STATUTORY AND DECLARED HOLIDAYS. 5.01 The following Statutory and Declared Holidays shall be recognized as a day off with pay for Members covered by this Agreement: New Years Day Canada Day Remembrance Day Good Friday Civic Holiday Christmas Day Easter Monday Labour Day Boxing Day Victoria Day Thanksgiving Day Float Holiday Family Day a) For those members not working rotating tours of duty, the Floater Holiday is to be taken at a time mutually agreed to between the Member and the Chief of Police or designate. 5.02 a) Each Member working rotating tours of duty shall be granted thirteen (13) days annually in lieu of the Statutory and Declared Holidays listed in Section 5.01, which shall be in the form of one hundred and four (104) hours, added to each Member's time bank on January 1st of each year. b) Each Member working rotating tours of duty shall have the choice of receiving pay for the lieu time at their regular rate, or taking the time off, or any combination thereof, and shall advise the Chief of Police no later than December 15th of each year as to the Member's choice. Unless requested by the Member that Statutory or Declared Holiday lieu time be paid as it occurs, it shall be accumulated as a credit to the Member and may be taken as a cash lump sum payment by December 15th of each year. 5.03 a) Statutory and Declared Holiday time off shall be granted on a seniority basis and shall be taken off in the year in which it is accumulated, on a weekly basis, based on a forty (40) hour work week, unless a special request is approved by the Chief of Police or his designate.

The proportionate amount shall be based upon the number of statutory holidays which have occurred in the year before the member leaves the Service.
