Common use of Transfers and Seniority Outside Bargaining Unit Clause in Contracts

Transfers and Seniority Outside Bargaining Unit. No employee shall be transferred to a position outside the bargaining unit without his/her consent. If an employee is transferred to a position outside of the bargaining unit, he/she shall retain his/her seniority accumulated up to the date of leaving the unit, but shall not accumulate any further seniority. An employee shall have the right to return or be returned to a position in the bargaining unit within the sixty (60) day period of the transfer. If an employee returns to the bargaining unit, he/she shall be placed in a job consistent with his/her seniority. Such return shall not result in the layoff or bumping of an employee holding greater seniority.
