Term and Occupancy. A. The term of this Lease shall commence on the ------------------ Construction Completion Date, as provided in Paragraph 4 below (hereinafter referred to as the "Commencement Date"), and shall end on the date which is the last day of the month that includes the twelfth (12th) anniversary of the Commencement Date (hereinafter referred to as the "Expiration Date"), unless the term be extended or earlier terminated as provided herein. Landlord shall notify Tenant of the anticipated Construction Completion Date. Landlord agrees to notify Tenant promptly from time to time of any changes in the anticipated Construction Completion Date. Tenant shall have the right to enter the Demised Premises during the approximately ninety (90) day period preceding the Construction Completion Date for the purpose of installing its equipment and Tenant does hereby agree to assume all risk of loss or damage to such equipment, and to indemnify, defend and hold harmless Landlord from and against any loss or damage to such equipment and all liability, loss or damage arising from any injury to the property of Landlord, or its contractors, subcontractors or materialmen, and any death or personal injury to any person or persons arising out of such installation. Landlord agrees to cooperate with Tenant so that Tenant's contractors and tradespeople will be permitted to reasonably perform their work without material interference. B. Notwithstanding anything else in this Lease to the contrary, Tenant shall have the right to terminate this Lease as of the end of the eighth (8th) Lease Year (the "Early Termination Date") provided that Tenant shall (a) notify Landlord in writing of its election to terminate at least one (1) year prior to the Early Termination Date, and (b) pay to the Landlord, concurrently with the notification to Landlord hereunder, a termination fee by certified or cashier's check or wire transfer of available funds ("Termination Amount") equal to the discounted present value (using Landlord's financing interest rate) amount needed to reduce the remaining unamortized principal balance due on the indebtedness originally incurred by Landlord to finance the Landlord's Development Costs (as defined in Paragraph 19F). Term and Occupancy. Said premises shall hereinafter sometimes be referred to as the "leased premises" or "premises". LESSOR does hereby lease and demise unto LESSEE said Premises to have and to hold the same for a period of two (2) years. Term and Occupancy. Subject to the terms of this Agreement, the LESSEE shall have exclusive access to, and use of, the Event Space from AM/PM on through The Event must be concluded, and the Event Space vacated by the LESSEE, its officers, agents, employees, guests, patrons, and invitees, by the end of the Use Period.
A. LESSEE agrees to remove all of its property on or before the date and time of expiration or termination of the Use Period, and shall promptly reimburse BAYLOR and/or Owner, as appropriate, for the cost of repairing all damage done to the Event Space by such removal. Absent special written arrangements with BAYLOR, any property left in the Event Space by the LESSEE after the Use Period concludes shall be disposed of at BAYLOR's sole discretion.
B. Failure by LESSEE, its guests, patrons, or invitees, to vacate the Space and the Event Space by will result in an overtime charge of

The occupancy may commence with partial occupancy of space not occupied by the Lessee on or before January 1, 1998 the said additional space will be available as follows: The 2,500 square feet on the second level of the warehouse (known as the show room) is available as of January 1, 1998 at the monthly rate of $300.00. The portion of the warehouse (known as the middle warehouse) consisting of 6,250 square feet will be available no later than February 1, 1998 at the rate of 1,825.00 per month. The remaining warehouse (known as the rear warehouse) is available no later than March 1, 1998. The effective date of this lease amendment for payment and accrual of rent is March 1, 1998.
