STATUTORY AND DECLARED HOLIDAYS. 7:01 Entitlement All Employees shall be entitled on a pro-rata basis to thirteen (13) Statutory and Declared Holidays in addition to their annual vacation. In lieu of the Statutory and Declared Holidays, each 24/7 shift Employee in the Fire Fighting and Communications Division and 24/7 shift Employees occupying positions of Safety Officer shall be credited with thirteen (13) lieu days, on a pro-rata basis where applicable. Such Employees shall be allowed to choose a cash-in-lieu for any days, or elect to take time off. The time off shall be based on the Employee’s regular scheduled workday and must be taken at a mutually agreed upon time. The Employee must signify his/her intention in writing to the Chief by November 1st of the preceding year of the number of days for which they intend to take time off. Boxing Day In addition to those set out in the preceding paragraph, any day proclaimed by the Governor General in Council or the Lieutenant Governor in Council for the Province of Ontario, shall be a Statutory or Declared Holiday. The Employee's date for determining his/her entitlement to payment in lieu of Statutory Holidays shall be the actual date of his/her appointment to the Fire Department. 7:02 Payment (Effective from January 1, 2009 to February 28, 2009) Request for payment for owed lieu day(s) must be made at least thirty (30) days in advance of when payment is requested. Employees will only be eligible for payment of any lieu day(s) after the actual Statutory or Declared Holiday has passed. Payment for any outstanding, unscheduled lieu days will be provided on the first pay period in December of each year. The daily rate shall be calculated by dividing the annual rate by one hundred and eighty-two (182) days. Payment (Effective March 1, 2009) Request for payment for owed lieu day(s) must be made at least thirty 30) days in advance of when payment is requested. Employees will only be eligible for payment of any lieu day(s) after the actual Statutory or Declared Holiday has passed. Observation of the statutory holiday by staff working Monday to Friday will be observed on the day that it occurs. If it falls on Saturday or Sunday, it will be observed on the day that it is observed by the Employer. 8.3 Two (2) Float Days shall be provided to firefighters annually, in place of Remembrance Day (November 11) and one half (1/2) day off on each of Christmas and New Year’s Eve. Float Days must be scheduled on a mutually satisfactory day during the current calendar year and cannot be banked or carried forward to the next year. Probationary firefighters shall not be entitled to Float Days during the first six (6) months of the probationary period. If a firefighter’s employment terminates within the first six (6) months of the year, they shall have no entitlement to payment in respect of any float days not taken by the date of termination of employment. However, if the firefighter’s employment terminates in the second half of the year, they shall be entitled to payment in respect of any untaken float holidays. 8.4 Pay-Out of Statutory and Declared Holidays 8.5 Suppression firefighters may elect at the time that vacation schedules are being chosen to bank up to five (5) lieu days for use during the year. All usage shall be subject to the operational and training needs of the Department and must not cause overtime. Normally, each 24/7 shift Employee in at least fourteen (14) days of notice should be provided to the Fire Fighting Chief or their designate but short notice may be accepted if the training and Communications Division operational needs of the Department are not compromised and 24/7 shift Employees occupying positions of Safety Officer shall no overtime will result from the absence. Scheduling requests that meet the needs above will not be credited with thirteen (13) lieu days, on a pro-rata basis where applicableunreasonably denied.
