Common use of Substitute Employees Clause in Contracts

Substitute Employees. ‌ (a) Effective July 1, 2005, substitute employees who work more than 75% of a fiscal year or 195 working days in any given fiscal year when the substitute is replacing an employee absent from duty due to illness or injury are entitled to classified status as a beginning probationary employee. (b) When the District is engaged in a procedure to hire a permanent employee to fill a vacancy, the District may fill the vacancy through the employment, for not more than 60 work days, of one or more substitute employees. At the end of the 60 work days, if the District is actively recruiting, the District may continue to use a substitute until the position is filled. If, however, the District is not actively recruiting by the end of the 60 days, it may no longer continue to use the substitute to fill the position.
