Common use of TEN HOUR BREAK Clause in Contracts

TEN HOUR BREAK. (a) When overtime work is necessary it shall, wherever reasonably practicable, be so arranged that an employee has at least ten (10) consecutive hours off duty between the work of successive days. (b) An employee who works so much overtime between the completion of the ordinary hours worked on one day and the commencement of the ordinary hours on the next day that the employee has not had at least ten (10) consecutive hours off duty between those times shall, subject to this sub-clause, be released after completion of such overtime until the employee has had ten (10) consecutive hours off duty without loss of pay for ordinary working time occurring during such absence. (c) If, on the instructions of the Employer and in exceptional circumstances, an employee resumes or continues work without having had ten (10) consecutive hours off duty, the employee shall be paid at double time until the employee is released from duty for such period and the employee shall then be entitled to be absent until the employee has had ten (10) consecutive hours off duty without loss of pay for ordinary hours occurring during such absence. (d) Where an employee is called into work on a Sunday or holiday prescribed under this Agreement preceding an ordinary working day, the employee shall, wherever reasonably practicable, be given ten (10) consecutive hours off duty before the usual starting time on the next day. TEN HOUR BREAK. (b) 9.6.1 An employee Employee who works so much overtime between the completion termination of the his/her ordinary hours worked work on one day and the commencement of the his/her ordinary hours work on the next day that the employee he/she has not had at least ten (10) consecutive hours off duty between those times shall, subject to this sub-clause, shall be released after the completion of such overtime until the employee he/she has had ten (10) hours off duty without loss of pay for ordinary working time occurring during such absence, provided that a lesser period than ten hours may be agreed between the Shire and the employee. 9.6.2 If such Employee is instructed to resume or continue work without having such ten consecutive hours off duty, or such other lesser period as agreed, an Employee shall be paid at double ordinary rates until released from duty for such period, and shall then be entitled to be absent until the Employee has had ten consecutive hours, or such other lesser period as agreed, off duty without loss of pay for ordinary working time occurring during such absence. (c) If, on the instructions of the Employer and in exceptional circumstances, an employee resumes or continues work without having had ten (10) consecutive hours off duty, the employee shall be paid at double time until the employee is released from duty for such period and the employee shall then be entitled to be absent until the employee has had ten (10) consecutive hours off duty without loss of pay for ordinary hours occurring during such absence. (d) 9.6.3 Where an employee (other than a casual employee or an employee engaged on continuous shift work) is called into work on a Sunday or a holiday prescribed under this Agreement preceding an ordinary working day, the employee he/she shall, wherever reasonably practicable, be given ten (10) consecutive hours off duty before the his/her usual starting time on the next day. If this is not practicable, then the provisions of (b) and9.6.1 and 9.6.2 shall apply. 9.6.4 Overtime worked as a result of a recall shall not be regarded as overtime for the purpose of this sub-clause when the actual time worked is less than three hours on such recall or on each of such recalls.

If this is not practicable, then the provisions of sub-Clause 27.2) and sub-Clause 27.3) shall apply. 27.5 The provisions of this sub-Clause shall apply in the case of shift employees as if eight (8) hours were substituted for ten (10) hours when overtime is worked: a) For the purpose of changing shift rosters; or b) andWhere a shift employee does not report for duty; or c) Where a shift is worked by arrangement between the employees themselves. 27.6 Overtime worked as a result of a recall shall not be regarded as overtime for the purpose of this Clause when the actual time worked is less than three (3) hours on such recall or on subsequent recalls.
