Reporting for Duty Where an employee is not notified beforehand not to report for duty, and he reports for work at his scheduled starting time, he shall be paid for the entire shift even when work is not available in his normal assignment. In such circumstances, the employee may be required to perform other available work.
Fitness for Duty When question exists related to appropriate leave administration or work safety to individuals, co-workers or others, the EMPLOYER may require employees to undergo a medical evaluation that will enable the EMPLOYER to determine the employee’s fitness for performance of his/her duties. When the EMPLOYER requires an evaluation or report from a medical authority, either the employee’s personal or treating authority or the medical authority of the EMPLOYER’s selection, the EMPLOYER shall:
Grounds for Discipline Incompetency, inefficiency, dishonesty, drunkenness, immoral conduct, insubordination, discourteous treatment of the public, neglect of duty, absence without leave, substance abuse, failure of good behavior, violations of City or department work rules, policies, procedures, or any other acts of misfeasance, malfeasance, or nonfeasance, shall be cause for disciplinary action.
Availability for Duty Where an employee is on availability duty (as defined by Clause 22.11 of the Award), he/she shall be paid an, ‘Availability for Duty Allowance’ of a minimum of $100.00 per week increasing to $105.00 per week on 1 July 2006, $110.00 per week on 1 July 2008 and $115.00 per week on 1 July 2010. Companies who have superior arrangements will maintain those superior arrangements.
Technical Objections to Grievances It is the intent of both Parties of this Agreement that no grievance shall be defeated merely because of a technical error, other than time limitations in processing the grievance through the grievance procedure. To this end, an arbitration board shall have the power to allow all necessary amendments to the grievance and the power to waive formal procedural irregularities in the processing of a grievance, in order to determine the real matter in dispute and to render a decision according to equitable principles and the justice of the case.
Extra Duty A. All extra duty vacancies listed in Article 29 (except as provided in 7-8-C) shall be filled by MBUs, providing they meet the following criteria.
Leave of Absence for College Committees An employee whose assigned work schedule would prevent her/him from attending meetings of a college committee to which s/he has been elected or appointed, will be granted a leave of absence from her/his regular duties without loss of pay or other entitlements to attend such meeting(s). Where such leave is granted, the employer will replace the employee as necessary. Costs arising from this provision will not be charged against the program area of the participating employee.
