratify this Agreement:
A. Teachers on active duty Any teacher covered under the terms of this Agreement who meets the eligibility requirements shall be permitted to elect to participate in Xxxxxx County are eligible to contribute to a sick leave bank. Each withdrawal shall be not less than five (5) school days or more than twenty (20) school days each year. The sick leave bank committee may consider additional requests in the event of accumulated personal a catastrophic illness.
F. Two (2) members of the Association as appointed by the President and two (2) individuals appointed by the Superintendent will act as a sick leave before bank committee in all matters that concern the policies and decisions of the sick leave bank. The sick leave bank committee shall write its own regulations of operation covering procedures to review all requests and make such regulations available to all members of the bank, Administration, and Board.
G. Any member who is receiving leave benefits from the Teachers' Retirement System, is absent for illness or injury due to a work related accident (which is compensable under the Illinois Workers' Compensation Act), may not avail himself/herself of any benefits of the bank. Sick Leave Bank. A. Teachers on active duty A sick leave bank will be established and is expressly intended to be used by any teacher who is incapable of performing his/her duties due to accident or serious illness after he/she has used his/her personally accumulated sick leave. a. The teacher must fulfill an elimination period of 30 workdays per qualifying event. This means a person has to have been out at least 30 consecutive sick days. The teacher must also incur 5 unpaid workdays to access the Sick Leave Bank. The unpaid days may occur during the elimination period.
b. Within the same school year, subsequent elimination periods will not be required to be fulfilled if for the same initial qualifying event as substantiated by a physician’s statement.
c. His/her own accumulated and accrued sick leave has been totally depleted. If additional sick days that can be granted are earned due to a break such as summer vacation, the teacher must again deplete these days before continuing in any one fiscal year will be the remaining number of duty days a teacher is scheduled to work. The Sick Leave Bank Committee shall determine the eligibility for the use of the Bank and the amount of leave to be granted and has discretionary authority to review and grant individual requests according to the provisions of this contract. The following criteria shall be used by the Sick Leave Bank Committee in administering the Bank and determining eligibility and amount of leave:

Sick Leave Bank. A. Teachers on active duty in Xxxxxx County 1. The Sick Leave Bank (“SLB”) has been established for the direct benefit of the employees. The bank of sick days is generated by a voluntary contribution of one sick leave day per year. Once a Professional Employee has contributed a total of three sick leave days then he or she is vested and is not required to contribute additional days unless the bank were to be reduced to nothing.
2. Participating Professional Employees who are vested or who have contributed to the SLB for the SY during which the request is made and who have exhausted their chargeable sick leave are eligible to contribute borrow days from the SLB.
3. Participating Professional Employees may borrow from the SLB:
a. to cover absences due to personal illness;
b. to cover absences due to illness of or injury to a member of his or her immediate family (spouse, dependent child, parent or sibling);
c. to cover absences due to the birth or adoption of a child; or
d. to cover absences due to a catastrophic emergency, such as a fire or flood.
4. A maximum of fifteen (15) days may be borrowed, except as follows: any Professional Employee who qualifies for leave under the Family and Medical Leave Act (“FMLA”) for the birth or adoption of a child may borrow up to 10 days from the Sick Leave Bank for the purpose of parental bonding.
5. If the Professional Employee qualifies for FMLA leave, all days borrowed from the SLB must be used concurrently with his or her FMLA leave.
6. Request for days from the SLB must be submitted in writing through the building administrator to the Sick Leave Bank Oversight Committee. The request must consist of sufficient documentation to substantiate the claim. All information will be in confidence and only disclosed on a need to know basis to those involved in the process.

B. Within 15 days following the execution of this Agreement, or annually, between the dates of August 15 and August 31, inclusively, each member of the bargaining unit may contribute between 1 and up to 12 of th leave days to a common bank. Newly hired members of the bargaining unit may contribute to a sick leave bank. Contributors will be permitted to apply for leave from the bank to cover regularly scheduled duty days for periods of personal illness, injury, or quarantine which are not only prolonged but are also catastrophic and incapacitating and which are not likely to permanently disable the teacher. New members of the sick leave bank may not access within 3 days after the first day of actual service with the District. Such contributions are irrevocable. Only members of the bargaining unit who have contributed days to the bank may apply for days from the bank. The value of the day donated will be equal to the FTE of the employee donating the day both upon contribution and upon withdrawal pursuant to this Article. Should the sick leave bank become exhausted, additional days will not be added until a 60 school-day waiting the new annual window period has been metin August. All days left in the bank at the end of the year shall be carried over to the next year.

F. The District will keep accurate records of sick leave accumulated by the bank and of sick leave used by members of the bank. The District will notify the Association on an annual basis of the accumulated days and the number of days charged to the bank for that last year.
