STATUTORY AND DECLARED HOLIDAYS. Shift Employees Long Term Care In lieu of the st atutory or declared holidays as defined in the Agreement, all shif t personnel shall be entitled to 12 days leave w ith pay in addition to vacation leave entitlement. Leave credit s, in lieu of st atutory or declared holidays, may be taken concurrent w ith vacation leave, or regular days off. Within six (6) w eeks of the holiday the employee shall exercise one of the follow ing options: (1) receive payment; or (2) take the leave w ith pay at a mutually agreeable t ime. Should the employee not exercise either option w ithin the t ime limit set out above, the Employer may assign the date of the leave w ith pay. Such assignment shall not be made in an unreasonable manner. All Long Term Care shift personnel w ho may, as a result of their shif t schedule, be on duty on the actual day of the st atutory or declared holiday as defined above shall, in addition to the t ime off w ith pay specif ied in this section, receive one and one-half (1 ½ ) t xxxx the hourly rate of pay for all t ime w orked during the shif t for the hours falling on the st atutory or declared holiday. Any employee w ho separates from employment during the calendar year shall only be entitled to those st atutory or declared holidays w hich w ere celebrated up to the date of separat ion, and any lieu day credits used in excess of the employee’ s entitlement shall be repaid to the Employer. It is agreed that shif t employees in Long Term Care shall not be required to w ork both Christmas Day and New Year’ s Day, but shall alternate from one to the other from one year to the next as may be required.
