TRANSFERS TO NON-BARGAINING UNIT POSITIONS. An employee transferred to a non-bargaining unit position shall not accumulate seniority while in the non-bargaining unit position, but his/her seniority earned shall be retained and frozen. If the employee is transferred back into the bargaining unit, he/she shall pick up his/her frozen seniority. The Union acknowledges that the Employer retains the right to determine the wages, hours, terms and conditions of employment for all non-bargaining unit employees, including the right to determine whether or not an employee is transferred back into the bargaining unit.
TRANSFERS TO NON-BARGAINING UNIT POSITIONS. 18.1 If an employee is, or has been a member of the bargaining unit and is transferred to a position outside this Agreement, and accordingly is not subject to the provisions of this Agreement, the employee shall retain his previous seniority for a period not to exceed two (2) calendar years. If transferred back to a position subject to the provisions of this Agreement, the employee shall carry this accumulated seniority, but will not be credited with seniority accumulated outside the unit.
