Title to Materials Found. As between Owner and Contractor, the title to water, soil, rock, gravel, sand, minerals, timber, and any other materials developed or obtained in the excavation or other operations of Contractor, any Subcontractor or Sub-subcontractor and the right to use said materials or dispose of same is hereby expressly reserved by Owner. Notwithstanding the foregoing, Contractor shall be permitted, without charge, to use in the Work any such materials that comply with the requirements of this Agreement.

Owner hereby approves Contractor’s right to use the following, but Owner makes no warranty or representation regarding the adequacy or sufficiency of same: spoils (cut) from the Train 1, Train 2 or Train 3 areas as fill for the Train 4, Train 5, Train 6, Train 7, OSBL and flare areas, and stabilized soil from the sump/impoundment excavations. Notwithstanding the above, Contractor shall remain liable for, at its sole cost and expense, the disposal of all materials developed or obtained in the excavation or other operations of Contractor, any Subcontractor or Sub-subcontractor (excluding Pre-Existing Contamination, Arsenic and Unforeseen Subsurface Conditions).

Notwithstanding the foregoing, Contractor shall be permitted, without charge, to use in the Work any such materials that comply with the requirements of this Agreement. Material dredged in the performance of the Work shall be deposited in the areas designated by Owner as set forth in Attachment Y.
Title to Materials Found. Subject to Laws of Sri Lanka, as between CPC and Pipeline Company, the title to water, soil, rock, gravel, sand, minerals, timber, and any other materials developed or obtained in the excavation or other operations of Pipeline Company, any Subcontractor and the right to use said materials or dispose of same is hereby expressly reserved by CPC. Pipeline Company may, at the sole discretion of CPC, be permitted, without charge, to use in the Work any such materials that comply with the requirements of this PS Agreement.

Title to Materials Found. Unless otherwise provided herein, the title and interest in all water, soil, stone, gravel, sand, materials, hydrocarbons, timber and all other materials at the Work Site developed or obtained in the excavation or other operations by the Contractor or any of its subcontractor or any of their representatives or employees and the right to use or dispose of the same are hereby expressly reserved in the Company and neither the Contractor nor any of its subcontractors nor any of their representatives or employees shall have any right, title or interest in or to any part thereof, neither shall they nor any of them assert or make any claim thereto. The Contractor will, as determined by the Company, be permitted to use in the Work without charge any such materials which meet the requirements of the Contract and as to which the Company shall have the right to use and consume without payment to a third party. In the event that any items with archaeological or historical value are discovered by the Contractor or any of its subcontractors or any of their representatives or employees, the Contractor shall immediately stop work, notify the Company and await the Company's decision before proceeding with any work. Neither the Contractor nor any of its subcontractors nor any of their representatives or employees shall have any property rights in such items. In addition, the Contractor shall neither enter into areas, nor damage or destroy structures, designated by the Departments of Antiquities as of archaeological or historical value, without the Royal Commission's and Company's prior written approval. The Contractor shall give due notice to the Royal Commission and Company prior to acting upon any such approval.
