Testimonials and Endorsements. As used in this Agreement, an “Endorsement” means any published marketing presentation (including but not limited to AMBASSADOR testimonials or endorsements, other consumer testimonials or endorsements, celebrity or expert endorsements, blogs, verbal statements, demonstrations, or depictions of the name, signature, likeness or other identifying personal characteristics of an individual or the name, logo or seal of an organization) that consumers are likely to believe reflects the opinions, beliefs, findings, or experience of a person or entity other than MT. XXXXX. The AMBASSADOR or other person or entity whose opinions, beliefs, findings, or experiences the Endorsement appears to reflect shall be referred to as the “Endorser.” Use of Endorsements is subject to the requirements below. MT. XXXXX reserves the right to research, monitor and audit AMBASSADOR’s use of Endorsements, and to determine, in MT. XXXXX sole discretion, whether AMBASSADOR is in compliance with these requirements. Failure of MT. XXXXX to research, monitor, or audit AMBASSADOR’s use of Endorsements shall not relieve AMBASSADOR from compliance with these requirements. 1. Endorsements must reflect the honest opinions, findings, beliefs and/or experience of the Endorser, and may not convey an express or implied representation that would be deceptive if made directly by MT. XXXXX. 2. Endorsements may not be presented out of context or reworded so as to distort in a material way the Endorser’s opinion or experience with the MT. XXXXX product or service. 3. If the Endorsement represents that the Endorser uses a MT. XXXXX product or service, the Endorser must have been a bona fide user of it at the time the Endorsement was given. 4. No Endorsement containing statements reflecting the objective experience of an individual or group on a central or key attribute of a MT. XXXXX product or service may claim that the experience is representative of what consumers will generally achieve. 5. If the Endorser was or will be paid for his/her Endorsement, or there is or was any other material connection between the Endorser and MT. XXXXX, AMBASSADOR must include in the Marketing presentation a clear and conspicuous disclosure, in close proximity to the Endorsement, that the Endorser has been or will be paid for his/her Endorsement or otherwise disclose the material connection between Endorser and MT. Testimonials and Endorsements. All testimonials and endorsements must comply with Federal Trade Commission (FTC) guidelines. Claims about a product’s performance or quality must be based on actual experiences. You must disclose connections between yourself and an advertiser that is unclear or unexpected to a customer (for example, whether there is a financial arrangement, employment arrangement, or ownership interest).
Testimonials and Endorsements. We may present real-world experiences, reviews, comments, and testimonials on the website and/or social media pages of Xxx Xxxxx. The testimonials, examples, and photos used are of actual clients and results they have personally achieved, or they are comments from individuals who can speak to our services and the quality of our work. Each person or individual has approved these testimonials, examples, and photos for use in materials to speak to our advice, written content, suggestions, videos, products, and services, but they are not intended to represent or guarantee that current or future clients will achieve the same or similar results. Rather, these client stories represent what is possible with our service, advice, suggestions, meeting sessions, coaching, videos, and efforts. Each of these unique stories, and all results reported in these stories by our clients on our website and through our videos, products, and services, are the culmination of numerous variables, some of which we cannot control.
Testimonials and Endorsements a. You must take steps to ensure that all endorsements and awards are substantiated, up-to-date and relevant. Any compensation made to any individual or organization must be disclosed. b. You must regularly take steps to confirm all endorsements and/or awards are current, with such confirmation provided on an annual basis. c. Marketing materials using endorsements which imply or represent that the endorsement is coming from actual consumers, must use the actual consumers in audio and video, or clearly disclose that the persons in the advertisement are not actual consumers (actors) of the advertised product.

  • Endorsements and Procedures You agree to restrictively endorse any item transmitted through our RDC service by either: • Signing the back of the item with your name and the words “For Mobile Deposit Only” • Following other instructions provided by us. You agree to follow any and all further procedures and instructions for use of our RDC service that we may communicate to you through changes to this agreement or through other notice we provide to you. You agree to securely retain each item for no fewer than 90 days after deposit. Then, no fewer than 90 days after deposit, you agree to mark each item submitted via our RDC service as “Void” and dispose of it using a high degree of care to ensure the item cannot be transmitted, deposited, or presented again. You warrant to us that: • You will only transmit eligible items that are properly endorsed. • You will not transmit duplicate items. • All information you provide to us when using our RDC service is accurate and true. • We will not sustain a loss because you have deposited an item. • You will indemnify us from any loss for breach of this warranty provision. In general, if an image of an item you transmit using RDC is received and accepted before 4:00 p.m. ET on a business day we are open, we consider that day to be the day of that deposit, subject to the other terms and conditions herein. Otherwise, we may consider the deposit to be made on the next Business Day we are open. Funds deposited using our RDC service will generally be made available by the third business day from the day of deposit. However, we generally make the first $225 of the aggregate of your checks deposited through our RDC service on each business day available by the next business day. We may delay the availability of your funds for a longer period of time at our discretion if we deem it appropriate in accordance with our policies and procedures.

  • Certificate of Insurance/Endorsements A certificate of insurance from an insurer with a Best's rating of no less than A- indicating compliance with the required coverages has been received by State Procurement Bureau, X.X. Xxx 000000, Xxxxxx, XX 00000-0000. The certificates must name the State of Montana as certificate holder and Contractor shall provide copies of additional insured endorsements required by Contractor’s commercial general liability and automobile liability policies. Contractor must notify State immediately of any material change in insurance coverage, such as changes in limits, coverages, change in status of policy, etc. State reserves the right to require complete copies of insurance policies at all times.

  • Additional Endorsements The Auto and Commercial General Liability Policies shall name the Texas A&M University System Board of Regents for and on behalf of The Texas A&M University System as additional insured’s.

  • NON-ENDORSEMENT As a result of the selection of a consultant to supply services to the City, the consultant agrees to make no reference to the City in any literature, promotional material, brochures, sales presentation or the like without the express written consent of the City.

  • Additional Insured Endorsements An original Additional Insured Endorsement, signed by an authorized insurance company representative, must be submitted to the City of Sparks, by attachment to the Certificate of Insurance, to evidence the endorsement of the City of Sparks as additional insured.
