UNFORSEEN EVENTS. If your vehicle is unavailable overnight due to being held in a mechanical repair shop, you will be refunded for that nights hire. For all out of pocket expenses, we recommend you take the highest level of travel insurance.
UNFORSEEN EVENTS. Sometimes due to unforseen circumstances (crash, vehicle theft, etc.) we are unable to supply the vehicle requested. Campervan Village will take no responsibility if the booked vehicle is not physically present in the depot and therefore not available due to external conditions beyond our control. We will always endeavour to supply a vehicle of similar quality and characteristics.
UNFORSEEN EVENTS. The CLIENT(S) cannot hold the Venue responsible for failure to provide the basic facilities and services due to emergencies, catastrophes, interruptions of public utilities or pandemics. If an Act of God were to occur preventing the event from taking place as scheduled, Venue will allow for the event to be rescheduled, pending availability, with no penalty.
UNFORSEEN EVENTS. The CLIENT(S) cannot hold the Xxxxxxx Xxxx Lodge responsible for failure to provide basic facilities and services due to emergencies, catastrophes or interruptions of public utilities. If an Act of God were to occur preventing the event from taking place as scheduled, Xxxxxxx Xxxx Lodge will allow for the event to be rescheduled, pending availability, with no penalty. Last minute cancellations of outdoor site due to inclement weather will NOT be considered for refunds.
UNFORSEEN EVENTS. The Operator will be free from liability for failing to perform hereunder due to industrial action, unsuitable weather conditions, technical problems or other events beyond the Operator’s reasonable control. The Operator shall endeavour to reschedule any Charter that is forced to cancel due to industrial action, unsuitable weather conditions and or technical problems within four weeks of the original charter. The weather shall be deemed to be unsuitable or dangerous at the sole discretion of the Master of the vessel and his decision shall relate only to safety of the vessel and its passengers. In the event that the Charterer cancels the Charter due to inclement but not dangerous or unsatisfactory weather, then the Charterer shall forfeit the deposit held by the Operator.
UNFORSEEN EVENTS a. Should the Venue be rendered unusable or unsuitable for the Event due to occurrences beyond SHU/ECPA’s control, this Agreement shall terminate and the Renter shall be responsible for paying only that portion of the Rental Fee and Estimate of Costs for the Venue attributed to the use of the Venue by Renter, if any, prior to such termination. If Renter has not made any use of the Venue prior to such occurrence, SHU/ECPA’s liability to Renter shall be limited to refund of any Rental Fee, Estimate of Costs and ticket receipts that SHU/ECPA has collected, less expenses incurred by SHU/ECPA in connection with the Event up to that point. SHU/ECPA shall not be responsible for any losses or other damages to Renter in the event of such occurrence.
b. SHU/ECPA shall not be obliged to perform any term or condition of this Agreement if such performance is prevented by: Act of God, War, acts or public authority, labor disputes, national or local calamity or emergency, fire or any other cause beyond SHU/ECPA’s reasonable control. “Labor dispute” will be deemed to include strikes, lockouts or picketing of the venue by representatives of any labor union having or claiming to have jurisdiction. In the event of any such occurrence which prevents the use of the Venue by Renter, SHU/ECPA’s liability to Renter shall be limited to refund of any Rental Fee, Estimate of Costs and ticket receipts that SHU/ECPA has collected, less expenses incurred by SHU/ECPA in connection with the Event up to that point.
UNFORSEEN EVENTS. The clients cannot hold Belle Acres Farm responsible for failure to provide the basic facilities and services due to emergencies, catastrophes or interruptions of public utilities. Belle Acres Farm will allow you to reschedule if possible. If an unforeseen event occurs preventing the event from taking place as scheduled, Belle Acres Farm will allow for the event to be rescheduled, pending availability, with no penalty. Cancellations of venue due to inclement weather will not be considered for refunds.
UNFORSEEN EVENTS. Client agrees that Southern Mono Historical Society and its officers shall not be liable for losses, damages (including attorney’s fees, court costs, and consequential damages), detention, delay or failure to perform in whole or in part resulting from causes beyond its control, including but not limited to acts of God, fires, weather conditions, power outages, inability to obtain supplies or requirements including any local legislation regarding liquor license requirements. Delays or non-performance excused by this provision shall not excuse payment of any amount owed by the Client at the time of said occurrence. If an event is cancelled in whole or in part because of a force majeure condition, Southern Mono Historical Society will allow for the event to be rescheduled, pending availability, with no penalty. Last minute cancellations of outdoor site use due to inclement weather will not be considered for refunds. For the safety of all involved, should hazardous weather occur, such as earthquake, severe thunderstorm, lightning strikes, etc., the Southern Mono Historical Society reserves the right to mandate taking shelter, stop alcoholic beverage serving, and require bands and musicians to switch to acoustic entertainment only, adjust volumes or terminate recorded music until hazardous weather is deemed no longer a threat. If hazardous weather requires the evacuation of our property for the safety of our guests, the event will be terminated, and guests will be required to vacate the premises.
UNFORSEEN EVENTS. Mitas Hill is not responsible for failure to provide the basic facilities and services due to emergencies, catastrophes or interruptions of public utilities. If an Act of God were to occur preventing the event from taking place as scheduled, Mitas Hill will not be held responsible. Mitas Hill reserves the right to move an outdoor ceremony inside within four hours of a ceremony due to inclement weather if there is a safety concern for you, your guests or Mitas Hill personnel. Mitas Hill is not responsible for any expenses incurred as a result of moving a ceremony to an alternate location. The Client may choose to move an outdoor ceremony inside due to inclement weather. The Client agrees to notify Mitas Hill at least four hours in advance of the scheduled ceremony time. Mitas Hill is not responsible for any expenses incurred as a result of moving a ceremony to an alternate location.
UNFORSEEN EVENTS. Neither you nor we will be liable to the other for any failure or delay, or for the consequences of any failure or delay, in performance of these Terms if it is due to any event beyond reasonable control and contemplation. This includes, without limitation, acts of God, war, industrial disputes, protests, fire, flood, storm, explosion, an act of terrorism and national emergencies.
