Sick Leave Bank. A. The Sick Leave Bank will When a bargaining unit member with over five (5) years of service has exhausted all of his/her accumulated paid leave (i.e. sick leave, personal leave and vacation leave) and experiences a serious, long term illness which a doctor states makes him/her unable to continue working and when that employee is ineligible for disability retirement or is in effectthe process of applying for such, so additional days of sick leave are still needed, then he/she may request through the Union that the additional days be transferred from other District employees’ accumulated sick leave.

5. If the total number of days in the sick bank at the end of a school year should drop below 20, each bank member shall be carried over asked to contribute another day in order to remain a member of the sick leave bank.
6. The Association President, or their designee, shall be responsible for providing to all bargaining unit members, an annual sick leave bank membership list and an accounting of the remaining sick leave bank days on or before September 1 each year. The school treasurer, or their designee, working with the Association President (or their designee), will assist in maintaining sick leave bank records, deducting sick days from members as needed and authorized, and informing new teachers of the availability to the next school yearsick leave bank.

Sick Leave Bank. A. a. Effective January 1, 1996, a Sick Leave Bank is hereby established for all qualified employees whose accumulated sick leave has been exhausted due to a prolonged illness or injury. Each employee who qualifies shall fund the Bank with one (1) sick leave day on 1/l/96 and two (2) sick leave days on January lst of each calendar year thereafter. 14.10 A teacher may withdraw from the sick leave bank a maximum of 45 days per contract year. If sick bank leave is remaining at the end of the contract year, those days would be returned the sick leave bank.
14.11 Sick leave bank days shall be applicable solely to the illness or disability of the teacher and not to the illness or death of any other person or persons.
14.12 A teacher may not be receiving benefits from the sick leave bank and benefits from the Teachers’ Retirement System at the same time. A teacher may elect to stop sick leave payment and take advantage of TRS Disability Benefits should he/she so desire. Furthermore, sick leave bank days shall not be available for use during an unpaid leave of absence.
14.13 The bank shall not be applicable to illness or disability resulting from cosmetic surgery or any surgical or other procedure that may be safely deferred until a vacation or recess period.
14.14 Teachers who withdraw sick leave days from the bank will not be required to replace those days except as a regular contributing member of the bank.
14.15 All unused sick leave bank days in donated by individual teachers to the bank will be returned to the individual teachers on a prorated basis if the plan is terminated at the end of a school year.
14.16 Teachers in their first year of employment with the district will not be able to withdraw sick leave bank days until completing 60 school days of service.
14.17 Nothing in this article shall be carried over construed as placing any obligation on the board to advance or loan additional sick leave days to the next school yearbank should all days be used up in any period or periods of its operation.
14.18 The Scales Mound Education Association, its members or teachers represented, agrees, with respect to the operation of the sick leave bank, that it will hold harmless and defend the Board of Education, its members, employees and/or agents, as regards any action, complaint or suit of any type, provided only that the Board shall fulfill its responsibilities as set forth above. In the event any action, complaint, or suit of any type in any form shall be brought against the Board, its members, employees and/or agents, the Board shall retain the exclusive right to select counsel to defend such action, complaint, or suit and/or to determine whether such action, complaint, or suit should be compromised or settled.

d. A teacher may be granted up to ninety (90) sick leave days from the bank per school year and up to an additional thirty (30) days from the bank per school year with his/her pay reduced by the compensation paid to his/her substitute.
e. Eligibility for sick leave days from the bank shall be based on a serious prolonged illnesses or injury preventing the teacher from working. The presence of a serious prolonged illness or injury shall be documented by a medical report from the teacher’s physician.
f. No days may be granted from the bank unless the employee has exhausted his/her accumulated sick leave. However, if it appears imminent a teacher will exhaust his/her accumulated leave, the request for days may be made in advance so that no interruption in the teacher’s regular pay occurs. The bank shall not be used in conjunction with any other leave.
g. The decisions of the sick leave bank committee shall not be subject to a grievance or any other collateral attack.

(3) The member has experienced an illness or disability that has prevented him/her from performing his/her job requirements for more than five days and a doctor has certified in writing this illness or disability.
d. If the request is approved, the committee shall notify the District Office and resulting days, including the first five days of the illness or injury, if personal sick leave was not available for those days, will be charged to the bank until the member returns to work or has used 65 days from the bank.
e. The District shall keep accurate records of leave accumulated by the bank and of sick leave used by the bank. Annually, the District shall notify the Association in writing of accumulated days and days charged to the bank that year.
f. Membership shall be terminated by written request of the member or by the end of a school employment. Previously donated days shall remain in the bank. 11. Employees who have accrued seventy-five (75) days of sick leave may convert one (1) sick leave day to one (1) bonus day each year. Employees who have accrued one hundred (100) days of sick leave may convert two (2) sick leave days to two (2) bonus days each year. Employees who have accrued one hundred twenty-five (125) days of sick leave may convert three (3) sick leave days to three (3) bonus days each year. Employees who have accrued one hundred fifty (150) days of sick leave may convert four (4) sick leave days to four (4) bonus days each year.
12. Nothing in this Article shall be construed as placing any obligation on the Employer to advance or loan additional sick leave days to the next school yearsick leave bank should all days be used up in any period or periods of its operation.
13. The district will be required to pay sick leave benefits for no more than sixty-five (65) consecutive days (combined personal and sick leave bank days) for any specific illness. Any Employee covered by this sick leave provision whose illness extends beyond the provision of this Section may participate in the long-term disability insurance program if they so qualify. An individual, however, may use their personal sick leave days for any unrelated subsequent use of sick leave benefits.

Sick Leave Bank. A. The Sick Leave Bank will continue Purpose – To provide members with additional paid sick leave when such members have exhausted sick leave due to their personal catastrophic illness or injury or combination thereof, and have provided competent and timely medical certification of said catastrophic illness or injury or combination thereof. Catastrophic illness shall be construed as severe physical or mental illness requiring prolonged hospitalization or recovery. Examples include, but are not limited to; coma, cancer, leukemia, heart attack and/or stroke. Enrollment in effectthe sick leave bank:
a. Membership in the sick leave bank is voluntary on the part of an employee once said employee has completed two (2) years of service in Waterford
b. Members who are eligible to participate shall notify the Human Resources department by May 31 of the school year preceding their enrollment.
B. Effective July 1, 1980, membership c. Members who choose to participate in the bank was voluntary for all employees. Thereafter, all new employees who request membership will shall be assessed automatically re-enrolled.
d. Annual enrollment requires the donation of one (1) day of sick leave for deposit in to the bank.

E. Any employee member who contributed one day to the Sick Leave Bank shall not be charged a sick leave day for the purpose of sick leave conversion. The day will be drawn withdraws from the prior year’s accumulated sick leave, except in the event that the employee has no sick leave, in which case that day will be drawn from the current year.
F. New employees must join the Sick Leave Bank within the first thirty (30) days of their employment or lose their right to do so.
G. Employees may relinquish their membership in the sick leave bank at any time; if they do sowill forfeit the contributed days. Procedure for requesting sick leave bank assistance:
a. A member fitting the criteria set forth above requests through the Federation that the sick leave bank board activate the sick leave bank. In the event that the member is incapable of making the request due to the member’s catastrophic illness, however, they will lose both their contribution in the Sick Leave Bank and their right to rejoin Federation may request activation of the sick leave bank at a later dateon the member’s behalf.
H. A member will lose b. Upon the right to utilize the Sick Leave Bank if his employment with the Baltimore City Public School System is terminated.
I. All contributions will remain in force and cannot be returned even upon cancellation receipt of a membership. In no case will the granting of leave request from the Federation to activate the sick leave bank, the sick leave bank cause four (4) member board, as described below, shall use the following criteria to determine eligibility of a member to receive more than his or her annual salarydonations and to determine the number of days to be allocated from the bank.
J. All unused i. A member must have a catastrophic illness or injury or combination thereof, diagnosed by a physician, and must provide timely and competent medical certification of the catastrophic illness or injury or combination thereof. The four (4) member sick leave bank board may require that the documentation of said illness or injury be reviewed by a sick leave bank board-designated physician in order to access the sick leave bank. When this review results in a significant question of the diagnosis, then the sick leave bank board may require the teacher to submit to a further medical examination.
ii. A member must have exhausted all accumulated sick leave.
iii. A member seeking to access the sick leave bank shall not be entitled to any other Board sponsored paid leave, remuneration from Board sponsored disability payments, workers’ compensation, and/or other such Board sponsored benefits.
iv. A member receiving an allocation of days from the bank must continue to pay for his/her portion of the health insurance premium. Administration of the sick leave bank:
a. The Board of Education shall cooperate in the establishment and maintenance of a sick leave bank on a voluntary basis, as described in this paragraph.
b. The sick leave bank shall be administered by a four (4) member board, two (2) members chosen by the Board of Education, and two (2) members chosen by the Federation. Each request for aid, as documented by a doctor's certificate, for the sick leave bank shall be decided by the sick leave bank board on the merits of the individual request. Action of the sick leave bank board shall be by the majority vote. The sick leave bank four (4) member board may reserve days in the bank at bank, and prorate the end allocation of a school year such days in the event that more requests are approved than days available in the bank.
c. Not more than Forty-five thousand dollars ($45,000) shall be carried over expended from this fund during any one (1) year. No more than Fourteen thousand dollars ($14,000) shall be expended upon any one (1) employee during any one (1) year.
d. Those employees not contributing to the next school yearsick leave bank shall not participate in it.
e. The parties shall appoint a committee that shall meet annually to study alternative means of funding the sick leave bank.
f. Should an alternative plan of funding be agreed to by both parties, the parties shall re-negotiate the provisions of this Article VI, Paragraph 29; provided that if the parties are not able to reach an agreement concerning revisions to this Article VI, Paragraph 29, the parties will defer any further negotiations until the negotiations for the successor collective bargaining agreement commence.

Any bargaining unit member shall be carried allowed to donate an unlimited number of personal leave days to the bank. This bank will be administered by the Council as defined above. There is, however, no limit to the number of days that can be granted from the personal leave bank.
j. The personal leave bank will not carry over to days into the next school year.
k. Once personal leave is donated to the bank, the revocation of the personal leave day is final and will not be returned to the donating employee.

7. A committee of eight (four teachers K-3 (1), G4-6 (1), G7-8 (1), G9-12 (1), three classified, and a building principal) shall grant or deny any request made to the sick leave bank for sick leave days. Requests for sick leave days should be made to the sick leave bank administrator. Decisions approved by the majority of the committee are final. The committee members shall use the following criteria in administering the bank and rendering their decision.
a. Medical evidence of serious illness
b. Employee has used all accumulative leave days
c. History of use of sick leave during the year
8. Sick bank leave may be requested by the employee for illness, injury, or death in the immediate family (Re: ARTICLE III, I). The central office shall maintain records of sick bank at the end use.
9. Requests must be accompanied by physician’s statement and indicate estimated number of a school year shall be carried over to the next school yearsick days requested.

Sick Leave Bank. A. The Sick Leave Bank will continue in effectDefinition: a sick leave bank is established for members of the bargaining unit and is available to all employees if agreed to by the parties.
B. Effective July 1The purpose of this bank is to aid unit employees who have exhausted regular sick leave and need additional sick leave because of a catastrophic* medical condition, 1980serious accident or disability, membership in which renders the employee incapable of working.

E. Each employee will sign an authorization at his/her work site specifying participation or non-participation in the sick leave bank. The Association Representative will deliver the forms to the appropriate central office clerk at the end of the twentieth work day. The day will then be deducted from the individuals' sick leave and credited to the bank.
C. A member X. Each contributing unit employee who exhausts his/her sick leave and is not able to return to work may apply for up to twenty (20) additional days per year from the bank. Applications will be considered by a review committee, which will take action upon such request by using specific criteria as contained herein. In the event of a new or reoccurring medical condition, accident or disability, the bargaining unit employee may participate reapply for up to ten (10) days of additional leave.
G. The review committee will consist of two teachers, one secretary, one associates and one administrator. The teacher, secretary and associate members will be appointed by the Association president upon recommendation from the respective groups, and the administrators by the Superintendent. The review committee will establish guidelines to be followed. These will be published and prominently displayed in the each building.
X. Xx employee who has exhausted all his/her sick leave and sick leave bank only after:
1allowance due to a serious illness may be eligible for an additional twenty (20) days maximum from an employee(s) who chooses to donate these days out of his/her sick leave days. Filing application with Under no circumstances will an employee solicit days from other employees. The employee(s) willing to donate his/her days to another employee will make arrangements through the Sick Leave Bank Committee;.
I. Retirees may contribute up to twenty (20) days of remaining sick leave to the sick leave bank upon their retirement retroactive from the implementation of the current contract to July 1, 2017. After July 1, 2017, only ten (10) days can be contributed by a retiree.
J. In order to qualify for consideration to receive days from the bank, employees will meet the following criteria:
1. The applicant is a regular employee of LMSD which is defined as one who contributes to the XXX.
2. Submitting satisfactory medical evidence of The applicant is an active contributor to the illness;bank.

5. The applicant has a member of his/her immediate family, defined as children or spouse, in a life threatening situation
K. Exclusions to consideration are:
1. Pre-existing conditions known to exist by the joint committee which includes an evaluation employee on or before the date of the teacher’s past sick leave usage record.
D. A joint committee of six (6) members, half named by the Board and half named by the Union, will administer joining the Sick Leave Bank and establish specific procedures will not be covered under the provisions of the Sick Leave Bank, except under the following guidelines:
a. If any sick leave days have been incurred for its utilization.
E. Any an illness, surgery, or injury during the ninety (90) days before the date the employee who contributed one day to joined the Sick Leave Bank, the employee may not request additional days from the Sick Leave Bank shall not be charged a sick leave day for until the purpose condition has caused no use of sick leave conversionfor Ninety (90) days after joining.

3. The day will be drawn from the prior year’s accumulated sick leave, except in the event that the employee has no sick leave, in which case that day will be drawn from the current yearapplicant is covered by Worker's Compensation.

Sick Leave Bank. A. 6.5.1 The Sick Leave Bank will continue in effect.
B. Effective July 1, 1980, membership Board agrees to establish a sick leave bank to cover eligible teachers in the bank was voluntary for all employeesevent of long term illness. Thereafter, all new employees who request membership will be assessed one day of The sick leave for deposit in the bank.
C. A member bank shall be administered by a committee composed of three (3) members of the bargaining unit may participate in Association appointed by the bank only after:
1. Filing application with President, henceforth called the Sick Leave Bank Committee;
. Each member shall serve for one (1) year or until a successor shall be appointed. The Sick Leave Bank Committee shall meet as needed. A majority of the members shall constitute a quorum and a majority vote of those present and voting shall decide all questions. A teacher becomes eligible to contribute and be covered upon beginning the second consecutive year of teaching in Alton. Those wishing to be covered agree in writing to donate one (1) or two (2) days each year from the fifteen (15) that are allowed to accrue in a one-year period. Submitting These days will be deposited in said bank and are from the teacher's accumulated sick days. Members may enroll as soon as they have a sick leave day to contribute. Each succeeding school year shall be a new enrollment period and days contributed to the bank shall not accrue in excess of one hundred fifty (150) days. A member shall become eligible to request extended benefits from the sick leave bank after an incapacitating illness or disability provided the member has exhausted all accrued sick leave. Upon presentation of satisfactory medical evidence of the illness;
3. Submitting evidence of having exhausted all accumulated leave;
4. Satisfying such other criteria as may be established by the joint committee which includes an evaluation of the teacher’s past sick leave usage record.
