Sick Leave Bank. The Employer agrees to establish a sick leave bank to cover employee/s in the event of long term illness. Sick Leave Bank. The Employer agrees to To establish a bank of sick leave days donated by CCCC employees in order to provide a benefit to employees who have suffered a catastrophic injury or illness and who do not have sufficient sick leave days, the following applies:
a. Catastrophic injury or illness is defined as a severe condition or combination of conditions affecting the mental or physical health of the employee. Such illness or injury must be severe enough in nature to force the employee to exhaust all sick leave time earned by the employee and to, therefore, potentially lost compensation.
b. Catastrophic illness or injury must require the services of a licensed doctor of medicine who is authorized to practice medicine or surgery, as appropriate by the state in which the doctor practices.
c. All applications for sick leave bank time must be accompanied by a licensed physician’s statement which states the beginning date of the condition, a description of the illness or injury, and the anticipated date the employee will be able to cover employeereturn to work.
d. Prior to granting sick leave from the bank, the applicant must have utilized all of his/s in her accumulated sick leave.
e. An employee may donate, on a voluntary basis, to the event of long term illness. The sick leave bank shall be administered by a committee composed maximum of five (5) members days on or before August 20, each year.
f. Once sick leave has been donated to the sick leave bank, it cannot be restored to the individual.
g. Employees may not designate a particular employee to receive their donated time.
h. Employees who use sick leave days from the bank are not required to pay them back.
i. Full-time employees, including those employees who have contributed to the bank and who have been employed by CCCC for more than six (6) months, may apply for sick leave bank days.

d. Satisfying such other criteria as may be established by the joint committee and shall be supplied which includes an evaluation of the employee’s past sick leave usage record.
3. Any employee who contributed one day to the EmployerSick Leave Bank shall not be charged a sick leave day for the purpose of sick leave conversion. The day will be drawn from the prior year’s accumulated sick leave, except in the event that the employee has no sick leave, in which case that day will be drawn from the current year.
4. New employees must join the Sick Leave Bank within the first thirty (30) days of their employment or lose their right to do so. Any rules established employee covered by this Agreement may join the committee shall include Sick Leave Bank within 30 days of the following:ratification of this Agreement or lose their right to do so.

Sick Leave Bank. The Employer agrees to establish a sick leave bank to cover employee/s District Central Bank:
1. A District Central Bank shall be created effective the first day the employee works in the event current school year. The District Central Bank total shall be allowed to be used as needed, without any further employee contribution of long days, until the accumulated total reaches three thousand (3,000). Each member shall automatically have one day deducted from his/her accumulated total when the accumulated total drops below three thousand (3,000). When the District Central Bank drops below three thousand (3,000) days, each member will be allowed eleven (11) days. The employee will place one (1) of his/her days at the disposal of the District’s Central Bank.
2. The District Central Bank is intended to provide each teacher with comprehensive protection from financial burdens imposed by prolonged disability, long-term illness, disability accident or the same chronic recurring illnesses. The In order to be eligible to draw from the sick leave bank shall bank, the following criteria must be administered by a committee composed of five (5) members of the Union appointed by the Union President. Rules satisfied:
a. A teacher employed for membership and participation in more than two years may not draw from the sick leave bank until after the fifteenth (15) day of absence as a result of the same illness or disability, other than those listed in G.2. above when the fifteen (15) day absence has already been met.
b. No teacher may draw from the sick bank until he or she has exhausted all but two of their accumulated sick days.
c. No teacher may draw from the sick bank while on a leave of absence without pay or while drawing workers’ compensation or while drawing long term disability provided in Article XV, Section A.
d. A teacher shall not be established by eligible to draw more than ninety (90) workdays’ pay from the committee and shall be supplied to the Employer. Any rules established by the committee shall include the following:
(A) The sick leave bank without reapplication to the sick bank for individual consideration.
e. Applications for long-term disability under Article XV, Section A, must be made as soon as the teacher is reasonably aware that the policy may be applicable to his/her situation. All teachers drawing from the sick leave bank must apply for long-term disability and must take long-term disability in lieu of sick bank benefits as soon as they are eligible to do so. Consideration should be given for additional sick bank days (to the ninety [90] sick bank day limit) when an employee returns from LTD. Salary received from the District will be returned if LTD benefits are approved for the same days.
f. First and second year teachers may use sick bank benefits without regard to 2-a above.
3. The District Central Bank Committee shall be funded by bargaining unit members at the start composed of each school year to reach a maximum two four (24) times the members, an equal number of staff representatives of the Association and the administration. All approvals of the Committee shall be by a majority of the members. The criteria for such approvals shall be set and published by the District Central Bank Committee. This shall not apply while a person is drawing workers’ compensation award.
4. Unused leave days credited to the sick bank shall carry over to the following school year.
5. Prolonged disability shall be defined as four (4) consecutive weeks with a physician’s statement attesting to the incapacity to work. The Board reserves the right to require a second opinion from the Board’s physician at the Board’s cost. Childcare, as differentiated from disability due to childbirth, shall not be covered by sick leave or the sick bank provisions.
6. It is expressly understood that the provisions of the sick leave bank are only for the personal illness of the teacher and shall not apply for family care, childcare, or illnesses of the immediate family. Under extenuating circumstances a teacher may be supplied with additional days whenever the number of days drops below fifty (50) to bring it up apply to the maximum.

The sick leave bank Employees shall be administered by a committee composed of five (5) members of the Union appointed by the Union President. Rules for membership and participation eligible to participate in the sick leave bank established for teachers in accordance with the program guidelines outlined in the Teacher’s Agreement. One paraprofessional, one employee who had been in Unit II prior to July 1, 2010, one employee who had been in Unit IV prior to July 1, 2010, and one employee who had been unaffiliated prior to July 1, 2010 shall be added to the Sick Leave Bank Committee established in the Teacher Agreement. Effective July 1, 1980, membership in the bank was voluntary for all employees. Thereafter, all new employees who request membership will be assessed one day of sick leave for deposit in the bank. Employees who had been assessed one day of sick leave to participate in a sick leave bank for another bargaining unit shall have their sick leave day transferred to the sick leave bank established under this Agreement.
2. A member of the bargaining unit may participate in the bank only after:
a. Filing application with the Sick Leave Bank Committee;
b. Submitting satisfactory medical evidence of the illness;
c. Submitting evidence of having exhausted all accumulated leave;
d. Satisfying such other criteria as may be established by the joint committee and shall be supplied which includes an evaluation of the employee’s past sick leave usage record.
3. Any employee who contributed one day to the EmployerSick Leave Bank shall not be charged a sick leave day for the purpose of sick leave conversion. The day will be drawn from the prior year’s accumulated sick leave, except in the event that the employee has no sick leave, in which case that day will be drawn from the current year.
4. New employees must join the Sick Leave Bank within the first thirty (30) days of their employment or lose their right to do so. Any rules established employee covered by this Agreement may join the committee shall include Sick Leave Bank within 30 days of the following:ratification of this Agreement or lose their right to do so.

(F) No one shall, under any circumstances, be entitled to receive sick leave and disability benefits at the same time.

Sick Leave Bank. The Employer agrees (a) Each fulltime employee who holds an appointment of one (1) year or longer or a continuing part-time employee having a workload of fifty (50%) percent or more, shall, on April 1 of each year, donate either one-half day's sick leave or one entire day’s sick leave from the employee’s sick leave entitlement to establish a sick leave bank to cover employee/s bank, as required, so that there is in the event bank a number of long term illnessdays equal to approximately three times the number of such fulltime employees, as determined on that date.
(b) Only those employees as described in (a) are entitled to draw from the bank.

(d) An employee who exhausts their sick leave allotment and accumulation shall be entitled to additional days of sick leave only for those days of absence for which a qualified medical practitioner testifies that the employee was unable to attend to the employee’s duties at the College.
(e) All requests for additional sick leave must be submitted in writing. The medical certificate will be submitted to Human Resources which shall determine if the absence is medically supported and the anticipated duration. The request for additional sick leave bank shall be administered by a committee composed of five (5) members of the Union appointed by the Union President. Sick Leave Bank. A. The Employer Appointing Authority agrees to establish a Sick Leave Bank to be used by employees that have completed his or her probationary period in case of catastrophic illness or injury to the employee. The sick days in the bank shall be contributed by members of the Unit during an established annual open enrollment period not to exceed 30 days. The Union must provide to the University, within 30 days following the end of the open enrollment period, a list of members eligible for the sick leave bank bank, the donation amount of each employee (a minimum of one sick day donation is required), as well as an authorization from each member to cover employee/s in deduct at least one sick day from the event of long term illnessmembers sick leave balance. The sick leave bank shall not be administered unless the above information is timely submitted to the University.
B. Employees must use all paid personal, compensatory and sick leave and all but 5 days of vacation leave before applying to draw on the Sick Leave Bank. Sick Leave Bank. 1. Certified employees may choose to participate annually in the Emergency Leave Bank by contributing one (1) day of available sick or personal leave to the Bank. The Employer agrees employee shall notify the Central Office during the Section 125 open enrollment period of their decision to establish a sick participate in the Emergency Leave Bank. New certified employees contracted after the enrollment period may enter into the Emergency Leave Bank during the time of their Section 125 enrollment.

(C) No one may contribute more than two three (23) days in any school year. If a participating employee does not have sufficient number of accrued sick leave days to contribute, his/her participation in the bank shall be restricted until such time that he/she can make the required contribution.
C. After a participating employee's accumulated sick leave has been exhausted, he/she shall be eligible to draw in ten (10) day increments, from the sick leave bank, for any one (1) illness, injury, accident, or complication thereof. A maximum of sixty (60) sick leave days per year can be utilized. In the event that the employee does not use all sick leave drawn from the bank, such days shall be returned to the bank.
D. Each application shall be accompanied by a physician's statement. Photo static copies of the doctor's statement will not be accepted. The committee reserves the right to ask for a second opinion. Sick leave bank days may not be used for maternity except in the case of major complications.
E. Extension applications for an initial illness, accident, injury, or complication thereof will be submitted within seven (7) days of the beginning date of the original or previous application.
F. Any participating employee withdrawing sick leave days shall not be required to replace those days except as a regular contributing member to the sick leave bank; and that any days contributed shall be deducted from that year's sick leave entitlement for the person making said contribution. Bargaining unit members must have ten (10) days of accrued sick leave on file with the employer prior to donating to the Sick Leave Bank.
(D) The Union shall notify the Employer by September 15th of each year of the individuals who have donated days to the sick leave bank so that said days may be deducted from the individual's yearly entitlement.

Sick Leave Bank. (a) A Sick Leave Bank is established, effective February 13, 2006, for use by a participating member whose sick leave is exhausted through prolonged illness. A prolonged illness shall be one which has caused absence of more than thirty (30) consecutive work days. Vacation, personal, and all sick leave days must be used by the participating member before being eligible to draw upon the sick leave bank. The Employer agrees member is responsible for obtaining the required documentation and submitting it in a timely manner.
(b) To be eligible for sick leave bank, the applicant must have been a member of the bargaining unit for at least one (1) year prior to establish a the date of the application and have contributed to the sick leave bank by July 15 of that fiscal year. Employees may elect each fiscal year to participate by contributing one (1) day or more days by July 15th, effective July 1, 2017. Forms for this purpose will be distributed to the members by the Human Resources Department. (Initial establishment of the bank will be made by the voluntary contribution of one (1) day per member of the bargaining unit by March 13, 2006.
(c) A doctor’s certificate shall be required in each instance that an applicant seeks access to the sick leave bank, including application for extended benefits.
(d) The initial grant of days from the sick leave bank will cover employee/s up to twenty (20) working days for any prolonged illness. Consideration will be given for additional days beyond the twenty (20) in the event that the prolonged illness continues. In no instance shall more than one additional grant be made to an individual in a year from the date of long term illnessthat application, or shall that additional grant, coupled with the initial grant, exceed forty (40) days for that individual. If the sick leave bank is exhausted, it shall be replenished by the contribution of one additional day of sick leave by each participating member.
(e) The sick leave bank shall be governed and distributed by a committee consisting of the Town Manager, the Department Head, Human Resources Direct and two (2) union members. In the event the Department Head is the employee requesting sick bank time, another Department Head will substitute in their place on the sick leave bank committee. A majority vote of the committee members will be required for sick leave days to be granted. The sick leave bank shall be administered by the Human Resources Department.
(f) The decision of the sick leave bank committee with respect to eligibility and entitlement shall be final and binding and not subject to appeal through the contractual grievance and arbitration procedure or through any other judicial or administrative procedure. Previous attendance records and performance evaluation will be considered.
(g) No days may be withdrawn from the sick leave bank for use other than for a committee composed prolonged illness of the union member. Days may not be withdrawn to permit the individual to be absent to care for other members of the applicant’s family.
(h) Application for benefits shall be in writing and shall consist of a letter to the department head accompanied by a written doctor’s certificate describing the nature of the illness and providing an estimate of when the employee will be able to return to work. The department head will forward the request to the Human Resources Director and the Unit President within five (5) members working days of the Union appointed by the Union President. Rules for membership receiving it and participation in the sick leave bank shall be established by the committee and shall be supplied to the Employer. Any rules established by the committee shall include the following:
(A) The sick leave bank shall be funded by bargaining unit members at the start of each school year to reach a maximum two (2) times the number of staff members. The sick leave bank may be supplied with additional days whenever the number of days drops below fifty (50) to bring it up to the maximum.
(B) Unused sick leave days in the bank at the close of the school year will carry over into subsequent years up to a unit of two (2) times the number of staff.
(C) No one may contribute more than two (2) days in any school year to the sick leave bank; and that any days contributed shall be deducted from that year's sick leave entitlement for the person making said contribution. Sick Leave Bank. 1. The Employer agrees SAC (Staff Administrative Communications) committee will function as the Sick Leave Bank Committee. The committee will meet to review requests and grant days as they are requested. The SAC committee’s ruling shall not be grievable or appealable.
2. The Chairperson of the SAC shall solicit (on or about July 1 of each year) the donation of unused sick leave days from members to establish and maintain a sick leave bank bank. Each member may donate up to cover employee/s a total of three days annually. d. When the number of days in the Sick Leave Bank falls below three hundred (300), each employee who wishes to remain in the Bank must contribute one (1) additional day to maintain coverage.
e. Members shall receive written notification prior to additional required contributions. Members of the Sick Leave Bank may withdraw from coverage by so requesting in writing to the Sick Leave Committee (“the Committee”). Eligible employees not in the Sick Leave Bank may also join at this time.
f. The Sick Leave Bank Committee shall be composed of three (3) Association members and the Superintendent of Schools or his/her designee. The Association Committee members shall be affiliated in good standing with the Sick Leave Bank and shall be approved by the appointed SPEA Executive Committee.
3. The sick days to be awarded from this bank to cover employee/s will apply only in cases where all of the individual’s accumulated sick leave has been exhausted. Employees who receive days from the Sick Leave Bank shall be compensated at their regular daily rate of pay.
4. In the event of long term illness. The an employee’s separation from employment, including but not limited to: reduction in force, retirement, termination or other event, accumulated sick leave bank previously donated to the Bank shall not be administered by compensated, but shall remain credited to the Bank.
5. Upon an employee’s separation from employment, including but not limited to: reduction in force, retirement, termination or other event, an employee may elect to donate his or her accumulated sick days to the Bank, up to a committee composed maximum of five (5) members days for each year of service. The employee shall not be compensated for days donated to the Bank in this manner.
6. Donations to the Sick Leave Bank will not affect “perfect attendance” as defined by contract language.

Sick Leave Bank. The Employer agrees to To establish a bank of sick leave days donated by CCCC employees in order to provide a benefit to employees who have suffered a catastrophic injury or illness and who do not have sufficient sick leave days, the following applies:
a. Catastrophic injury or illness is defined as a severe condition or combination of conditions affecting the mental or physical health of the employee. f. Once sick leave has been donated to the sick leave bank, it cannot be restored to the individual.
g. Employees may not designate a particular employee to receive their donated time.

The applications shall be accompanied by a note from the attending physician, which clearly confirms the illness and the expected recovery period. The committee may demand a second evaluation by another physician before determining the status of the application. The Committee shall be responsible for authenticating the claim of illness or injury as well as ascertaining the eligibility of the teacher to draw on the bank. They shall make recommendations to the Board of Education regarding sick bank applications. The decision of the Board of Education shall be final and not subject to the grievance procedure. Neither the employees nor the Association shall hold the Board or its officials and employees, including but not limited to the Superintendent and the other members of the sick leave days in bank committee, liable for any decisions made by the bank at committee. Sick Leave Bank. The sick leave bank committee shall consist of two representatives from each building, the CCEA president and CCEA secretary. The building representatives shall be administered by a committee composed of five (5) members of the Union appointed by the Union PresidentCCEA president each school year. Rules for membership The Administrative Committee will notify District administration of days withdrawn from the Bank and participation to whom the days are granted Each bargaining unit member wishing to participate in the sick leave bank shall be established by the committee and shall be supplied Bank agrees to the Employer. (A) The sick leave bank shall be funded by bargaining unit members at the start of each school year to reach a maximum donate two (2) times sick leave days accrued in a one year period to be deposited in said Bank, such days to be deducted from the number of staff membersbargaining unit member’s annual sick leave. Bargaining unit members may enroll as soon as they have two sick leave days to contribute. The sick leave month of October of each year shall be a new enrollment period. The Administrative Committee shall inform the Superintendent in writing of the members wishing to participate by November 1 of that year. Sick days in the Bank shall accrue from year to year to a maximum of one hundred (100) days after which additional donations shall not be required until the bank may be supplied with additional days whenever the number of days drops below fifty (50) days. A bargaining unit member shall become eligible to bring it up request benefits from the Bank after exhausting all personal and sick leave days. Approval of such requests shall be made at the discretion of the Administrative Committee. The Association shall indemnify, defend, and hold harmless the Board and all of its agents and employees against any and from all claims, demands, suits, legal costs or other forms of asserted damage or liability (monetary or otherwise) arising out of or relating in any way to the maximum.

(F) No one shall, under any circumstances, be entitled to receive sick leave and disability benefits at the same time.
(G) New employees are not eligible for sick bank participation prior to January 1st if they are hired before the first day of school and for 120 calendar days after employment if hired after the first day of school.

Sick Leave Bank. The Employer agrees to establish a sick leave bank to cover employee/s in the event of long term illness. The sick leave bank shall will be administered by a committee composed established in July 1995. The purpose of five (5) members said sick leave bank will be to offer financial protection for those employees who suffer serious and long-term illness or injury. 4. The intent of this plan is to provide extended sick leave, as limited by the Sick Leave Bank provisions, to Sick Leave Bank members who, by reason of personal illness or disability, exceed their available sick leave days.
5. An employee withdrawing from membership in the bank will not be able to withdraw the contributed days.
6. A member who has contributed will not be able to withdraw from the bank until after the member’s own accrued sick leave days have been depleted and a two- (2) day deduction period has transpired for each year extended illness. Should a single extended illness exceed ten (10) days, the deduction will not apply. A physician’s written verification will be necessary and will exclude the two- (2) day deduction. The member will have a five- (5) day deduction from pay only if the member decides not to return to active employment with the District at the end of an extended illness. Persons on disability are not covered by this Section.
7. A member is entitled to a lifetime maximum of ninety (90) days from the Sick Leave Bank; however, grants for days are limited to twenty (20) work days per request, and the initial request and any subsequent request must be verified, in writing, by the member’s physician.
8. The SEEO may request that contributing members donate an additional day to the Sick Leave Bank at the beginning of the individuals school year should the number of days in the bank drop below three hundred (300) at the end of the prior school year.
9. Employees withdrawing sick leave days from the bank will not have to replace these days except as a regular, yearly contributing member of the bank.
10. When necessary, a representative from the SEEO will communicate to the Assistant Superintendent of Human Resources/ designee for the purpose of providing current information about use of the Sick Leave Bank.
11. Employees who have donated days to the sick leave bank so that said days may be deducted from the individual's yearly entitlement.
(E) Individuals may not elect to receive sick leave benefits in lieu of disability benefits. Eligibility for sick leave bank benefits shall terminate when an individual is eligible for disability benefits.
(F) No one shall, under any circumstances, be entitled to receive exhausted their accumulated sick leave and have a permanent or temporary disability can apply for disability benefits at from the same timeIllinois Municipal Retirement Fund (IMRF) if the IMRF qualifications are met.

Sick Leave Bank. The Employer agrees to establish a 16.1 A Sick Leave Bank will be established for use by members of Bargaining Units A, B, C, Custodians and Administrative Assistants who have exhausted their own accrued sick leave bank and have a prolonged and/or serious illness or injury. 1. A District Central Bank shall be created effective the first day the employee works in the event current school year. The District Central Bank total shall be allowed to be used as needed, without any further employee contribution of long days, until the accumulated total reaches three thousand (3,000). Each member shall automatically have one day deducted from his/her accumulated total when the accumulated total drops below three thousand (3,000). 2. The District Central Bank is intended to provide each teacher with comprehensive protection from financial burdens imposed by prolonged disability, long-term illness, disability accident or the same chronic recurring illnesses. The In order to be eligible to draw from the sick leave bank shall bank, the following criteria must be administered by a committee composed of five (5) members of the Union appointed by the Union President. a. A teacher employed for membership and participation in more than two years may not draw from the sick leave bank until after the fifteenth (15) day of absence as a result of the same illness or disability, other than those listed in G.2. above when the fifteen (15) day absence has already been met.
b. No teacher may draw from the sick bank until he or she has exhausted all but two of their accumulated sick days.
c. No teacher may draw from the sick bank while on a leave of absence without pay or while drawing workers’ compensation or while drawing long term disability provided in Article XV, Section A.
d. A teacher shall not be established by eligible to draw more than ninety (90) workdays’ pay from the committee and shall be supplied to the Employer. Any rules established by the committee shall include the following:
(A) The sick leave bank without reapplication to the sick bank for individual consideration.
e. Applications for long-term disability under Article XV, Section A, must be made as soon as the teacher is reasonably aware that the policy may be applicable to his/her situation. All teachers drawing from the sick leave bank must apply for long-term disability and must take long-term disability in lieu of sick bank benefits as soon as they are eligible to do so. Consideration should be given for additional sick bank days (to the ninety [90] sick bank day limit) when an employee returns from LTD. Salary received from the District will be returned if LTD benefits are approved for the same days.
f. First and second year teachers may use sick bank benefits without regard to 2-a above.
3. The District Central Bank Committee shall be funded by bargaining unit members at the start composed of each school year to reach a maximum two four (24) times the members, an equal number of staff representatives of the Association and the administration. All approvals of the Committee shall be by a majority of the members. The criteria for such approvals shall be set and published by the District Central Bank Committee. This shall not apply while a person is drawing workers’ compensation award.
4. Unused leave days credited to the sick bank shall carry over to the following school year.
5. Prolonged disability shall be defined as four (4) consecutive weeks with a physician’s statement attesting to the incapacity to work. The Board reserves the right to require a second opinion from the Board’s physician at the Board’s cost. Childcare, as differentiated from disability due to childbirth, shall not be covered by sick leave or the sick bank provisions.
6. It is expressly understood that the provisions of the sick leave bank are only for the personal illness of the teacher and shall not apply for family care, childcare, or illnesses of the immediate family. Under extenuating circumstances, a teacher may be supplied with additional days whenever the number of days drops below fifty (50) to bring it up apply to the maximum.
(B) Unused sick leave days in the bank at the close of the school year will carry over into subsequent years for up to a unit maximum of two (2) times the number of staff.

Employees, who have not repaid the days borrowed from the sick leave bank and are requesting to terminate their membership in the bank, shall be obligated to repay those days at the rate of five (5) days per school year until all days borrowed are repaid. In the event of long term illnessthe death of an employee, the estate will not be required to repay the sick days.
X. Xxxxxxxxx, who elect to become members of the sick leave bank, borrow days from the bank and terminate their employment with the Chelsea School District before all days borrowed from the bank are repaid, shall have their per diem pay withheld from their remaining payroll entitlement for all days not repaid. The sick leave bank shall be administered credited with the repaid days.
F. When the sick leave bank is depleted to fifty (50) days, members will contribute one (1) day of their sick leave. Necessary additions will be made at the beginning of each school year and are to be made after all repayments have occurred. The sick leave bank shall have a cap of two-hundred-fifty (250) days.
G. The sick leave bank will be controlled by a committee composed of five (5) members of the Union appointed by the Union President. Rules for membership and participation in the sick leave bank shall be established by the committee and shall be supplied to the Employer. Any rules established by the committee shall include the following:
(A) The sick leave bank shall be funded by bargaining unit members at the start of each school year to reach a maximum two (2) times the number of CEA/Professional staff members. The sick leave bank will be administered by the committee in accordance with the following procedures and guidelines:
1) Any employee enrolled in the sick leave bank may be supplied with additional days whenever apply for a loan from the number of days drops below fifty (50) to bring it up to the maximumsick leave bank for disability caused by personal illness or accident.
(B) Unused sick leave days in the bank at the close of the school year will carry over into subsequent years up to a unit of two (2) times An employee must first exhaust all the number of staff.
(C) No one may contribute more than two (2) employee’s sick days in any school year to before utilizing days from the sick leave bank; and that any days contributed shall be deducted from that year's .
3) All requests for use of sick leave entitlement for bank days must be in writing. The committee shall maintain a copy of the person making said contribution. Bargaining unit members request, as well as a record of the committee’s action on the request.
4) The employee must have give the committee adequate notice of the request to allow the committee time to meet prior to the needed days of leave.
5) A maximum of ten (10) days of accrued sick leave on file with per request may be granted by the employer prior to donating to the Sick Leave Bankcommittee.

Sick Leave Bank. The Employer agrees to establish a A. A sick leave bank to cover employee/s is established for use by eligible members of the secretarial staff covered by this Agreement who have exhausted their sick and personal leaves and who have serious illness or incapacity.
B. The bank shall be established by a contribution of two (2) days of accumulated sick leave from each employee in the event unit. If the sick leave is exhausted, it shall be replenished by the contribution of long term illnesstwo (2) additional days from each member in the unit. The maximum contribution in any work year shall be six (6) days per employee. All sick leave contributions will be deducted from such employees' accrued and unused sick leave. The Sick Leave Bank Committee shall determine when it is necessary to replenish the bank but shall not do so more than three (3) times per work year. At no time will the sick bank have more than two hundred (200) days accrued.
C. The Sick Leave Bank shall be administered by a committee composed Sick Leave Bank Committee consisting of five (5) two members of the Union appointed designated by the Union PresidentSchool Committee, and two members designated by the Association. Rules The Sick Leave Bank Committee shall determine the eligibility for membership grants of sick leave from the bank and participation the amounts of such grants. The following criteria shall be used by the Sick Leave Bank Committee in administering the bank and determining eligibility and the amount of leave to be granted:
1. Adequate medical evidence of serious illness.
2. Prior utilization of all eligible sick leave.
3. Amount of sick leave available in the bank.
4. Length of service in the Lincoln Public Schools.
D. In no event will an employee receive more than a total of eighty (80) days of sick leave from the sick leave bank for any one illness or incapacity.
E. The initial grant of sick leave to an eligible employee shall not exceed thirty (30) days of sick leave as determined by the Sick Leave Bank Committee in its sole discretion. Upon exhaustion of the initial thirty (30) days, additional days may be extended by the Sick Leave Bank Committee in its sole discretion upon demonstration of need by the employee.
F. The decision of the Sick Leave Bank Committee with respect to eligibility and the amount of grants shall be established by the committee final and shall be supplied binding and not subject to the Employer. Any rules established by the committee shall include the following:appeal.

Sick Leave Bank. The Employer employer agrees to establish a sick leave bank Sick Leave Bank to cover employee/s staff members in the event of long term illnessan extended illness or disability. The sick leave bank Sick Leave Bank shall be administered by a committee committee, hereinafter called the “Administrative Committee,” composed of five two (52) members of the Union Association appointed by the Union President. Rules Each member shall serve for membership one year and participation until a successor shall be appointed. A majority of the members present shall constitute a quorum and a majority vote of those present and voting shall decide all questions. Each employee will donate two days from the thirteen (13) days that the employee is allowed to accrue in a one-year period to be deposited in said bank, such days to be deducted from the employee’s annual sick leave. Employees are enrolled as soon as they have a sick leave day to contribute. Members will become eligible to request extended benefits from the Sick Leave Bank, after an incapacitating staff illness or disability of thirty (30) calendar days, provided they have exhausted all of their accrued sick leave. Upon presentation of satisfactory medical evidence of staff disability or illness to the Administrative Committee and approval by said Administrative Committee, a member may be granted up to thirty (30) additional days of sick leave. Guidelines for application by a member to the Sick Leave Bank shall be determined by the Administrative Committee and published by said Administrative Committee. In the event the employer or the Superintendent questions a recipient’s eligibility to receive sick leave benefits from the Sick Leave Bank, the employer may require proof that the recipient is eligible to receive such benefits as well as a physician’s certificate certifying to the disability or illness of such recipient. The total number of sick days in the sick leave bank “Bank” shall be established by the committee and shall be supplied not exceed in any one calendar year a number equal to the Employer. Any rules established by the committee shall include the following:

Sick Leave Bank. Sick Leave Bank. A. Any employee covered under the terms of this contract shall be eligible to participate in a VOLUNTARY district-wide Sick Leave Bank. The Employer agrees intent is to establish a provide extended sick leave benefits to those persons who incur a period of extended illness, injury, or hospitalization. Only those employees who donate the required days to the bank shall be eligible to cover employee/s apply to draw from the bank when needed.
B. New participants in the event of long term illness. The voluntary sick leave bank shall be administered submit written notice between August 15 and September 15 of intent to participate on a form created by the Sick Leave Bank Committee and provided by the Jacksonville School District. If a committee composed new employee is hired during the school year he/she may take part in the Sick Leave Bank by submitting intent to participate form provided by the JSD. New employees will have two (2) weeks from the first day of five employment to decide if he/she wishes to participate in the Sick Leave Bank.
C. Each employee electing to participate in the bank shall contribute two (52) sick days to the sick bank each year until the sick leave bank reaches the minimum capacity of 600 days. In case of depletion of the sick leave bank below 200 days all employees enrolled will automatically have one (1) sick day deducted and added to the sick bank. HR will notify all members of the Union appointed sick bank in writing of the depletion of sick bank days and that an automatic one (1) sick day will be taken out of their personal sick days on said date that it will occur.
D. Membership is automatically renewed each year unless a member submits written notice of cancellation by September 15 of the school year in which cancellation is desired. A participant may cancel membership by indicating in writing directed to the attention of HR. HR shall then transfer the letter of cancellation to the Sick Leave Bank Committee within 5 business days after receipt. Cancellation of sick leave bank membership, regardless of reason, shall mean forfeiture of any claim to their contributed days and benefits of membership.
E. The intent of the bank is to provide additional financial protection to those employees who incur a period of catastrophic illness, prolonged illness, serious injury, or hospitalization, as verified in writing by a physician, if requested by the Union PresidentCommittee. Rules The bank is not applicable to any employee utilizing days for membership illness in the family except in emergency situations following approval of the Superintendent and participation the Sick Leave Bank Committee. It remains the intent of both parties to strive to retain good attendance in the district. It is not the purpose of this bank to provide additional days to employees who have exhausted their accumulated sick leave and are applying for days because of colds, sore throats, flu, or some other non-catastrophic illness.
F. Beginning with the fourth (4th) unpaid day after the employee has exhausted all of his/her sick, vacation, and personal leave, an employee may be eligible to submit an application to use the Sick Leave Bank. If the employee is eligible, the plan coverage shall be retroactive to include the first (1st) day of eligibility which begins on the fourth (4th) unpaid consecutive day of absence. The consecutive day rule does not apply to intermittent absences due to life threatening occurrences. (See attached Sick Leave Bank Application attached hereto as Appendix G) G. Authorized withdrawals by participating employees of the sick leave bank shall be established by the committee and shall be supplied to the Employer. Any rules established by the committee shall include the following:
(A) The sick leave bank shall be funded by bargaining unit members at the start made only upon approval of each school year to reach a maximum two (2) times the number of staff members. The sick leave bank may be supplied with additional days whenever the number of days drops below fifty (50) to bring it up to the maximum.

(C) No one may contribute more than two (2) days in any school year to the sick leave bank; and that any days contributed shall be deducted from that year's sick leave entitlement for the person making said contribution.
